MACC police report against Dr. Pornthip – double test case for Selangor CPO Khalid and new MACC Chief Commissioner Abu Kassim

Last week, Selangor Chief Police Officer Datuk Khalid Abu Bakar announced a second police report lodged by the police over the mysterious death of DAP political aide, Teoh Beng Hock at the Malaysian Anti-Corruption Commission (MACC) headquarters in Shah Alam on July 16 last year.

Khalid said the police would be hauling up the Selangor DAP State Chairman and Selangor State Exco member Ean Yong Hian Wah under Section 506 of the Penal Code and the Communications and Multimedia Act 1998 for allegedly intimidating the police in “directing” the police to cease their investigation of Penang Chief Minister and DAP Secretary-General Lim Guan Eng for sedition.

Will Khalid direct the Selangor police to lodge a police report against himself, for Khalid had been guilty of the offence of publishing “false news” under the Printing Presses and Publications Act as Hian Wah never “directed” but merely urged the police to stop their baseless investigation of Guan Eng.

Three days earlier, the Selangor police had lodged police report against Guan Eng for his speech at the Pakatan Rakyat national convention on December 19 for expressing national sentiments that the mysterious death of Teoh Beng Hock was a case of murder.

On New Year’s Day, the MACC lodged two police reports over the Teoh Beng Hock case – one by MACC officer Hisham Mohd Yusoff against Suara Keadilan and the other by MACC officer Raub Ghani against Thai pathologist Dr. Pornthip Rojanasunand for “leaking” information to unauthorised people on the forensic report of the second post-mortem on Teoh on Nov. 22.

In his police report, Raub said: “This report is made because every action of Dr. Pornthip was contrary to court’s decision and would further undermine MACC’s image”.

What Raub did not realise is that it is short-sighted and malicious actions like the MACC report against Dr. Pornthip which are responsible for plunging public confidence in the efficiency, independence and professionalism to a lower depth – especially as Dr. Pornthip has denied being responsible for any “leak” of information in an interview with Sin Chew Daily.

The question Malaysians want to know is whether the Selangor CPO Khalid will lodge or direct the Selangor police to lodge police report against MACC for trying to intimidate Thai pathologist Dr. Pornthip over her inquest testimony in October of 80 per cent probability that Teoh Beng Hock’s death was homicide and not suicide!

The MACC police report against Dr. Pornthip has in fact become double test case for Selangor CPO Khalid and the new MACC Chief Commissioner Datuk Abu Kassim Mohamed.

Abu Kassim Mohamed cannot take the report by his MACC officer Raub against Dr. Pornthip lightly and pass the buck to the police, claiming, “If they have lodged police reports, let the police conduct their investigation”.

This is in fact Abu Kassim’s first critical test as the new MACC Chief – whether he approves of the police report lodged by MACC officer Raub against Dr. Pornthip with all the implications and consequences including the MACC endorsing or condoning the MACC being used to intimidate Dr. Pornthip from giving truthful testimony at the Teoh Beng Hock inquest.

As the new MACC chief, Abu Kassim cannot wash his hands and disclaim responsibility for a police report lodged by a MACC officer which further undermines public confidence in the MACC.

Either Abu Kassim assumes full responsibility for the MACC police report against Portnthip or he should direct the MACC police report to be withdrawn by Raub if it does not have sanction and authorization of the MACC and the MACC does not want to start off under him with a new scandal of the MACC maliciously trying to intimidate Dr. Pornthip from truthfully giving her expert testimony on the cause of Teoh Beng Hock’s death at the inquest.

  1. If Selangor Chief Police Officer Datuk Khalid Abu Bakar and MACC officers Hisham Mohd Yusoff and Raub Ghani are so keen in serving their political masters, they should quit their jobs and enter politics full-time instead of hijacking Teoh Beng Hock’s case to further their political interests.

  2. Khalid had failed his SPM, so don’t blame him for failing to know the difference between the words “directed” (mengarahkan) and “urged”(mendesakkan). Cut his graduate salary and put him back into the PMR pay scale.

  3. Valuable lessons we learned the past years. Democracy in the third world is not merely political parties contesting for political offices. If you are in the opposition, the fight is with the “whole government” – the political leadership, the civil service, the police, the judiciary, the AG, the MACC, local authorities, the teaching professions, the universities, and the Inland Revenue. It is daunting indeed. I pray that when the opposition should someday be in power, they will begin to dismantle and depoliticise all these for the sake of our nation’s future. The sake is high for politicians; it is higher for this nation.

    I wonder how this CPO Khalid is going to earn respect from all his sibdordinates in the Police Force! His subordinates may not be convinced about the fact that they have an unprofessional apple-polishing CPO who sits at the helm of Selangor Police Headquarter. One of his subordinates may just think that it is much better to have Khalid been replaced by him in view of Khalid’s paying attention in employing certain kinds of cheap trick and low tactic in performing the apple-polishing job like lodging a police report against a State EXCO member from the Opposition front.

    Will CPO Khalid please resign with immediate effect from the Police Force? There are many other much more competent and professional-like Police Officers who are impatient to wait for taking over Khalid as the CPO of Selangor!

  9. The police report against Dr. Pornthip is just plain silly. First of all, the person doing the lodging of report did not possess any evidence that Dr. Pornthip had actually leaked the information. He merely inferred that a criminal act had taken place by reading a news article. Is this what you call investigative police work?

    A report against Suara Keadilan may still be acceptable, but a report against Dr. Pornthip ? And now we know that she did not leak any information and therefore have committed no crime? Am i to be blamed if someone leaks my report to the press? Please, investigate who leaked the report before filing police reports!

    Seriously, with this kind of incompetent police work by the officers in MACC, no wonder the real criminals in Malaysia are having a field day robbing and looting in broad daylight.

  10. MACC Officers’ lodging report against Dr. Pornthip is just one move out of a series of harrassment actions which have been planned by Najib’s administration for buying time to delay the legal proceedings of the coroner court.

    Najib knew that no matter what the outcome of the coroner court’s inquest could be, the end result would still be deemed as having negative impact on the political image of Barisan Nasional. Najib’s think tank have decided that the inquest should be postponed and postponed until some day in a few years later when the critical witnesses have been lost of touch by the Prosecution side or already passed away! This is the old tactic which has often been employed by BN politicians for stopping the disclosure (that may be done through the due process of law by carrying out the proper legal proceedings) of any truth which is deemed to have possible negative impact on the power-that-be.

  11. The police report made by MACC officials against pathologist Dr Porntip of Thailand for contempt of court creates the perception that MACC and the government do not want the truth known.

    Dr Porntip has clarified that he had not revealed the findings about the second postmortem on Teoh Beng Hock. So, it is not known whether MACC officials had definite and direct evidence on Dr Porntip revealing the information, in advance of the enquiry set for 7 January 2010. The court would consider evidence presented to it by the expert under cross examination. Whatever that has been said and speculated outside the court would not change the decision of the judge. So why should MACC allow its staff to engage in petty offence against a foreign expert on the question of contempt of court, even if Dr Porntip ‘leaked’ information in advance? She has not leaked any information, in keeping with her professional ethics both inside and outside Thailand.

    It is most unbecoming of MACC to have its official engage in intimidating expert witness by making the police report. Dr Porntip would not be intimidated had such a report been made in any other country. But Malaysian police has shown that it manhandled the Speaker of the Perak Legislative Assembly, and the police also limited the scope for Malaysian pathologists to work on the first postmortem on Teoh Boon Hock. That should have convinced Dr Porntip that Malaysia is a police state or worse, and that her safety cannot be assured when she provides expert opinion which most likely would go against the wishes of the government. The government is implicated by MACC action.

    It would appear that since MACC has no more credibility that it would not mind what the public think about it. MACC’s only concern was to prevent Dr Porntip appear before the Enquiry.

Malaysian now rely on miracle to take place, in order to restore trustworthy and justice, Karma will act on behalf of God Almighty. Let us pray together so that the power of Karma took place asap. This suggestion that “Selangor DAP State Chairman and Selangor State Exco member Ean Yong Hian Wah” should be hauled up “under Section 506 of the Penal Code and the Communications and Multimedia Act 1998 for allegedly intimidating the police in “directing” the police to cease their investigation of Penang Chief Minister and DAP Secretary-General Lim Guan Eng for sedition” is implausible and illogical because one may ask : what powers (whether legal, temporal mor spiritual) does Ean Yong Hian Wah have to be able to intimidate the police?

    If he has no such powers then he is in no position to intimidate the police.

    In fact the opposite is likelier true: it is the police that are in the position of judge, jury and executioner to lodge reports against him, investigate him, recommend to AG his prosecution, and if he were so charged, to arrest him. It is therefore the police who are in the position and within powers to intimidate Ean Yong Hian Wah and not the other way around because Ean has no such powers!!!!

    Lets not twist white to black the facts and reality of the unequal power equation in the case of Ean and the police here.

    The above blog news has shown us another evidence that the system of parliamentary democracy by westminster style constitutional monarchy of Malaysia is still a very fragile and immatured democratic system. If any religious group of its own religious upholding does not have the strong will to exercise a reasonable degree of self-restraint and self-control in their beaviour of encroaching upon the religious freedom of the other religious group, it is likely that a tragic conflict which may impair the national unity will occur contrary to our wish.

    It is time now for us to stand firmly by the side of justice and righteousness, no matter how strong the resistance can be coming against us in view of a huge stumbling block of religious fanaticim standing ahead of us.     So, does it mean that when a policeman on patrol suddenly witnesses a robbery in progress, he has to first return to his police station to lodge a report before he can return to the scene of the crime to take action?

  23. How did MACC goons jump to the conclusion that Dr. Pornthip had leaked the result of the 2nd autopsy?

    This could only have happened if they have a guilty conscience that she had found the truth and leaked the truth.

    If MACC is confident that they were not responsible for TBH’s death then they would just go after Suara Keadilan and leave Dr. Pornthip out of it. To them, Pornthip could have found nothing incriminating. But due to their guilty conscience they assumed that Pornthip had leaked the truth. Their behaviour is exactly that of a guilty person.
