Najib’s announcement of scrapping of Batu Caves condo project if BN wins Selangor desecrates Deepavali as it is not a “triumph of light over darkness” but continued spreading of darkness to prevent the triumph of light

Despite the screaming headlines, “S’gor BN to scrap Batu Caves condo if we win” (Malaysiakini), “Najib promises Indians no Batu Caves condo if BN regains Selangor” (The Malaysian Insider), “PM: We’ll scrap Batu Caves project if we win Selangor” (New Straits Times); “Najib: Return Selangor to Barisan and Batu Caves ground will be safe” (Star) and “PM: Bt Caves development will stop if BN regains S’gor” (Sun), the first reaction of fair-minded, reasonable and patriotic Malaysians is one of distinct unease and discomfort, even feeling of being repelled by an inchoate sense that something is wrong or just not right in what the Prime Minister, Datuk Seri Najib Razak had done.

Why is this so? Why are these people, who want the 29-storey Dolomite Park Avenue condominium project to be scrapped, not welcoming Najib’s announcement with open arms and unqualified support?

This is also my immediate response. In 1980, I had announced a “DAP Save Batu Caves Campaign” to join forces with all conservationist and environmental groups to save the 500 million-year-old Malaysian natural heritage and the religious shrine of 800,000 Hindus in Malaysia by stopping all quarrying activities at Batu Caves.

Having saved Batu Caves once, DAP and Pakatan Rakyat would have no hesitation to spearhead another “Save Batu Caves Campaign” as a result of the MIC/BN approval of the 29-storey condo project in Batu Caves in 2007. SEPT 24 ― Civil society is under siege in Malaysia. That does not augur well for a nation, touted by the powers-that-be, to be the best democracy in the world. How on earth can anyone even begin to espouse a democratic way of life if he doesn’t even recognise the role civil society plays? Is this so-called democratic government effective or legitimate, at all?

According to a mainstream newspaper, some RM20 million was poured into 11 organisations in a plot to destabilise the government. RM20 million from genuine benefactors can destabilise the government when hundreds of billions plundered by present and past leaders have gone unchecked?

If at all the present government can be destabilised, it can only come from its own undoing! Don’t go pointing fingers at others. “Sila tepuk dada, tanya selera!”

A large part of humanity lives in darkness, even now in the 21st century. We have seen how, in Tunisia, fruit-seller Mohamed Bouazizi immolated himself to draw attention to police corruption and ill treatment. Will history show that this selfless act of sacrifice as an exercise in vain? I’m no soothsayer but I think history will show, in time, how a solitary act of selflessness and sacrifice will liberate a huge chunk of humanity. It always begins with that solitary act. Always.

When I first started working almost three decades ago, I saw a copy of Aliran on a table in the staff room. What I read both shocked and mesmerised me. The founder himself wrote with such courage and tenacity. I was instantly converted and started to subscribe to Aliran soon after.

From his writings, I learnt about inequality in society. I learnt about how each of us can play our role in bringing about a more equitable Malaysia. I read about how we should demand good governance and how we should hold the government of the day to account.

Now, when I read what “he” has to say, I die a little inside. He was one of those in civil society who could have resurrected our ailing nation to a new life. He could have taught us how to rise up to a tyranny. Continue reading “To free is to save”

Kita berkumpul di sini untuk menentukan dasar parti manakah yang lebih boleh memberi manfaat kepada rakyat Malaysia. Seharusnya, satu perbahasan patut diadakan di antara Perdana Menteri, Dato’ Seri Najib Tun Razak, dan Ketua Pembangkang, Dato’ Seri Anwar Ibrahim. Malangnya Perdana Menteri enggan berbahas dengan Anwar. Adakah Najib enggan berbahas dengan Anwar kerana beliau bimbang selepas perbahasan, rakyat akan membuat pernilaian bahawa Anwar lebih layak menjadi Perdana Menteri Malaysia?

In fact, MCA is not qualified to be here to discuss about policies because MCA does not decide, it is UMNO that decides. MCA claims to speak only for the Chinese, and yet only the Chinese in the Peninsula, and not the Chinese in Sabah and Sarawak. This is different from the DAP, that wants to speak for all Malaysians. DAP mahu bersuara untuk semua orang Malaysia: Melayu, Cina, India, Kadazan dan Iban, kerana kita semua rakyat Malaysia, bukan macam MCA, yang kononnya mahu mewakili orang Cina sahaja.

Mengapakah mesti kita terus dipecahbelahkan mengikut kaum dan agama? Inilah kejayaan terbesar UMNO. Mereka mahu kita takut satu sama lain supaya BN boleh terus merompak harta dan kekayaan Malaysia. Tengoklah skandal lembu dan kondo. Pak cik yang ternak lembu sepanjang masa tidak dapat pinjaman berjuta-juta ringgit, tapi keluarga menteri yang tak pernah ternak lembu boleh mendapat pinjaman 250 juta ringgit yang disalahgunakan untuk beli kondo pula. Jangan-jangan orang Singapura yang ada banyak kondo nak datang ke Malaysia belajar macam mana ternak lembu di kondo. Skandal PKFZ sebanyak 12.5 bilion ringgit telah melibatkan pemimpin tertinggi MCA tetapi ahli politik yang aktif tidak dibawa ke mahkamah. Semua skandal ini MCA tidak bersuara tetapi sokong buta sahaja. Kedudukan Malaysia telah jatuh dalam persepsi rasuah Transparency International daripada 37 dalam tahun 2003 kepada 60 tahun lepas (2011).

Kita harus bersatupadu sebagai anak Malaysia. Kalau kita terus dipecahbelahkan, hanya kroni-kroni dan orang-orang ataslah yang untung. Kalau kita bersatupadu, baru dapatlah kita semua menikmati hasil kejayaan ekonomi Malaysia.

Scandalous! Outrageous! Najib administration not serious about bringing Teoh’s killers to justice when MACC could take three times longer than TBH RCI to conduct internal probe into RCI findings on criminal transgressions of MACC officers

It is downright scandalous and outrageous – the Malaysian Anti-Corruption Commission (MACC) taking three times longer than the Teoh Beng Hock (TBH) Royal Commission of Inquiry (RCI) to conduct its internal probe into the RCI findings on the criminal transgressions of MACC officers resulting in Teoh’s death at MACC headquarters in Shah Alam on July 16, 2009.

And what is the outcome of such MACC internal probe? To decide on the disciplinary action to be taken against the three MACC officers whose “aggressive, relentless, oppressive and unscrupulous interrogation” had “driven” Teoh “to commit suicide”!

The MACC chief commissioner Datuk Seri Abu Kassim Mohamed said today that the MACC would first make its recommendations to its complaints committee before meting out appropriate disciplinary action against the trio.

Kota Belud MP Abdul Rahman Dahlan the worst racist and biggest liar in Parliament

An example of the draconian powers that remain in the Printing Presses and Publications Act (PPPA) 1984 despite the present batch of amendments and which are open to grave abuses are the “offences” provisions in the parent Act, like Section 8A on “false news” under which the Penang Chief Minister and DAP Secretary-General Lim Guan Eng was once a victim, being jailed for 18 months and deprived of his parliamentary status as well as his civil liberties.

How many cases of “false news” prosecutions have been instituted under the PPPA in the past 18 years?

All these years, the “false news” provisions have been used to victimise and oppress the critics of Barisan Nasional government, while Barisan Nasional leaders and publications enjoy immunity and impunity for all the lies and fasehoods they had perpetrated regardless of the adverse consequences to nation-building or national unity.

A good example is the UMNO organ, Utusan Malaysia which is the worst offender in concocting “false news”, for example in its lies about DAP wanting a Christian Prime Minister and a Christian Malaysia and the falsehoods that the DAP is anti-Malay, anti-Islam and anti-Malay Rulers.

PPPA amendments get nod after much acrimony

Parliament adopted the amendments to the Printing, Presses and Publication Act (PPPA) at 2.15am today as BN and opposition MPs fired verbal barbs at each other in a heated atmosphere.

Lim Kit Siang (DAP-Ipoh Barat) questioned the gvernment’s intentions to “truly allow for freedom of the press” ,dismissing the amendments to the PPPA as “mere baby steps”.

The major amendments include provisions to do way with the annual renewal of printing licences and publication permits as well as remove the absolute discretion of the minister on deciding whether to approve new applications or revoke existing ones.

“The Bill is to be debated in such a short time shows that the government is not interested in political transformation and the amendments were done without consultation, all the talk of transformation is just political mimicry,” Lim charged.

“These are just baby steps to press freedom. The prime minister has said under his leadership there is more press freedom and it was internationally recognised.

Former KL CID chief Mat Zain Ibrahim claims the A-G is looking after his own interest in deciding not to charge anyone over Teoh Beng Hock’s death.

PETALING JAYA: With the amount of skeletons in his closet, Attorney-General Abdul Ghani Patail would be “digging his own grave” if he prosecutes anyone over the Teoh Beng Hock’s death, said a retired senior policeman today.

Ex- Kuala Lumpur criminal investigation department(CID) chief Mat Zain Ibrahim said this was the reason why Ghani was being cowardly and ‘afraid’ to institute criminal proceedings against any persons recommended by the royal commission of inquiries (RCIs).

“It’s for his own survival. Ghani will not institute any criminal proceeding against any person or persons that are being recommended by any RCIs.

“It is not about lack of evidence or that the case needs further investigation from the appropriate Department or anything to that effect. The RCIs recommendations are valid and proper.

“I state without any hesitation, that Ghani is himself very afraid to take any actions.

“To institute any criminal proceeding against those persons would be like digging his own grave.

“It is like putting himself in the same boat with those people he is suppose to charge and prosecute.

AG intentionally snubs Agong’s RCIs, says former senior cop

KUALA LUMPUR, April 6 — Datuk Mat Zain Ibrahim added today the purported snubbing of the Agong to the list of accusations he has levelled against Tan Sri Abdul Gani Patail after the Attorney-General (AG) refused to say if his office would prosecute three anti-graft officers who allegedly drove Teoh Beng Hock to suicide.

The royal commission of inquiry (RCI) into the DAP aide’s 2009 death had recommended that action be taken against then-Selangor MACC deputy director Hishammuddin Hashim, assistant enforcement office Arman Alies and assistant superintendent Mohd Ashraf Mohd Yunus.

But the country’s top lawyer instead told reporters yesterday the case has been referred back to the Malaysian Anti-Corruption Commission (MACC) after emerging from a meeting with de facto law minister Datuk Seri Nazri Aziz and MACC investigation chief Datuk Mustafar Ali. The pointless Lynas PSC

MARCH 18 — Finally, the Prime Minister has come clean on something — last night he said that the parliamentary select committee on Lynas will not have the final say on the project.

Thank you, Najib Razak for this rare piece of honesty because now I will urge the Opposition and fair-minded Malaysians to boycott this committee and see it for what it really is: a public relations exercise by a government which is big on symbolism and gimmicks and nothing else.

According to Najib, the committee is supposed to engage the public and allay their fears about a project which has raised concerns about toxic waste and waste management.

Here is where the duplicity of the government shines through: they have given Lynas a temporary operating licence, have allowed the Australian company to build a plant, given them 12 years tax holiday, have rubbished fears from PKR’s Fuziah Salleh, have given the anti-Lynas movement almost no coverage in the media and have allowed the Atomic Energy Licensing Board to become a partisan outfit and now they want to have a process of consultation. Najib should apologise for his own mistakes first before apologizing for past BN mistakes resulting in the political tsunami four years ago

Four days after the Prime Minister, Datuk Seri Najib Razak extended an apology for past Barisan Nasional (BN) mistakes resulting in its loss of several states and electoral seats in the last general elections, it remains a mystery and state secret what were the mistakes Najib was apologizing for.

Nobody knew what past BN mistakes Najib was confessing and apologizing, allowing the Deputy Prime Minister Tan Sri Muhyiddin Yasin to immediately dismiss the need to find out what these “mistakes” were arguing that “the crucial thing now was to look ahead” and the UMNO Information chief Datuk Ahmad Maslan to make nonsense of Najib’s “apology” by declaring that “UMNO needs mandate to fix its mistakes”!

Does Najib himself know what past BN mistakes he was confessing and apologising for in Kedah last Saturday or was it a meaningless political rhetoric just to win votes?

While Najib mull over and decide what were the past BN mistakes which he is prepared to confess and apologise, let him apologise for his own mistakes first, especially those committed during his 35-month premiership.

PR MPs will remind Najib in March Parliament to honour his solemn undertaking to leave “no stone unturned” to find out the truth about Beng Hock’s death or face the censure of voters

For more than 30 months since his murder at the Malaysian Anti-Corruption Commission (MACC) headquarters at Shah Alam on July 16, 2009, justice have been denied to Teoh Beng Hock.

Despite an inquest, an exhumation, a Royal Commission of Inquiry (RCI) and solemn undertaking by the Prime Minister Datuk Seri Najib Razak to Teoh Beng Hock’s family that “no stone would be left unturned”, the full frightening story of the causes and circumstances for Beng Hock’s murder at MACC Headquarters have still to be told and full justice given to Beng Hock and family.

The Coroner Muntapha Abas in Beng Hock’s inquest had ruled out suicide but had returned an open verdict as there was insufficient evidence to prove that his death was a homicide.

The James Foong RCI came out with a finding overturning the verdict of the Inquest ruling out suicide – concluding that Beng Hock was “driven to commit suicide by the aggressive, relentless, oppressive and unscrupulous interrogation”.

This is most unacceptable finding as it was not based on any evidence but completely a leap in speculation by the RCI. It’s already 2012, could the PM please tell us when the Beng Hock case will be given due attention?

We, the family of Teoh Beng Hock, will be in Putrajaya at 9 a.m., 2 February 2012 for a Court of Appeal decision on the Teoh Beng Hock case judicial review.

In 2012 we are about to usher in the third Chinese New Year without Beng Hock and with the truth nowhere in sight.

We should like to ask: What actually happened on 16 July 2009 at the scene of Beng Hock’s death? Why have the various doubts we raised gone unanswered?

NOV 24 — PAC Chairman Datuk Seri Azmi Khalid was reported to be frustrated, when giving his comments on the National Feedlot Centre controversy. “The public is fed up”, he told reporters.

Firstly, I would like to ask Datuk Seri Azmi: why are YOU frustrated? How could you lament at the inefficiencies, wastages and corruption which have become ingrained in our civil service’s DNA, when the nation’s CEO (who by extension, happens to be your boss) went to a by-election with his “I help you, you help me” tag proudly on display? Here’s a management lesson 101 then:- down-liners apply the same principles and work culture that the top adopts. The down-liners are also good at doing going to sleep with their eyes open, when the same top delivers speeches peppered with virtuous sounding jargons, because most of them could pick out a “do as I say, but don’t do as I do” type, when they hear one.

In fact Datuk Seri, I wish to ask you, is feeling frustrated ALL that you could muster? Pardon me, but frustrated sounds a little polite for me in the light of what is revealed, year in-year out, by the Auditor General’s report. KUALA LUMPUR, Oct 28 — Teoh Beng Hock’s family today demanded that the police investigate the Malaysian Anti-Corruption Commission (MACC) officers named in the royal commission of inquiry (RCI) into Teoh’s death for contributing to the DAP aide’s death.

KUALA LUMPUR, Oct 27 — Teoh Beng Hock’s family accused the Najib administration of “taking grieving family members for a ride” by not pushing for criminal charges against three national graftbusters despite a royal investigation panel finding the trio contributed to the political aide’s death two years ago.

The Teohs said the government’s inaction casts serious doubt not only on the credibility of the Royal Commission of Inquiry (RCI) the prime minister foisted on the family, but its chairman, Federal Court judge Tan Sri Datuk Seri James Foong Cheng Yuen.

“What we do not understand is until today, why the government still thinks the RCI report does not carry enough evidence for commencing action against these officers who have abused their power, but spends more public funds to conduct another round of investigation?” the dead DAP aide’s family questioned in an email statement to The Malaysian Insider.

Very lame excuse – why AG not acting against MACC officers for Teoh Beng Hock’s death following James Foong RCI report?

The de facto Law Minister, Datuk Seri Nazri Aziz has given a very lame excuse why the Attorney-General is not pursuing legal action against Malaysian Anti-Corruption Commission (MACC) officers on Teoh Beng Hock’s death following the James Foong Royal Commission of Inquiry (RCI) Report – telling Parliament yesterday that no police report has been lodged over the matter.

Why didn’t the Attorney-General Tan Sri Gani Patail direct that a police report be lodged on Teoh Beng Hock’s death based on the findings and new leads in the James Foong Royal Commission of Inquiry Report?
The finding of the James Foong RCI into the death of Teoh Beng Hock (TBH) that “TBH was driven to commit suicide by the aggressive, relentless, oppressive and unscrupulous interrogation by certain officers of the MACC”(Para 119) is not acceptable as it is mere speculation and not backed up by evidence.

(a) Great flaw of TBH RCI report – failure to affix responsibility for TBH’s death on MACC despite evidence galore

The Teoh Beng Hock Royal Commission of Inquiry did not contribute to the restoration of public confidence in the independence, professionalism and integrity of key national institutions but their continued degradation.

A great flaw of the Teoh Beng Hock (TBH) Royal Commission of Inquiry (RCI) report is its failure to affix responsibility for Beng Hock’s death on the MACC although there were evidence galore before the RCI proceedings.

It was not just persons, namely various MACC officers led by Hishammuddin Hashim the then Selangor MACC Deputy Director and the “mastermind” of the illegal and massive 33-officer MACC “operation”, who must bear responsibility for Beng Hock’s death but also the institution of MACC as well. Merdeka! Are we truly free?

Corruption, nepotism, cronyism and the abuse of the judiciary and legislation have marred the significance of Aug 31.

COMMENT

Aug 31 is a day of reflection, of taking cognisance of the fact that the country’s independence or Merdeka can no longer be taken for granted, that too by the “keepers” of this nation.

Regrettably, it is the “powers that be” that have marred the meaning of Merdeka. Corruption, nepotism, cronyism and the abuse of the judiciary and legislation have marred the significance of Merdeka, especially for the younger generation.

Instead of imparting profound meaning to Malaysians, Aug 31 had been reduced from the sublime to the ridiculous by the power-hungry and “self-first” politicians-leaders of this country.

The fact is Malaysia is “independent” but only in name, not in act. The existence of draconian laws that are continuously abused by the “powers that be” to safeguard its position have turned the understanding of Merdeka into a laughing stock. Continue reading “Merdeka! Are we truly free?”

Decision on the second term of reference:

[119] Having considered all the evidence in its entirety, we found that TBH was driven to commit suicide by the aggressive, relentless, oppressive and unscrupulous interrogation to which he was subjected by certain officers of the MACC who were in the ongoing operation by the Selangor MACC on the night of the 15th and into the morning of the 16th.

– Forensic psychiatric aspects

[233] Tormented by this predicament, TBH experienced a change in his state of mind. And in a matter of hours, this change transformed him from being in the low-risk group for suicide into the high-risk group. The doubts, extreme emotional conflict and the immense feeling of guilt were all intolerable. Finally, precipitating the irreversible crisis that happened to him between 3.30am and 7.00am on the 16th, was the last straw that broke the camel’s back. Finding no viable strategies to surmount the hurdle of accusations levelled, he found himself unable to escape from the suffocating quagmire in which he was trapped. TBH would have felt trapped and have succumbed to despair. Since the window on the 14th floor was either open or could be easily opened and it was conspicuous and easily accessible near where he was on the sofa outside Nasdzri’s room, TBH would have found that the only way for escape from the torment he was undergoing was by jumping out of the window, even though it meant taking his own life….”
