Best Hari Raya present Najib can give country is to declassify all Cabinet minutes and documents relating to PKFZ scandal

In the past five-and-a-half months of his premiership, Datuk Seri Najib Razak had made valiant attempts to project his administration’s commitment to reform, accountability, integrity and good governance as exemplified by his slogan of “1Malaysia. People First. Performance Now”, his website, walkabouts and his emphasis on KPIs with the appointment of two KPI Ministers.

But all these efforts by Najib had failed to convince the Malaysian public that the Prime Minister is committed or capable of fundamental change in government.

One important reason is the long drawn-out farce of the RM12.5 billion Port Klang Free Zone (PKFZ) scandal – resulting in the public fallout between the MCA President and Transport Minister, Datuk Seri Ong Tee Keat and the Barisan Nasional Backbenchers Club (BNBBC) Chairman Datuk Seri Tiong King Sing who is also the CEO of the PKFZ turnkey contractor Kuala Dimensi Sdn. Bhd and other political skirmishes in MCA, Umno and Barisan Nasional.

For the past three consecutive days, fugitive blogger Raja Petra Kamaruddin has published on his website Malaysia Today documents including Cabinet papers throwing light on the extent of Cabinet involvement in the PKFZ scandal, snowballing from a RM1.1 billion scandal in 2002 under Tun Dr. Ling Liong Sik as Transport Minister to RM4.6 billion in 2006 under Tan Sri Chan Kong Choy and now set to become a RM12.5 billion scandal under Ong Tee Keat.

Does the Prime Minister deny the veracity and authenticity of the official and Cabinet documents about the PKFZ scandal revealed by Raja Petra on his website, whether they fall under the Official Secrets Act or otherwise?

Have these documents been brought to the attention of the Parliamentary Public Accounts Committee (PAC) investigating into the PKFZ scandal, and if not, isn’t it right and proper that the PAC should extend its sessions on testimony from witnesses to bring these documents within its cognizance before reaching its end stage to formulate its conclusions and findings for submission to Parliament?

The person most suitable to be summoned by the PAC to throw light on these official and Cabinet documents would be none other than the Cabinet Secretary Tan Sri Mohd Sidek Hassan who was appointed to the highest civil service position in September 2006.

In fact, the PAC should question Mohd Sidek to find out why in the past two years he had failed to carry out the Cabinet decision to investigate and take the necessary action against those responsible for landing the government and country with the RM12.5 billion PKFZ scandal – especially on the unlawful issue of the four Letters of Support by the former Transport Ministers, Ling and Chan!

The failure of the PAC to summon Mohd Sidek to give testimony in its inquiry into the PKFZ scandal will be a major and even fatal one affecting the credibility and acceptability of the final PAC report.

In fact, it is precisely because of Mohd Sidek’s failure to carry out the Cabinet’s decision in 2007 to investigate and take the necessary actions against the culprits of the PKFZ scandal that there is widespread skepticism and cynicism about the Super Task Force under his chairmanship into the PKFZ scandal announced by Najib last week – as it smacks of being a Super “Cover-Up” Task force more than anything else.

For this reason, the PAC should suspend its deliberations on its conclusions on the PKFZ inquiry to summon the Chief Secretary as Mohd Sidek’s testimony can completely change the entire character of the PAC’s findings, especially in the light of the official and Cabinet documents published by Raja Petra on his website in the past three days.

The best Hari Raya present Najib can give the country on his first Hari Raya as Prime Minister is to declassify all Cabinet minutes and documents on the PKFZ scandal to send out two unmistakable messages to the nation and the world , viz

  • his commitment to accountability, integrity and good governance and that he and his administration have nothing to fear or hide in the PKFZ scandal; and

  • an end to the culture of impunity and that no one implicated in the PKFZ “mother of all scandals”, regardless of his position or status, whether in MCA, Umno or any Barisan Nasional party, is above the law and will be brought to justice so that the RM12.5 billion PKFZ scandal will not end up as another “heinous crime without criminals” like the RM2.5 billion Bumiputra Malaysia Finance (BMF) scandal three decades ago.

Otherwise, the coming Hari Raya holidays will be another gloomy one in terms of public accountability, integrity and good governance.

  1. Quite interestingly rpk put is as no one has done anything wrong for everything that was done was actually what was suppose to be done. Cabinet gave approval and everyone knew what was going on. It is just us – the fools outside cabinet and umno who are not aware. So it no wonder that 12.5b did not come as any surprise to them.

Latest is that ex MB of Selangor Khir Toyo is claiming to have received a death threat letter should he topped the PR led state government. Just ask the question has anyone received any similar threat yet that Perak state was stolen by BN? So who wrote that death threat letter to Toyo? His own man under his instruction???????

But if what rpk revealed is true – those rahsia docu – then it would appear that najib is well aware of what went on in pkfz. He could have explained the case himself and given an account of the issue without going through the rounds and rounds of inquiries and task force. I dont know how vinayak would feel if he discovered that he has been roped in by najib to those endless rounds of wayang.

    Review isa – wayang.
    Another merit-based scholarship category – wayang.
    Open up some sectors of gobermen services for non-umnoputras – wayang.

    When Parliament commences in Oct 09, you must do all you can to give the BN cadre no rest, until they take full responsibility for the mess that is PKFZ.

    It is very clear to many, that this Super Task Force is just a convenient means to provide the proverbial “carpet”, with which to sweep the dirt under.

    You must sound the alarm loudly in P’ment, YB. After all, it was your relentless 3-questions-a-day to OTK that applied the decisive pressure so as to allow the Malaysian public to get the PKFZ reports & info as it stands today.

    PS – While you are at it, can you also pls knock some sense into this PM of ours, with regards to his new “pet project” in the form of 1Malaysia F1?

    The last thing we need now is a sequel to PKFZ.

    If PKFZ project has been originally designed by the collaborators of Umnoputras and the corrupted Big Heads of Chinese-based political party like MCA and the suspected vilest conspirator Dato Seri Tiong for purpose of siphoning out the Federal Government’s funds for the sake of personal gains among the interested culprits, then it will not be easy to demand the BN cabinet members to actually commit themselves with much effort in order to expose the inside out of the PKFZ scandal.

    The majority of Malaysian people may ask the BN leaders to show a much better commitment for public accountability, integrity and good governance but the political reality simply will not allow PM Najib to disclose too much about the truth of PKFZ scandal.

    In view of the huge debt which they owed to the financial institutions through highly geared debt-financing, it seemed that many next-of-kins or siblings of top BN politicians had not been able to get themselves bailed out of the debt-ridden situation even three years after happening of currency crisis during July 1997-August 1998. Since the BN thieves had already acquired the state-of-the-arts technique of stealing the public funds for personal gain throughout many years’ experience when sitting at the helm of political power, it was no wonder why such a malpractice of gross financial indiscpline as getting the Ministry of Finance to stand as guarantor for issuance of fund-raising bonds by a private company like Kuala Dimensi Sdn Bhd could be detected in the politician-initiated and professional-engineered money squander infrastructure project like PKFZ project.

    If PM Najib is to dig further into the root-cause of PKFZ scandal, it is quite likely that he will risk himself of unplugging the whole root system of continuing survival for Barisan Nasional. Since Najib has been given a warning by Pak Lah openly on the possible disintegration of BN if PKFZ issue is allowed to be probed further without restraint, it is highly questionable for us to anticipate that Najib will continue to show a strong commitment in the disclosure of truth about PKFZ scandal.

    The widespread skepticism and cynicism about the Super Task Force under the chairmanship of the Cabinet Secretary Tan Sri Mohd Sidek Hassan for the suspected purpose of covering up the PKFZ scandal are not simply an unfounded allegation by the Opposition. PM Najib’s stake is too high in PKFZ scandal if he continues to allow the PKFZ issue to explode and break up the unity among several BN component parties which have conflict of interests with their respective leaders’ direct involvement in PKFZ turnkey contract and Bonds issuance of Kuala Dimensi Sdn Bhd with Ministry of Finance serving as the surety of the Bonds!

    I won’t be surprised that the investigation into PKFZ scandal is going to be another effort in vain in view of no serious commitment from the top politician of Barisan Nasional! In case there is any one single politician who is really keen to have the truth being uncovered, it is quite likely that he/she will eventually be singled out and isolated from the mainstream investigating team of the PKFZ probe by the mainstream political power within Barisan Nasional. No wonder we already saw some clues that Dato Seri Ong Tee Keat would be gradually phased out from his original role of active involvement in PKFZ probe. All these cover up steering positions had been made possible with PM Najib’s choosing a sharp turn into another diversion, through the monitor of a new driver Tan Sri Mohd Sidek. The diversion so made is going to be one which would show less harmful to the membership unity among the component parties of Barisan Nasional!

    I think Najib is trying to ‘pasang kaki’ the MCA inquiry. Remember that in 2008 it was Tiong who organized the MP’s trips to Taiwan and HK to ‘study agricultural techniques!’ So, UMNO owes Tiong big time and now it looks like payback time!!

    Please keep hammering away and don’t let Najib NFA the $12.5 billion PKFZ fraud and scandal.

    On another note, earlier this evening I heard Kerismudin say on NTV 7 News at 8 that he was sad Nordin Top was dead because they did not have an opportunity to capture and rehabilitate him!!

    Please take him to the cleaners on this matter. He seems to have absolutely no understanding of the issues at hand like compassion for the hundreds of innocents killed by Nordin’s lethal bombs in Bali and Jakarta!!

    What will he say when Osama is killed? That he was a great benefactor to Islam?

    If I were PM Najib, I will sack him today, especially after his fiasco over the cow’s head incident!

  9. Mr Najib will have to do some drastic makeover before I am convince that he meant business in reforming the country… in thoughts, deeds and consistency.
    Granting a few citizenships and permanent residency certificates won’t fool me… will the approach be consistent and FAIR going forward.

    If that statement is made and how can Najib now declassify all documents including the 18 pages?

    So it is also for the Special Task Force on PKFZ to confirm the documents of 18 pages.

  13. Former PM Badawi had a good idea but did not have a plan to carry out that idea. Najib has all sort of plans but not a single good idea behind it. Anyone with half an education who says this is better is committing intellectual molest.

    There is no administrative or management solution that is satisfactory to Malaysian without first a political solution. How far can you tackle corruption when its acceptable politically? How far can you tackle waste when its even deemed necessary political funding? How do you push efficiency and productivity when being uncompetitive is deem a ‘birth right’?. Its pushing an entire mountain of cotton through a pin-hole.

    The crime of Najib-Muhiyiddin adminstration and its a lot worst than Badawi’s is that they got the cart-before the horse. Its nothing but prodigal son behaviour that makes nothing and lives of the legacy of the their forebears..They look better, they sound better BUT they are prodigal, underserving and a waste…

    Party elections are based on votes cast during the general assembly, and delegates vote in secrecy. The results show the collective decision of the persons who attended the meeting and voted. The number of nominations a candidate received has no influence on the result. That was why in the original UMNO constitution, a candidate needs only nomination from two Divisions to be qualified to stand for election, of any vacant position including the presidency. The fact that Tengku Razaleigh obtained 20% of the nominations but 50% of the votes cast would not change the outcome, if there was no blackout during vote counting, and Tengku Razaleigh had won with 50 votes. In fact TR needed only two nominations to stand under the original election rules.

    That was money politics at the Division level. If Mahathir was sincere in ensuring that the best leaders were elected, he should have allowed the old two-nomination rule to stay. But he would have reduced his influence on party elections when positions of party leaders in government did not exert excessive influence. He certainly knew about the emergence of money politics with that bonus votes; he could not be that naïve.

    AAB must have been quite useless to withdraw from the contest fearing that he could not muster enough nominations to qualify, and is now being referred to by his best friend by enemy standard. That was the results of cold war among friends; those who had government ministerial positions. Those who are out of the government stand no chance, however bright and capable he might be; Tengku Razaleigh is a case in point. He is undoubtedly a better candidate for president than Mahathir but obtained only one nomination from the division he headed. He might not have been nominated otherwise.

    The people however few there may be once offered unfair advantage would not want to give it up. Mahathir started the system, and he should have known about the defects in it. Why did he not abolish it during his term? A double standard or jealousy which is it, or both?

    There had been suggestion that a person must have held a lower position for two terms before he could be qualified to stand for a higher post. A youngest person having been a vice-president for two terms would certainly make it to be the President, when old vice Presidents die in due cause. UMNO election enters the era of longevity rather than capability.

    Why can’t they go back to the system of UMNO 1946 rather than Mahathir’s system of UMNO 1988?

  15. PKFZ is a project for wealth creation, of the persons who developed it.

    The land where PKFZ stands was alienated to a cooperative society for a specific purpose. If the land was not utilized as asked for, it should have been returned to the state government.

    The land was sold to Kuala Dimensi most probably after the government has decided that PKFZ would be developed in that area. It is the usual practice that the government acquires land even owned by private individuals when the land is needed for development purposes, such as it is needed for PKFZ. The compensation would be the market value assessed based on the use put to the land. Kuala Dimensi acquired the land at RM 1.5 per square foot. Since the land had not been approved for housing, the value of the land could be valued at most at what it could be used for, such as for coconut plantation. At RM 1.5 a square foot or RM 63,840 an acre, the land is over priced for plantation use.

    When PKFZ forcibly acquired the land from Kuala Dimensi, it should be at the price the government is willing to pay Kuala Dimensi as compensation. Since Kuala Dimensi purchased the land for a year before it was forcibly acquired by PKFZ, the compensation paid for the land by the government should be at cost plus financial charges. Kuala Dimensi has the right to appeal to the court for fair compensation.

    PKFZ sits on a thousand acres of land, and Kuala Dimensi might have developed some areas of it when it was sold, but not the entire land areas of 1,000 acres. RM 25 a square foot might be the price for a housing land in the remote area, but that price should not have been applicable to areas, 99% of which remained undeveloped. At RM 25 a square foot, the 1000-acre land costs RM 1.064 billion. How can the Minister or the Finance Minister, including the Prime Minister believe that the project could be self-financing with a budget of RM 1088 billion when it had only RM 24 million left for developing it after paying 97.8% of it for land? PKFZ has failed to be operational within the approved budget 1.088 billion the moment it bought the land from Kuala Dimensi. Why did the project continue, and who had approved the proposal to acquire the land at that price?

    The government would have saved 90% of the cost of land had they allowed the court to decide fair compensation rather than purchasing it on the negotiated basis. Why were the ministers and the PKA general manager became so generous with paying for the land at that price when they were aware that with 2.8 % of funds left in the approved budget, they were not able to implement the project on self-financing basis. In that case, RM 1,064 would be wasted on a land which could offer no other use than to be sold off, and with obviously no taker at that price? Did the Prime Minster tell PKA and the minister-in-charge to go ahead even when he was told that 97% of the approved budget was spent on useless land if it remains undeveloped? Or was the PM not informed of the actual situation?

    What had been the plan of Kuala Dimensi on the use of the 1,000 acres of land when it bought the land? Was Kuala Dimensi privy to the knowledge of PKFZ plan before it acquired the land? Why was the function of PKA when turn-key contractor did all the development work? Was PKA only a cashier?

As far as you have the minimum IQ, we know this evil project are the master mind of BN and its cabinet ministers. They all know about it and it was a scheme used by BN to reward the cronies.

    Any way, it was more interesting to watch what RPR has to said on who insulting Islam.

  18. It is plain as day that the PKTZ fiasco have all the blessings from the Cabinet. As such they must all resign for having committed this heinous crime against the Rakyat or are accomplices in the committing fraud with the Rakyat’s money. As TDM said any self respecting lawmaker should commit Hara Kiri to save their face. Najis and his gang must be made answerable. What super Task force ? Super Cover-Up force more likely!!

    Friends said that these 2 guys are now dirt rich. Of couse there r many many others as well especially those big tail snakes. And by now they would have hide their $$$$$$$$$$$$$$$$ nobody will know.
    It is indeed amazing till todate nobody is penalized or names mentioned after all the evidence are there. Instead our PM and all government agencies are busy trying to nail the very people who revealed these evil, corrupted scandals. This is real Bolehland.
    Just look at those corrupted and evil crooks giving hard times to the MCA guy who recently reveal this. God helps him.
