AG, IGP ‘cleared’ in black-eye case

Attorney-general Abdul Gani Patail and inspector-general of police Musa Hassan have both been cleared of any criminal involvement in Opposition Leader Anwar Ibrahim’s black-eye case, according to the Minister in the Prime Minister’s Department Mohd Nazri Abdul Aziz.

He was replying to Gobind Singh-Deo (DAP-Puchong) as to why no action has been taken by the authorities after Anwar had lodged reports with the police and the then Anti-Corruption Agency (ACA) last July.

Subsequently, the ACA – now called the Malaysian Anti-Corruption Commission – set up an independent panel to probe the case.

The panel members were Kadir Sulaiman, Wira Mohd Nor and Ahmad Nor Abdullah – all former judges from the Federal Court and Court of Appeal.

According to Nazri, the investigation by the panel began on July 2 last year.

“The investigation was completed two months later as it was considered a sensitive and high-profile case,” he said.

“After a detailed investigation, they found the AG and the IGP did not commit any wrongdoing relating to the case as alleged by Anwar.”

He further said that each of the panel members had to probe the issue independently in order to draw their own conclusion on the matter.

However, several opposition MPs were not convinced by the minister’s answer, stressing that there had been no information on the case after the investigation was completed.

In his supplementary question, Gobind queried Nazri as to when the panel had made the decision and why there had been no disclosure on this earlier by the authorities.

“We have also not been informed whether any action has been taken against the suspects,” asserted Gobind.

Nazri said the authorities required “ample time to make the decision public so that it would not be doubted by some parties”.

Lim Kit Siang (DAP-Ipoh Timor) then questioned Nazri as to who had made the final decision, since the investigation had been conducted independently.

“Let’s say one of them decides that the AG is guilty. In that case, who makes the final decision?” asked Lim.

Nazri explained that the decision was made based on the majority view, and in this case, all three members had found no case against the IGP, and only one had found a case against the AG.

He however refused to divulge further details.

Later at a press conference, Anwar, who is also de facto leader of PKR, said it was typical of the government to “manipulate” the facts adduced to the MACC.

“It is not easy to bring a case against those two without evidence, and it also depends on what has been submitted,” said Anwar.

He further accused Nazri of using the Parliament as a place to “defend the case” as the latter chose to reply in the House this morning.

Anwar: I’m disgusted

Anwar said he was “disgusted” with the finding and said the government did not provide full details of his complaint to the investigating panel.

“I believe there is a cover-up because it involves the VVIPs.
I am disgusted, I think it is very unfortunate with all the evidence provided, they can brush it aside,” he told reporters at Parliament.

“It is typical of the government – you give them strong evidence, medical reports, they refuse to act and allow them to go free,” he said.

Last month, Anwar had lodged a police report claiming that the AG and the IGP were involved in a conspiracy to fabricate an arrest warrant in 1998.

Anwar had also accused Abdul Gani and Musa of fabricating evidence in an investigation into the beating he received by former police chief Abdul Rahim Noor while in police custody.

Anwar, then deputy prime minister, was arrested and jailed for corruption. A sodomy conviction was later overturned on appeal.

The oppposition leader had said the involvement of Abdul Gani and Musa was further affirmed by a defamation suit against him last October by Mat Zain Ibrahim, the investigating officer who probed the ‘black eye’ incident.

Mat Zain had stated that Abdul Gani, who was then a senior deputy public prosecutor, delayed the investigation process and concealed facts from then AG, the late Mohtar Abdullah.
Musa was the investigating officer into previous cases against Anwar, where the former DPM was accused of abuse of power, corruption and sodomy.

Police report last July

In his police report last July, Anwar had alleged: “I believe Musa and Abdul Gani were present in Bukit Aman on Sept 20, 1998 and knew about the assault by Rahim Noor on me.

“Musa and Abdul Gani further concealed the fact of the assault on me from the public until my black eye and injuries were revealed in court.

“I believe both Musa and Abdul Gani were actively involved in the procuring of the second undated (medical) report by Dr (Abdul) Rahman (Yusof) which makes false and incredible conclusions (regarding his injury).

“They gave instructions to Dr Rahman to proceed to write this second report and were acting under the direction and/or jointly with Mohtar.

“These facts show that Musa, Abdul Gani and Mat Zain (who, according to Dr Rahman’s second report, accompanied him to the cell in Bukit Aman where I was detained and participated in the so-called reconstruction of the scene) conspired with Dr Rahman to procure the production of this second report.

“This was done so that my police report of Sept 27, 1998, in respect of the assault would be regarded as a false police report for which I could be charged, or at the very least, to damage my credibility, so as to affect my defence in the other criminal cases where I was charged for so-called corruption and sodomy to facilitate a conviction.”

    The AG and the AGP were rewarded by Mamakthir, and similarly we can expect the pathologist at the Selayang Hospital to be elevated, the Judicial Commissioner in Ipoh to be promoted, and the MACC Commissioner to be rewarded. This is the inevitable truth in Bolehland, and it can only end when BN’s reign ends.

  3. The verdict is a given, the investigation was for arriving at it. The 2-1 score had also been decided, but the person taking the different positions was decided by chance. There is no need for unanimous verdict when 2-1 serves as well. Besides, it gives the impression that the former judges were allowed a freehand.

    When Lingam proved to the world that he could influence the appointment of judges, the quality of those who served during TDM’s throne is suspect. The fact that the two suspects were cleared says that former judges have creative means of creating doubts and in utilizing technicalities to support predetermined decision.

    The IGP, the AG and Najib are trinity of police state and they have shared destiny.

    When no action is taken against 18 big sharks, when practically everyone is a saint in the Lingam case, when there is always “insufficient evidence” etc etc, you know you are going to be “violated”.

    And so the IGP and AG are very good men, of high integrity and honour and have been working very “professionally” all this while.

    They say “possession is 9/10 of the law”, so if one controls everything, then their opponents will have uphill battles to fight, like with the SLA and JC in Ipoh. Its all “legally done” they say, never mind other considerations like transparancy, accountability etc etc.

    In other words, you are f—-d if you cannot control. Who would want to create problems and embarassment for themselves? So things usually and miraculously turn out “right” for them.

    When all institutions are stacked against you, you know your chances are no good. The only way out is to be able to take over control. Then f–k them kow-kow if you want to.

    Bottomline line is you must control. So what are you waiting for?

    And furthermore, both my intelligence and intuition leads me to suspect that the extremly low-blow beating administered on AI in that dirty Bukit Aman cell by that cheap coward, ex-IGP Rahim Noor, must have been carried out because he was likely ordered to do so by someone who may have held near-absolute power then of an unconstitutionalised Malaysia Berhad.

  9. Having 3 ex-judges view the evidence in private and give their comments is a totally inappropriate way to deal with Anwar’s complaint. How very convenient to have the case disposed of this way. How were the panelists selected? Nathaniel Tan said one of them is the judge who sentenced Lim Guan Eng to jail for distributing info about the Malay girl rape case and another is a known pro-establishment lapdog.

    In lieu of proper investigations, MACC resorts to this skulduggery which convinces nobody but only serves to confirm that the MACC is no improvement from the ACA and may even be worse.

    I clearly read the ex IGP apologized to Anwar…long time ago.
    As a commentator…and I am near 70 years old..I have suffered a fair share of threats …designed to discourage me from commenting…some 2 years ago…and treated like an animal with tear gas.
    My reward was the 12th election…and what is happening after that…clearly shows…..UMNO is desperate and each of those minister is doing their part…to bring down Anwar Ibrahim.
    Yes RM60 billion good news…bad news for Anwar sodomy trial….English language for Maths and Science…all timed to see how voters will vote in the 3 by-elections.
    Rewards and threats…these are the signs and signals….UMNO is giving to Malaysians…meaning vote for UMNO..or else……

Anwar was part of the Umno government in the past and he should have known much better than anyone else that there are two sets of laws in Malaysia: one set is applicable to the ordinary Malaysians and the other one set is applicable to only Umnoputras. It is no point for Anwar to spend so much time in a vain effort trying to topple the AG and the IGP since both these two men are the key personnel of Umnoputras whose value is so vital as similar to an ace dealt face down to a player as in stud poker and not exposed until the showdown.

    Nevertheless, having an ace in stud poker does not necessarily mean that the ace holder must be the winner. Other player who holds any “Pair” in stud poker will definitely win over the holder of an ace. It is really amusing to see the photo showing Anwar lunching together with Abdullah Ahmad Badawi on 10.03.2009. It may just be a coincidence and this kind of coincidence may not carry any weight which will affect the balance of power in the political struggle between BN and PR. However, many people of Malaysia will still like to indulge themselves in the whimsy and fancy of getting a “Pair” in order to win over the single “Ace”.

    When God makes such a coincidence to happen at our bare eyesight, God certainly has His special purpose. Who knows how long Najib can be sitting in the chair of the Prime Minister after March 2009 if in the future there will be a cooperation between Anwar and Abdullah in the Parliamentary session in order to vote out Najib from the post of Prime Minister with a vote of no-confidence against Najib?

  12. The whole episode is a whitewash.

    Something is amiss and the report must be reviewed by an independent committee comprising members of the legislature, the sitting judiciary and eminent persons from the public.

    MACC’s panel cannot be considered as independent as they are not acceptable to the complainant, the eventual victim.

    The tabling of the report in parliament is also unjustified. It should be duly subjected to the scrutiny of a court of law and dissected by lawyers appointed by the complainant if it is of any value at all.

    A great injustice had been committed. Something must be done to address it. Else the MACC’s and the government’s credibility are to be questioned and doubted.

  13. I can still remember TV footage of the late Christopher Fernando the prominent criminal lawyer on ChannelNewsAsia who claimed the present A-G had fabricated evidence in the Anwar sodomy case.
    The surprising thing is that at the time, no action was taken against him for such an accusation.
    Now years later, the cover-up is being given a white-wash by the discredited judiciary under the “cows and car” commission.

AG and IGP are free,that’s don’t surprise me at all.Remember the 2 PR’s frogs in Perak,come due date,they too would be clear of any corruption.I can tell you guys,any corrupt or criminal investigation regarding their good old pals,past,current will result the same old verdict.Just don’t waste your time and effords and money on these guys’ corrupt action.Just look at how many police complaimts by the oppositions regarding Umno/BN people and what do you guys get ? Nothing but adding salts to your own injuries you get busted instead. YB Karen Kok case is an good example. Macc,Jac,police etc etc etc, in fact have lost it’s credibility long time ago.Our only choice now is to change the Umno/BN government in the 13th GE.

    Now that they have announced the RM60 Bil financial aid package, these umno crooks will do anything to stay in power as long as they could, to lay their hands on the money.   23. The 2-1 decision was not enough to convict the AG, but it shows that a judge believed that he was guilty. AG must be above suspicion. Now that a judge has decided with the benefit of the investigation that the AG was guilty beyond reasonable doubt, the AG does not meet the required standard that he must not only be clean, but the people believe that he was clean. The AG has obviously failed the test. He should be asked to resign. The Sultan of Perak can help the country by asking the AG to resign. UMNO leaders will have to decide whether the wishes of the Sultan would be their command.

    V. Sivakumar is not being allowed to even represent himself in court and the state legal adviser, who’s supposed to represent him, is giving him the ‘cold shoulder’.
    It appears that Sivakumar is being trapped in some sort of ‘legal limbo’ which is of course engineered to force him to quit his speaker post.
    No surprise if the police say they can’t figure out the origins of those live bullets in those death threat letters to Karpal.
    No surprise if the MACC ‘closes one eye’ to Anwar’s black-eye case.
