DAP condemns arson attack on MACC vehicle and advises Nazri against making baseless insinuations of DAP involvement

DAP condemns the arson attack on a Malaysian Anti-Corruption Commission (MACC) vehicle today.

As reported by Malaysiakini, four Molotov cocktails were thrown at the Klang MACC office at around midnight, destroying a four-wheel drive vehicle belonging to Selangor MACC.

MACC officers only realized the damage to the vehicle, a Nissan X-Trail, when they reported to work this morning.

There must be a full and thorough investigation to bring to book the culprits from whatever quarter responsible for the arson as no rational Malaysian regardless of race, religion or political affiliation wants to see any degeneration of Malaysia into growing lawlessness. Leaders To Bring Us Together

In having to appoint a Royal Commission of Inquiry to investigate the Malaysian Anti Corruption Commission (MACC) following the death of one of its witnesses, Prime Minister Najib clearly demonstrated his lack of leadership and inability to be in command of a rapidly evolving crisis. Essentially, events forced Najib’s hand; he was reacting, not leading.

Najib is not a leader, at least not the type Malaysia desperately needs today. His meteoric rise in the party and government is less an expression of talent, more the gratitude his party has for his late father. For his part, Najib has not shown any indication that he benefited from those splendid opportunities. On the contrary, like a spoiled child, those amenities merely indulged him.

Unfortunately for Najib, more so for the nation, there are no ‘training wheels’ to the Prime Minister’s office.

Teoh family rejects Cabinet decision and demands comprehensive RCI into TBH’s death

I have come to Alor Gajah for the media conference by the family of Teoh Beng Huat who has just announced that they reject the Cabinet decision yesterday on the mysterious death of Teoh Beng Hock, who went to the MACC Hqrs as a healthy, vigorous and idealistic political worker but ended up as a corpse.

The Prime Minister, Datuk Seri Najib Razak and the Cabinet Ministers seem to be Malaysia’s David Copperfields, creating the illusion of a Royal Commission of Inquiry (RCI) in Teoh’s death when actually there is none.

Like Teoh’s family members, I had at first welcomed the Cabinet decision when there was at first news that it had decided on a RCI on Teoh’s death but when the details of the Cabinet decision became known, we were all dumb-founded, shocked and outraged.

What is the use having two inquiries, with an inquest into Teoh’s death but a Royal Commission of Inquiry strictly prevented from delving into the causes of Teoh death but only to probe into the MACC’s investigative techniques? MCA, Gerakan, MIC Ministers must speak up to get support of UMNO Ministers in Cabinet on Wednesday to censure Berita Minggu and Mingguan Malaysia and in particular New Straits Times editor-in-chief Zainul Arifin

The Cabinet has a heavy responsibility when it meets on Wednesday as a result of the extraordinary death of Teoh Beng Hock, 30, the political secretary to Selangor DAP State Exco and State Assemblyman for Seri Kembangan, Ean Yong Han Hwa who went to the Malaysian Anti-Corruption Commission (MACC) Shah Alam to co-operate in its investigations but end up as a flying corpse from the 14th floor MACC Hqrs the next day.

I am not asking the Cabinet to decide on the establishment of a Royal Commission of Inquiry into Teoh’s death as I expect the Prime Minister, Datuk Seri Najib Razak to announce the establishment of the Royal Commission of Inquiry tonight on his return from abroad – if he has ears close to the ground to keep close touch with the pulse of the nation.

I do expect the Cabinet to address several important issues which have cropped up as a result of Teoh’s death, the public outcry of rage and outrage as well as the reactionary reactions to such legitimate nation-wide feelings and responses.

One such reactionary reaction is the distortion, manipulation and incitement of the most racist and communal discord in the country as illustrated by articles in Berita Minggu and Mingguan Malaysia yesterday. Nation mourns for Teoh Beng Hock

Leaving PJ now for Alor Gajah for Teoh Beng Hock’s last journey.

Nation and all right-thinking people mourn for Teoh Beng Hock.

Even more, they mourn for the country and people.

Nation in shock, grief and anger – greater shock, grief and anger than four days ago when the dastardly deed was committed.

Let us transform our shock, grief and anger into People’s Power to change Malaysia so that there will not be another Teoh Beng Hock and death in custody, whether MACC, Police or any other government agency in Malaysia.

Let Us Clean Up The Police Force And MACC To Make Malaysia Safe For Our Children

I do not know Teoh Beng Hock.

But now every Malaysian who reads will know who is Teoh Beng Hock – his open pleasant face, his distraught fiancé and his twisted body lying grotesquely on the Malaysian Anti-Corruption Commission (MACC) building imprinted indelibly in our minds.

I vaguely remembered meeting him once. He was one of the many idealistic, bright and young Malaysians who joined the DAP after the political tsunami on 8 March 2008 that transformed our political landscape.

Teoh wanted to participate in the flowering of democracy and forge the real changes that promised equal opportunity, good governance and justice. Teoh wanted to be part of this amazing transformation shaping his country and future. He wanted to serve the public, through his position as a personal assistant to a Selangor State EXCO member.

This wish to serve has tragically cost Teoh his life, taking him away from his loved ones. Denying his parents of a son, his fiancé of her husband and his unborn child of a father.

3-point formula to resolve the Kedah Pakatan Rakyat crisis – resolution of outstanding complaints by Kedahans, a committee headed by Dr. Goh Cheng Teik to resolve abbatoir problem and a PR trouble-shooting state mechanism

Yesterday, I had a 90-minute meeting with the Kedah DAP State Committee followed by a two-hour dialogue with the people of Kedah in the Kedah Chinese Assembly Hall, with overflowing capacity crowd, over the Kedah DAP State Committee’s decision on Wednesday to pull out of the Pakatan Rakyat Kedah state government.

I had my hands full in Parliament on Wednesday, with a host of burning issues such as the RM12.5 billion Port Klang Free Zone scandal; the urgent need to have a new Inspector-General of Police to provide new police leadership and vision to create an efficient, incorruptible, professional world-class police service which is regarded as friend and protector of the people and capable of performing the three core functions to keep crime low, eradicate corruption and uphold human rights; and Parliament becoming a kangaroo court to punish eight Pakatan Rakyat MPs when the subject is the punishment of Umno Youth leaders who had obstructed and threatened wheelchair-bound DAP National Chairman and MP for Bukit Gelugor Karpal Singh from discharging his parliamentary duties in the precincts of Parliament on February 26, 2009.

I was shocked when I heard the news about the Kedah DAP State Committee decision to pull out of the Pakatan Rakyat Kedah state government, subject to the final decision of the DAP Central Executive Committee. A Pig in a Poke

High Chaparral, the pig abattoir, the race card, double standards…. What you see is not what you get. It seems as if many politicians – and I use that term to also include some activists – have gotten all hot under the collar about the DAP’s failings in the Kampung Buah Pala and for locking horns with PAS on the pig abattoir matter in Kedah.

Get a grip people. First, Hindraf and Uthayakumar needs to cool-off; perhaps have some refreshing chendol and think through the High Chaparral matter a bit more constructively. Does he really think Lim Guan Eng is in bed with the developers? For a lawyer, he must know better the potential implications of a breach of contract – in this case, a contract the former state government – had undertaken – under the former chief minister’s watch. Yes, perhaps a stroke of the pen by the current chief minister may save the homes of the residents of Kampung Buah Pala. But at what cost to the rest of the residents of the state? Now that the current DAP state government finds itself in a dilemma like this, does it not matter what it might cost the rest of the residents of Penang to go back on their word? Relativism and the Politics of Absolutes

Studying Malaysian politics is a chore in itself, but rewarding for the simple reason that it is one of the most plural, complex and complicated countries in the world. Among all the countries that I have worked on, it is Malaysia that continues to challenge my capacity to think (and relax) for the simple reason that its communitarian mode of sectarian politics is an odd blend of modernity and primordialism that is seldom equalled anywhere else.

At present the opposition coalition known as the Peoples Alliance (Pakatan Rakyat) is once again in a state a crisis – or rather manifold crises – as the component parties bicker over the mode of governance in the states that they won after the elections of March 2008. Bringing together the predominantly Chinese-Malaysian Left-leaning DAP, the multiracial PKR and the overwhelmingly Malay-Muslim Islamists of PAS was never an easy task; and it was said from the outset that the coalition was an instrumental one.

Today however the coalition is once again at breaking point after the DAP threatened to leave the coalition over a dispute over the destruction of a pig abattoir in the state of Kedah, disputes over contracts awarded to development projects in Penang and Selangor, and the lingering fear that the Islamists of PAS will push their Islamisation agenda in the states that have come under their control. Seemingly trivial matters such as the sale of pork and alcohol have forced all three parties to the defensive, with each party holding steadfast to its stand. Suddenly the MCA President, Datuk Seri Ong Tee Keat himself has led a ferocious political charge against me, challenging me to state my stand on the resolutions tabled by PAS at its muktamar last week and wanting me to apologise for misleading and betraying the Chinese community for supporting Pas.

Did Kit Siang and Karpal commit sedition?

Prelude – please read it before reading the article

I write this article so as to apprise the people who, in the mind of the general public, have taken the law into their own hands through the harassment of law abiding citizens of this country with the threat of using the Sedition Act 1948 on them. They should not have done it without first taking expert legal advice on the technical and difficult law of sedition under the Act.

After you have read this article, I am sure you will agree with me that the law of sedition is not easy for a layman to understand. Even lawyers and judges have found great difficulty in understanding it – let alone an uninitiated policeman. If the police are not careful, one of these days they will find themselves at the receiving end of a suit for malicious prosecution, false arrest or whatever the victims of their harassment would throw at them.

I hope you will bear with me if this time I am not able to explain difficult law in simple language as much as I would like to. It is at a time like this that I really appreciate the great ability of the late Lord Denning who was so adept at explaining difficult law to us ordinary folk. Don’t tell Najib the truth or risk charge of sedition/criminal defamation!

I believe the overwhelming majority of the people, in Perak and Malaysia, agree with what I said at the Guar Perahu ceramah – that Najib must bear the greatest responsibility for the protracted Perak political and constitutional crisis, set off by Najib’s unethical, undemocratic, illegal and unconstitutional power grab in Perak, which has now broadened into a larger national crisis of confidence of key national institutions, like police, election commission, MACC, civil service, judiciary, whose credibility, legitimacy and integrity have been compromised in serving Najib’s political agenda.

Are there enough court houses for the police to prosecute the overwhelming majority of Malaysians who think alike with me and are there enough prisons for them if they are convicted of the serious offences of sedition and criminal defamation of the Prime Minister?

What really surprised me is not that the police are investigating a police report lodged against me for sedition and criminal defamation, but that the police report was lodged by the police itself.

Chief Inspector Pang Meng Tuck lodged the police report against me because, as the police recording officer for the PKR Penanti by-election ceramah in Guar Perahu, Kubang Semang on Sunday, 24th May 2009, he was of the view that my speech defamed the Prime Minister, Datuk Seri Najib Razak and was seditious. Are there enough courts and prisons?

This has never happened before. I could not finish the blog “Speaking the truth is sedition and criminal defamation in Najib’s Malaysia” as I was just too tired to continue.

Had a series of very hectic days recently, not only with multiple issues but having to regularly triangulate three places, Petaling Jaya, Ipoh and Penang – not to mention having to cover Malacca and Bangkok as well.

Thought I would get a short nap before completing the blog. Instead I slept like a log of wood for nearly four hours.

There are already 24 comments on the unfinished blog. Instead of finishing it, I am writing a new blog.

Speaking the truth is sedition and criminal defamation in Najib’s Malaysia

ASP Norazizi bin Saad took a statement from me following a police report lodged by Chief Inspector Pang Meng Tuck, CID, Seberang Perai Tengah Police, on 25th May 2009 that my Penanti ceramah speech at Guar Perahu, Kubang Semang on Sunday night (24th May) was sedition and criminal defamation against the Prime Minister, Datuk Seri Najib Razak.

In my speech, I had blamed Najib as being responsible for Perak political and constitutional crisis because of an unethical, undemocratic, illegal and unconstitutional power grab, resulting in the expansion of the crisis of confidence, with one national institution after another, such as the Police, Election Commission, MACC, civil service, judiciary compromising their credibility and legitimacy as they just serve Najib’s political agenda.

In Najib’s Malaysia, speaking the truth has become sedition and criminal defamation. Darkness is descending on Malaysia. Malaysians must not be cowed.

What is shocking is that this police report against me for sedition and criminal defamation did not come from some members of the public, but by the Police itself. Insp. Pang’s report was on the directive of senior police officers, ASP Subramaniam Sanaassy and ACP Nasir Salleh.

PDRM’s 3 minutes to disperse….. 1,2,3 Catch, Catch, Catch!

It is now clear that the assurance given by Justice Syed Ahmad Idid to Anthony Clement Skinner (who is now the Kota Kinabalu High Court Judge) in the case of Datuk Yong Teck Lee v PP & Anor 1993 1mlj 295 has travelled through the intestinal passages of abuses of constitutional protection of citizens and now awaits it’s final moment. To be flushed down in the toilet bowl.

Skinner’s (as he then was and whom I know as a judge blessed with enviable judicial temperament) fears were well founded as he provided an illustration of the extensive powers of the police under the Police Act 1967 and the likely abuses by the police.

“‘If three school boys decide to go to the cinema for a film show, they cannot do so. It is illegal to do so unless they have a licence from the OCPD to do so. Any steps taken in furtherance of the intention (without a licence) would render the meeting or assembly illegal and any person taking part thereto shall be guilty of an offence.”

PDRM: A tale of the tail wagging the dog

MAY 25 — The only reasonable conclusion I can draw as a reasonable man from the PDRM raid on the DAP headquarters last Saturday evening is that the police leadership need their heads examined for signs of mental degeneration.

It was Euripides (480–406 BC) the Greek playwright who said, “Those whom God wishes to destroy, he first makes mad.” Police behaviour in recent times has convinced me more than ever that there is something rotten in the state of our country, with apologies to William Shakespeare.

The beleaguered police, as far as we are concerned, are in moral retreat. It beggars the imagination that with all the relentless assault on their reputation, they do not seem to care one iota about public opinion.

This is frightening self-indulgence. To be deaf to public strictures is really a symptom of a deep malaise associated with a diseased culture of impunity that has brutalised the police psyche.

Najib is the primary target in Penanti by-election – referendum on his first 2 months as PM

The Penanti by-election has been described as a dull and unexciting contest because of the absence of the Barisan Nasional candidate.

The PKR and PR candidate, Mansor Othman is challenged by three independent candidates. The real battle however is not between Mansor and the three independent candidates, but with the main protoganist publicly “hiding” from the contest, the Barisan Nasional and its leader, Prime Minister Datuk Seri Najib Razak.

Although there is no BN candidate, Najib is undoubtedly the primary target in the Penanti by-election, which is a referendum on the credibility, integrity and legitimacy of Najib in his second month as Prime Minister

Last night, Najib allowed the police to do what five previous Prime Ministers, Tengku Abdul Rahman, Tun Razak, Tun Hussein Onn, Tun Mahathir and Tun Abdullah had never done – police raid on DAP Hqrs in Petaling Jaya, the first time in 43 years, as if the DAP is a terrorist organisation when we had demonstrated our commitment to peaceful, democratic and constitutional change for over four decades.

The Prime Minister, Datuk Seri Najib Razak should apologise for what five previous Prime Ministers had not done in the 43 year history of the DAP – police raid on DAP Hqrs as if the DAP is a terrorist organization like Al Maunah.

I was enroute to Air Kala for a DAP branch function and had stopped in Sauk for dinner for its famous fresh-water fish, jerawat and malau, when I received a phone call at 6.27 pm from DAP IT manager, Goh Kheng Teong that a police party of 12 in plainclothes had brought along a handcuffed DAPSY political education director Ooi Leng Heng in a police raid of DAP hqrs.

I was unable to tweet the outrageous police action as I could not access the Internet with Maxis 3G and I later authorized Goh to update the twitter on my behalf.

Why has Najib, who had committed himself to an open and democratic premiership only seven weeks ago, allowed the police to go on a rampage to the extent of doing things which the previous five Prime Ministers had not allowed the police to do for 43 years – a police raid on DAP Hqrs as if the DAP is a terrorist organization like Al Maunah.
