Has the IGP really gone bonkers with the crackdown against all and sundry who crossed him?

Two days ago, I asked whether the Inspector-General of Police, Tan Sri Khalid Bakar had gone bonkers in his latest tweet command to his police subordinates to investigate University of Malaya senior lecturer, Dr. Khoo Ying Hoo for her article “Who owns the police” in The Malaysian Insider on 16th March 2015 under Section 500 on criminal defamation of the Penal Code when it is the height of the ridiculous to accuse of her of intimidation of the police although her article was quite critical of high-handed police actions.

Clearly, the IGP suffered from poor English comprehension problems.

This was not the first time when the IGP’s poor English comprehension led him to flex his IGP muscles, as the earlier ludicrous episode of his mistaking DAP MP for PJ Utara’s tweet on “Royal my foot” as an attack on Malay Rulers is still the joke in the country.

Unfortunately, the twitter trigger-happy IGP has committed a third transgression from his poor comprehension problem when the PKR Secretary-General and MP for Pandan, Rafizi Ramli was arrested because the IGP thought Rafizi was urging supporters to “break out” Anwar Ibrahim from Sungai Buloh prison – an idea which has never entered into anyone’s mind! Has the IGP gone bonkers as to order the police probe of UM lecturer raising the most legitimate questions about political protest and protest policing?

I read, re-read and read a third time the article “Who owns the police” by University of Malaya senior lecturer, Dr. Khoo Ying Hooi in The Malaysian Insider on 16th March 2015 and I still cannot fathom how it could be the basis for two police officers to question Khoo for one-and-a-half hours under Section 500 of the Penal Code for criminal defamation of the police – without committing a gross abuse of police power.

Has the Inspector-General of Police, Tan Sri Khalid Bakar gone bonkers in his latest tweet-trigger happy response to Khoo’s article on the same day, saying

“KYH’s article in MI is misleading the readers, When did @PDRMsia allow the 7th street protest?”

Khoo, in her article, had said that police “had earlier allowed the #KitaLawan rally on March 7 to carry on smoothly, but began their ‘arrest spree’ the next day” – with 11 people, including DAP Youth leader and MP for Rasah Teo Kok Seong, PKR Secretary-General and MP for Pandan, Rafizi Ramli, PKR Youth Chief and Selangor State Exco Member Nik Nazmi Nik Ahmad arrested over the March 7 rally.

When Khoo said the police had earlier “allowed” the March 7 rally to be held smoothly, it did not and need not mean that the Police had issued a police permit to hold a rally, as all that it meant was that the Police did not disturb or disrupt the rally and permitted it to be held smoothly.

What is wrong with that statement?

What is the “criminal defamation” against the police in such a statement?

Cops overstepping legal limits in ongoing public crackdown, lawyers say

KUALA LUMPUR, March 25 – The police are acting beyond their legal means by relying on a law provision that has been declared unconstitutional to arrest people for participating in public shows of dissent, lawyers said.

They argued that the authorities cannot continue to detain individuals using disputed laws when the courts have clearly ruled against the admissibility of such legislation, even if an appeal is still pending.

“This is a worrying development. The authorities seem to take the position that just because an appeal is filed, it means there is no finality to the interpretation of the impugned provision,” said civil liberties lawyer Syahredzan Johan.

Why is the twitter trigger-happy Inspector-General of Police, Tan Sri Khalid Abu Bakar, keeping quiet about the death and rape threats to BFM journalist, Aisyah Tajuddin, for questioning of hudud?

Khalid could swing into twitter action against Pakatan Rakyat leaders and NGO activists within seconds, but why he is keeping his silence for over 24 hours over the death and rape threats to Aisyab Tajuddin?

Is the IGP suffering from selective attention in the way the police authorities suffer from the sin of selective investigation and harassment of PR leaders and NGO activists (the latest victim being the 11th #Kita Lawan rally arrest of PKR Vice President and MP for Batu, Chua Tian Chang) and the Attorney-General suffer from the disease of selective prosecutions?

Surely Khalid is not going to plead ignorance about the spate of death and rape threats against Aisyab which appeared on the social media in the last 36 hours, and he should explain what he has done about it in keeping with the IGP’s self-professed high standards of police professionalism and efficiency?

In view of Khalid’s “fame| for his twitter-quick monitoring of events concerning PR leaders and NGO activists, Malaysians wonder and have a right to know what the IGP has done with regard to the death and rape threats on the social media against Aisyab Tajuddin. Zahid’s skeletons in the cupboard and the “stacks of letters and agreements” to US

Fourthly, we have the tragedy that the Home Minister, Datuk Seri Ahmad Zahid Hamidi cannot put the IGP on the right path, because he has his own skeletons in the cupboard.

Malaysians are still no nearer to the mystery of Zahid’s infamous letter to the Federal Bureau of Investigations (FBI) vouching for the character of an alleged international gambling kingpin without the knowledge or sanction of the Police, the Foreign Ministry, the Cabinet or the Prime Minister.

In fact, the whole episode has become very much murkier with the latest contortion by the Minister in the Prime Minister’s Department, Datuk Seri Shahidan Kassim that the federal government is satisfied “in principle” with explanations provided by Zahid regarding his infamous letter to FBI on Paul Phua. IGP’s English standard incomparably low

Thirdly, On Monday, DAP MP for PJ Utara, Tony Pua, tweeted in anger when he heard that Nurul Izzah was arrested under the Sedition Act in relation to her speech in Parliament last week when she went to the Dang Wangi Police Station to keep an appointment with the police for her statement to be taken over the #KitaLawan rally in Kuala Lumpur on March 7.

This attracted a tweet directive from the IGP, namely: “@PDRMsia akan panggil YB ini menjelaskan apa maksud beliau dgn ‘Royal my foot’. Adakah ditujukan kepada Raja2 Melayu?” (@PDRMsia will call this YB and ask him to explain what he means by ‘Royal my foot’. Is this aimed at the Malay Rulers?)

Khalid was referring to Pua’s tweet “Bastards. Real bastards. Royal my foot”.

I agree that Pua’s tweet was in bad taste. But it was not a crime. Was Pua’s tweet aimed at the Malay Rulers?

Not to mention the police officers, I believe the overwhelming majority of school children with decent command of English language will give the IGP a strong unambiguous answer – No, it is not aimed at the Malay Rulers but the Royal Malaysian Police. IGP’s misguided war against PR leaders/NGO activists when he should declare war on IS

Secondly, the IGP’s misguided war against PR leaders and NGO activists when he should have declared war on Islamic State, which is misleading Malaysian Muslims to join them Iraq and Syria to commit atrocities like beheadings, public stonings and mass massacres.

On Monday, the Wall Street Journal in its opinion piece titled “Malaysia’s Creeping Authoritarianism” following more police crackdown marked by the arrest of two MPs, referred to 19 Islamic State supporters who had been arrested for plotting attacks around Kuala Lumpur last year.

Up to now, Malaysians have not been told the full story of the 19 Islamic State supporters who had been arrested for plotting attacks around Kuala Lumpur last year, but the twitter trigger-happy IGP seemed to be more pre-occupied with his “war” against PR leaders and NGO activists, who only wanted to expand the democratic space for Malaysians to qualify as a fully developed nation in 2020. than the serious war waged by Islamic State in Malaysia. Committee of Privileges should haul up IGP Khalid over the police breach of parliamentary privilege over false arrest of Nurul Izzah and to decide how the police could purge itself for utter contempt for institution of Parliament

I hope to highlight several issues which the veteran MP from Gua Musang Tengku Razaleigh on Monday said has caused a “historic juncture” as Malaysia’s economic and political situations are in a “gridlock” and teetering on crisis.

Firstly, the police arrest of two MPs, the DAP MP for Rasah Teo Kok Seong on Saturday and the PKR MP for Lembah Pantai Nurul Izzah Anwar on Monday, and their overnight remand at the Jinjang Police Station, and in the case of Kok Seong, the police sought another four-day remand but the magistrate only allowed remand for another day.

The police knew well beforehand that Kok Seong and Nurul would be reporting at the Dang Wangi Police station but on the day in question, the police did absolutely nothing to record their statements after their formal arrest, in order to justify an overnight remand for both at the Jinjang Police Station.

This is not police efficiency and professionalism at their best, but police pettiness and vindictiveness at their worst.

Nobody blames the police personnel at Wang Dangi for such petty and vindictive abuse of police powers, showing utter contempt and disrespect not only to Kok Siong and Nurul but also the institution of Parliament!

Nobody believes that the ordinary police rank and file are capable of such pettiness and vindictiveness against MPs. I do not believe that senior police officers would want to exhibit such police pettiness and vindictiveness which do not reflect well on police efficiency and professionalism – and such police abuses of power and contempt for MPs, particularly from Pakatan Rakyat, can only come from the command of one person, the Inspector-General of Police, Tan Sri Khalid Abu Bakar. Why is IGP Khalid declaring war on Pakatan Rakyat when he should be declaring war on Islamic State? Is IGP for UMNO/BN or for all Malaysians?

DAP MP for Rasah and DAPSY Chief Teo Kok Seong is the sixth victim of the police crackdown on organisers of the Kita Lawan peaceful rally last week.

He was arrested under Section 143 of the Penal Code when he reported to the Dang Wangi district police headquarters at 11 am this morning, for his statement to be recorded as arranged beforehand.

The Kita Lawan rally was held peacefully to protest against the five-year jailing of Parliamentary Opposition Leader Datuk Seri Anwar Ibrahim.

The other five who had been arrested for the peaceful rally are PKR Youth chief and Selangor Exco Member Nik Nazmi Nik Ahmad, PKR Vice Chairman/Secretary-General/ MP for Pandan Rafizi Ramli, PKR Youth leader Saifullah Zulkifli, PKR Supreme Council member Fairiz Musa and PAS Youth treasurer Fakhurazi Mokhtar.

PKR Vice President and MP for Lembah Pantai Nurul Izzah Anwar is expected to be the next target.

Kok Seong has been sent to the Jinjang Police Station where he would be remanded overnight. Is the police planning for a longer remand for Kok Seong, like the further three-day remand in the case of Nik Nazmi?

Something is really “rotten in the state of Denmark” when the twitter-happy IGP can chop and change on an important issue on police investigations into the RM42 billion 1MDB scandal

On February 10, former Prime Minister Tun Mahathir Mohamad quoted Shakespeare’s Hamlet on “something is rotten in the state of Denmark”, and this sense of “rottenness” in Malaysia is increasingly exacerbated with passing weeks and days.

When the twitter-happy Inspector-General of Police Tan Sri Khalid Abu Bakar can chop and change on an important issue on police investigations into the RM42 billion 1MDB scandal, something is really rotten in the “state of Denmark” in Malaysia.

On Monday, 9th March, the Inspector-General of Police, Tan Sri Khalid Abu Bakar caused quite a media sensation when he announced a high-powered three-agency special task force to investigate the biggest financial scandal in the nation’s history, the RM42 billion 1MDB scandal comprising the police, the Malaysian Anti-Corruption Commission (MACC) and the Attorney-General’s Chambers.

But Khalid, who said the task force would even investigate the Prime Minister, was contradicted by the MACC Chief Commissioner Abu Kassim Mohamed who said on the same day that the MACC would wait for the Auditor-General’s report on 1MDB before starting its own probe.

The MACC Chief Commissioner seemed to be unaware of the three-agency task force on 1MDB which Khalid said was formed the previous week.

The IGP and the MACC should clarify whether there is such a three-agency special task force on the 1MDB or whether it only existed in the imagination of the IGP.

But strangest of all, the very next day, Tuesday, 10th March, Khalid backtracked and announced that the special task force would only start their investigations into the 1MDB after the Auditor-General had completed his scrutiny and uncovered discrepancies and wrongdoings. The present meeting of Parliament is providing multiple examples of a hydra-headed government.

For instance, the Home Minister Datuk Seri Zahid Hamidi in a written answer to the DAP MP for Kulai, Teo Nie Ching, said police have completed investigations on incendiary statements by Umno leaders, the Agriculture and Agro-based Industries Minister Datuk Seri Ismail Sabri Yaakob and the former Deputy Minister in the Prime Minister’s Department, Datuk Dr Mashitah Ibrahim and are waiting for further instructions from the Attorney-General.

A total of 32 police reports were lodged against Ismail over his call for Malay consumers to boycott Chinese businesses as a way to force down the prices of goods while ten police reports were lodged against Mashitah, who had said that Chinese people had burned the Quran in a religious rite in Kuala Kedah, which was a downright lie as it never happened.

But while the Home Minister said that the Police are waiting for instructions from the Attorney-General, another Minister, the Minister in the Prime Minister’s Department, Datuk Seri Shahidan Kassim, cleared Ismail Sabri of any offence or any crime! The Twitter habits of Inspector-General of Police (IGP) Tan Sri Khalid Abu Bakar got an endorsement from the home minister, who said today using the social media platform to make announcements did not break any laws.

Instead, it was aimed at keeping the public informed on the police’s actions and was not politically motivated or out to scare anyone, Datuk Seri Ahmad Zahid Hamidi said.

Police have always acted professionally, maintained law and public order, and set out to detect and eradicate crime without fear or favour, he said today.

Why is the Police fighting a losing war with Islamic State – has IS developed a local leadership structure in Malaysia with dedicated recruiters scouting for new recruits for the terrorist movement in Syria and Iraq?

Yesterday, the Police announced that “A civil servant said to be one of the most senior Islamic State (IS) members in Malaysia and a 29-year-old housewife who recruited a 14-year-old girl into the militant movement are among three people detained by Bukit Aman”.

The 39-year-old civil servant was arrested by the Bukit Aman Special Branch Counter-Terrorism Division in Kuala Lumpur on Monday while the housewife was picked up in Muar on Saturday.

The third suspect – a 22-year-old trader – was also arrested in Perak on Monday.

The civil servant, described by the police as “a senior IS member with direct links to Malaysians in Syria”, is believed to have used his position to recruit members to ensure the local militant network ran smoothly.

This is most shocking news. How “senior” is the civil servant who was arrested, and who are the more “senior” IS leaders in Malaysia?

The IGP should be non-partisan professional top policeman to uphold law without fear or favour and not to act like the Security Chief of Prime Minister to harass and persecute dissent

I commend the Inspector-General of Police, Tan Sri Khalid Abu Bakar for his composure and being unfazed by a video of three men threatening to blow up his car with him inside it, which is expected of all holders of public office and trust when confronted with extremist threats to cow them from carrying out their public duties.

Khalid sets a good example in declaring that he is not intimidated by the death threat against him, his denunciation of the group known as “Anak Malaysia Anti Demokrasi” as irresponsible for not respecting parliamentary democracy and not knowing the real meaning of democracy.

All Malaysians will support the firmest actions taken by the authorities to punish severely those involved in IS-type videos to threaten violent acts, including murder the current IGP, as Malaysians must not allow such deplorable culture to take root in the country.

On Feb. 15, a video was uploaded under a You Tube account named ISIS Malaysia 69 which featured four masked men threatening to light up fireworks in courts across the country, which was followed by another one, featuring a group of three individuals that called themselves Anak Muda Anti-Democracy (AMAD) on Tuesday which threatened to kill Khalid, by blowing up his car with him inside it.

The last thing Malaysia needs is the introduction of IS-type of barbarities and atrocities on our shores.

A day before the IS-type video death threat to Khalid, I had issued a statement criticizing the IGP for a wrong sense of priorities, setting up the world’s first police special unit on sedition for him to twitter instructions to harass Pakatan Rakyat leaders and NGO activists while overlooking the bigger national threat of Islamic State extending its tentacles to vulnerable young Malaysians including 14-year-old boys and girls. Has IGP completely lost his sense of priorities – setting up the world’s first police special unit on sedition for him to twitter instructions to harass PR leaders and NGO activists while overlooking the big national threat of Islamic State extending its tentacles to vulnerable young Malaysians including 14-year-old girls?

Many Malaysians must be asking whether the Inspector-General of Police, Tan Sri Khalid Abu Bakar has completely lost his sense of priorities in setting up a special sedition unit called D5 for him to twitter instructions to the police officers attached to the unit to investigate and harass Pakatan Rakyat leaders and NGO activists while overlooking the real big national and international threat of Islamic State (IS) extending its tentacles in the country to vulnerable Malaysians, including 14-year-old girls?

Neither Parliament nor the country had been informed that sedition crimes have become so serious and ubiquitous that the Police have deemed it necessary to set up a special unit called D5 with special police officers who can and must respond immediately to the IGP’s twitter commands to act against PR leaders and NGO activists on sedition and whole variety of other speech crimes.

Undoubtedly, Khalid has made a name for himself in the international fraternity of No. 1 policemen in the world, for he must be the first head of police in a country to set up a special unit on sedition, as if Malaysians have just set a new world record as the most seditious people in the world!

At a time when the IGP’s eye must be unfailingly focused on the new real crime and threat not only to Malaysia and the world – the rise of Islamic State with its siren appeal to Malaysian Muslims for a Muslim Caliphate stretching beyond national borders and space – Khalid’s focus is fixed in the wrong direction.

This has caused him to set up D5 and arrogating to himself the supreme task of roaming the cyberspace so that he could tweet directives to D5 police officers as to who are the PR leaders and NGO activists to harass and investigate, and undoubtedly, laying down a deadline when the D5 officers have to comply to report to him as to how they had carried out their instructions. Sirul should make a clean breast of the truth about the 2006 murder of Altantuya – admit to being one of the two killers, demonstrate true remorse and spell out the outrage that he is sentenced to death while the murder “mastermind” is allowed to get away scotfree

Former police special commandore Suril Azhar Umar should stop hiding and running which he had been doing for the past nine years but to take a honest stand to make a clean breast of the truth about the 2006 murder of Mongolian Altantuya Shaariibuu – admit to being one of the two killers (together with Azila Hadri), demonstrate remorse at the heinous deed “under orders” and spell out the outrage that he is sentenced to death while the murder “mastermind” is allowed to get away scot-free.

The time has also come for Sirul to make a public declaration of his first confession to the police on November 9, 2006 on the Altantuya’s murder.

Although his confession to the police was declared inadmissible by the Kuala Lumpur High Court during Sirul’s trial in July 2007, Sirul must now declare whether his confession represented the truth.

On Feb. 3, 2009, a tearful Sirul had asked the court not to sentence him to death for Altantuya’s murder, saying he was like “a black sheep that has to be sacrificed” to protect unnamed people who have never been brought to court or faced questioning.

“I have no reason to cause hurt, what’s more to take the life of the victim in such a cruel manner,” Sirul said. “I appeal to the court, which has the powers to determine if I live or die, not to sentence me so as to fulfil others’ plans for me.”

In his Nov. 9, 2006 confession to the police, which had been ruled inadmissible in the Altantuya murder trial, Sirul said his boss at the time, Chief Inspector Azilah Hadri who is also charged with Altantuya’s murder, had talked about a reward of between RM50,000 and RM100,000 if the case was settled. Sirul is showing to the whole world the “feet of clay” of the Inspector-General of Police, the Attorney-General, the Judiciary and the Prime Minister in their mishandling of the 2006 Altantuya Shaariibuu murder case

The last thing former police commando Sirul Azhir Umar wanted to do is to show to the world the “feet of clay” of the Inspector-General of Police, the Attorney-General, the Judiciary and the Prime Minister in their mishandling of the 2006 Altantuya Shaariibuu murder case.

In his first telephone interview with Malaysiakini on Tuesday 17th February, Sirul said:

“I was under orders. The important people with motive are still free.

“It is not like I do not love the police (force) or the country, but I acted under orders.”

But this is exactly what Sirul has done, for in one fell swoop he had exposed the “feet of clay” of the pillars of our country, the Inspector-General of Police, the Attorney-General, the Judiciary and the Prime Minister.

Many Pakatan Rakyat leaders, including the DAP MP for Bukit Gelugor Ramkarpal Singh, who is also lawyer for the family of the murdered Mongolian, have called on the Inspector-General of Police, Tan Sri Khalid Abu Bakar to initiate fresh investigations into Altantuya’s murder after Sirul claimed that he was ordered to kill her.

The IGP, however, is obstinate that the police will not re-investigate Altantuya’s murder even though new allegations have surfaced on the ground that Sirul had not divulged information that merited renewed scrutiny into the case. ‘Zahid broke OSA in writing FBI letter’

EXCLUSIVE A former top cop has accused Home Minister Ahmad Zahid Hamidi of breaking the Official Secrets Act (OSA) by writing the letter to the United States Federal Bureau of Investigation (FBI) to clear gambling kingpin Paul Phua Wei Seng.

This is because the information contained in the police investigation files is classified under the OSA, unless it has been declassified, former Kuala Lumpur CID chief Mat Zain Ibrahim said.

The Official Secrets Act 1972 (Act 88), or OSA, is a federal law in Malaysia that prohibits the dissemination of information classified as an “official secret”.

Mat Zain said Zahid disbursed ‘secret’ information to unauthorised parties, such as the FBI and to the lawyers for Phua, Shafee Abdullah in Malaysia and Messrs Chesnoff & Schonfeld in the US.

In an email to Attorney-General Abdul Gani Patail on Jan 19, Mat Zain said Zahid had broken the law in writing the letter and stating that Phua is not a member of the 14K triad.
