Abdullah should give public assurance that Anwar will not be detained under ISA

The uncharacteristically stern and harsh allegation by the Prime Minister, Datuk Seri Abdullah Ahmad Badawi yesterday that the Parliamentary Opposition Leader Datuk Seri Anwar Ibrahim is a threat to the national security and economy who wanted to “destroy the country and exploit the people’s trust and tarnish the country’s image abroad” had sparked speculation that the stage is being set for a Operation Lalang 2 crackdown and Anwar’s arrest under the Internal Security Act (ISA).

All right-thinking Malaysians must deplore in the strongest terms the veiled threat by Abdullah that Anwar would be arbitrarily and undemocratically silenced as the allegation that Anwar is a threat to national security and economy is a most ludicrous and preposterous one.

I have been twice detained under the ISA, once in 1969 and the second time in 1987, becoming the guest of His Majesty’s Government for a total of 35 months – and on both occasions, I was accused of being “a threat to national security”!

All the 16 DAP MPs and leaders detained in the 1987 Operation Lalang dragnet under the ISA were all accused of being threats to national security – but these are all baseless catch-all allegations just to justify the abuse of the ISA to silence critics and dissent.

We were threats to the political security of the Barisan Nasional leaders but it is the democratic and citizenship right of every Malaysian to challenge the political credibility, legitimacy and authority of the ruling government through the democratic process or we should not claim that Malaysia practises parliamentary democracy.

Such democratic challenges do not become threats to national security just because those in power are in fear of losing the perks of office and power.

Anwar Ibrahim can be accused of posing a grave threat to the political security of Abdullah and the other Umno and Barisan Nasional leaders with his “916 sky-change” plan, but he cannot under any stretch of imagination be accused of being a threat to national security and economy.

Abdullah should not prop up his political life by resorting to the abuse of the ISA which had been enacted to deal with subversion or organised violence.

The toppling of the Barisan Nasional national government by getting the allegiance of the majority of the 222 MPs in Parliament to support a Pakatan Rakyat federal government is neither “subversion” nor “organised violence” intended in the Preamble of the ISA enacted 48 years ago in 1960.

In fact, the toppling of the government-of-the-day is part and parcel of the democratic process if the government-of-the-day loses support of the majority of the elected MPs, resulting in a change of government.

In first-word Parliaments and developed nations, change of government resulting from the withdrawal of support by the majority of MPs is a common occurrence, which is accepted and transacted without any threat of chaos or disorder with all political leaders participating peacefully in an orderly transition of power.

Malaysia is experiencing the possible change of federal government for the first time in the nation’s 51-year history, as this has never happened in Malaysia before.

This does not mean that any change of federal power should not be conducted in a democratic, orderly and peaceful manner.

Since he became Prime Minister, Abdullah has been talking about his dream of Malaysia shedding its “First-World Infrastructure, Third-World Mentality” malaise to join the ranks of first-world developed nations.

Malaysia is presently undergoing a critical test whether the nation can become a first-world developed nation where democratic change of government at the national level is accepted as an integral part of the democratic process as in developed countries in the West.

This is why Abdullah should make a public statement that if the Barisan Nasional government loses majority support and Anwar can get the support of the majority of the 222 MPs, he will gracefully, orderly, peacefully and democratically effect a transition of power for a new federal government to come into being.

This is also why Abdullah should make a categorical public assurance that the ISA will not be used to silence and arrest Anwar whether to foil the “916 sky-change” plan to replace the Barisan Nasional government with a new Pakatan Rakyat government or on the preposterous and baseless ground of being a “threat to national security and economy”.

    Looking at BN’s past track record, invoking ISA to silence opponents is their Standard Operationg Procedure.

    I know DSAI is at risk, you are probably at risk. If you guys are “temporary inconvenience” please make sure you have PAS’s Tuk Guru Nik Aziz (TGNA) as your spoke person and plan executor.

    I have a feeling AAB and Goons will never touch TGNA (or risk open revolt even among UMNO) and he is your most formidable ally at this crucial juncture.

    With the present Political deadlock turning dangerous & ugly, let us again focus on the need to reduce BN’s majority.

    Already the BN’s self-destruct mechanism is in action.

    More defections will be coming & they should all consider forming the 3rd Front with SAPP taking the lead.

    PR only need to focus & hang on to its present numbers.

    Let the neutral 3rd Front be the “King maker” with the reduced BN majority.

    Devine Intervention will ensure the “Headache” will be on the Powers-that-be with the neutral 3rd Front.

    With this, the “Morality” issue can be resolved and any coalition thereafter with PR can be considered to overcome the “Deadlock”.

    The ideal thought of calling for another election will not materialise with the “Powers-that-be in its present desperate predicament.

  4. Ang Sang Su yi has been under house arrest by the Myanmar warlords for the past decade for winning the general election in the 1990s, and eligble to take over the government and hence a threat to national security to Myanmar, wholly owned by the warlords.

    Anwar is the opposition leader and is likely to have, or has already acquired the support of more than half the MPs in the house, and thus is eligible to take over the governemnt, pending appropriate procedures of power transfer has been said to be a threat to national security. ISA could remove Anwar and render him a worse situation than a house arrest.

    The situations are similar between the two countries. Is Malaysia following the footsteps of Myanmar?

  7. What Kit Siang said is exactly true, ISA is created by UMNO to Silence Critics from opposition or any individual who managed to expose the truth of UMNO.

    Kit Siang has been sent twice to ISA as accused that he is a threat to national security.
    Every one knows that Kit Siang is not a threat to National security but UMNO’s security as Malaysian government.

    ISA is only used in a communist or dictatorial government and not a democratic country. Ahmad Ismail himself said that he is innocent before being proven guilty and the news has sentenced him guilty before a fair trial.

    What fair trial did the ISA victims get???????.

  9. Of course he won’t give public assurance. As someone said here, the ISA is Standard Operation Procedure (SOP) for maintenance of power. Since when has this norm changed? Also self preservation, personal or ruling group and all cronies. If you belong to such a group would you give up power to the next group that once ensconced in power will investigate and jail you and your friends?

    There are only two broad calculations that have to be weighed in relation to applyimng that SOP:

    1. that Anwar has independently come out forthwith to prove his claims of 31 kataks; if fails or prevaricates in this, an adverse inference will be drawn against him for recklessly making false claims that causes uncertainty, heedless of the negative effects on investors and businessmen, ie the nation’s economy – making him a fit and proper target for justifying use of SOP;

    2. adverse effect of arresting him, whether (a) security forces can contain backlash and whether public disorder will spread (b) international backlash and more important (c) whether Bursa Malaysia will crash further, and all values, wealth comprised in stocks of government or political or BN parties’ linked counters will be wiped out – waiting for foreigners to pick up and fire sale price.

    No assurance esp when warning already given along lines of threat to sercurity and economy. The only calculations bearing on equation are along lines 1 and 2.

    Who hastily arrested the Selangor state government personnel who is in charge of Investment Trade & Industry portfolio under the same ISA with unestablished accusations and frigthened away foreign investors and rocked our national wealth & stock market? NOT ANWAR!

  15. Anwar is playing high stakes almost to the point of courting ISA.
    Nothing is worse than admitting that he made false claims of having the 31 crossovers (assuming that’s the case) because he will be tossed into oblivion having to face Sodomy II charges which maybe are worse than ISA. However if ISA is used, then he becomes an icon & political matryr for the great Cause of Malaysian Democracy which his BN detractors can never thereafter prove he had made false claims and never had the 31 defectors in the first place. His detractors will then carry the blame that they use unfair ISA to stamp out the flowering Malaysian democracy held by promise of 31 defectors not given a chance to surface, and hopefully generate a further wave and storm of public and national sympathy to put the BN out, as a matter of course.

  16. Anwar is now calling for a vote of no confidence in Parliament. Whether it is a vote of no confidence in Badawi or his entire BN administration is still unclear, but either way, he has upped the stakes. Now everyone will be saying that if Badawi chickens out of allowing a vote of no confidence, then it should be true that Anwar has enough support to form the next government.

    The only problem is that if the debate is held, I am sure Anwar will convince a few more fence-sitters to come aboard his Pakatan.

If the PM genuinely believes Anwar is bluffing, then call the bluff, the way to it is (1) not to use the ISA (because that would only make him political matryr without opportunity to expose the bluff, indeed public perception will, on the contrary, be reinforced that he relly had 31 defectors which is why ISA is used) and (2) instead of giving him special emergency parliamentary session, just wait till parliamentary session resumes in October because by then if he still has the 31 kataks with him, as he claims, he has every opportunity to invite them to cross the floor from govt to opposition benches. What is the hurry for the PM to call a special parliamentary session just to test one’s own position? There is no logic in it. If one takes the stand that he is bluffing (as PM has been doing) why dignify the bluff the importance by calling a special parliamentary session to test or expose it, when it can be done all in due course when Parliamentary session resumes in October? The mistake is to invoke the ISA before the Parliamentary session resumes as scheduled in October. Then it cannot be proven that he has been bluffing, and BN would also have fallen straight into Anwar’s grand plan to absolve himself from accountability of making falsew claims and at the same time throwing on the government all consequences of negative public perception that the govt is draconian and repressive in using ISA to suppress a democratic challenge from a greater majority opposition….

    this is blasphemous, the british (you ppl also proud speaking their language) had brought in enormous amount of immigrants which is why the bumi has been sidelined, and the british with wisdom (involved 2 world wars, and cold war and colonized so many countries) has foreseen the importance of “special privilege” to ensure that the bumi stays “relevant” in their own country. otherwise malaysia as new country will turn into south africa where the whites control the country with the “native” got no say. and look at thailand how thaksin screwed the country. try to remove that “privilege”, malaysia will even worse than today! just look at today’s universities and skools. without those quotas (and matriculation), ask yrself honestly if bumi got chance to fill up the seats where those bumi usually comes from kampung background where there’s no fair education. “No one owes Malaysian Malays a living.” But it is gov prime “responsibiliy” to uplift their standard of living……

    1. He needs time to organise another study tour for “suspect” BN MPs, this time to Harare to study consensus politics.

    2. He needs to get rid of Muhyiddin from his cabinet as Muhyiddin has been relaying all sorts of info to Pak Bodoh’s arch enemies within UMNO.

    3. He is just getting into a new ministry and he has to start reading “Jane’s Defense Journal” and we all know that when he starts, he can’t stop.

    4. Syed Botak is still liasing with the AG and the IGP on what to say to the public as grounds for putting Anwar under the ISA. Evidently the public won’t buy the argument that it will be for Anwar’s own protection.

    Very rare in the history of mankind we come across leaders who will step back and let other better ones lead when the rakyat no longer respect their leadership ability. If one can do that while in power than he/she is the rare one. In M’sia the BN politician stay on despite of losing public respect because it is all about making a comfortable living without working. The new generation will not tolerate a sleepy leader and economy. Morally it is a sin to stay in power when the people are sick and tired of your leadership failures.     Since BN is no longer a majority party Abdullah has no reason to cling on to power – that is unconstitutional, illegitimate and presents a threat to the nation. Attempts to use the ISA to prevent leader of the majority party from acceding to his rightful position of power is deemed undemocratic, barbaric and must be condemned in the strongest terms.

    Abdullah is obliged to effect a smooth handover of power to leader of the majority party under Malaysian parliamentary democracy.

    This is the most stupid comment I have ever heard. Why should the PM gives such an assurance? Beside our PM is not the one that decides who should be detained under ISA, why should he gives any such assurance to anybody? There is no neccessity for him to give such an assurance as neither does the PM owe Anwar anything nor they are good friends. The Opposition always demand the Government to do this and that with no real reasons and benefits to the people. What is the whole purpose of doing all this? If the Government found Anwar or anyone to be a threat to national security, then he or she should be detained under ISA with no further questions. Please don’t confuse the public that ISA is being used by Government as weapon on the Opposition only.

    Further, if Anwar already have enough MPs to form government, he would have already stormed into the PM’s office to make demand, since he is so desperate to be PM. So it is obvious that he has told lies to all of you who have supported him so fervently. My question is, why does he want to lie? This does not reflect well on this credibility at all so why do you all still want to support him so blindly, knowing that he is bringing you to no where???

  37. I am a political novice, only got interested in the political scene a couple of months ago. Here’ my 2 cents advice to PR:

    1) either you wait for next GE (which i assume is rather too late now) and be a good opposition
    2) go for the “kill” and win the hearts of the rakyat (again if the majority is thin, the new opposition will give you a hard time) and prepare for an snap GE with a clean lists of voters for a new mandate
    3) if all things fails and the EVIL REGIME still rules, street politics is the ONLY choice to bring down the GOMEN!
    GOD saves the AGUNG.

The fact that Abdullah is issuing a veiled threat, and contemplating to use any means, including the ISA to arrest Anwar on the ground that he is a threat to economy and national security confirmed that BN’s house is not in order. If Abdullah has absolute control over his MPs, why is he not behaving like he is?

  39. It is a forgone conclusion that AAB will not last as PM beyond the end of the year even if Anwar does not have the number. It is no point to use ISA on Anwar to make himself at par with Myanmar junta. Eventually it would be TDM’s son who goes straight to the position of PM if UMNO agreed to the system of presidential council, and the president of the council chose to have his son take the place on his behalf.

    AAB has tried his level best to move away from the norms of TDM regime, but sadly failed. He shouldn’t forgo the chance to get TDM’s nemesis to avenge the wrong on his behalf. Even though AAB and Anwar belong to different party, the animosity between them would be much less than either of them had against TDM. Yes, both would claim that they forgive but not forget. Nevertheless, the memory would be that much sweeter if they could get even, before TDM reports to a call elsewhere.

    AAB should signal to the Speaker to convene an emergency parliamentary session. He can glean a good name for being a respecter of parliamentary democracy.     The rakyat have lost all respect to the administration with the recent ISA detention. Your ‘reputation’ plummets to historical low. However, you might be able to turn around the situation by cleaning up the EC and call for re-election before stepping down. If Mr PM was far-sighted, you should look beyond current political turmoil and abolish whatever unfair and oppressive policies that leads to the current situation.

    Abdullah, think of China, think of East Germany, think of how the communist era ended in these countries and finally brings great blessing to the people and the country after decades of communist oppressive ruling.

    As your time is running out, do make use of the little opportunity left in your hand to bring good not to yourself but to your country and the rakyat.

    If Anwar was to be arrested again under ISA again (this might be your short term solution), don’t forget this will be recorded as the most unjust and unfair government intervention in the nation history. People perception will last a life time. The cancerous policies will continue to eat up and destroy the nation in the coming days. You wouldn’t solve the problem.

    Think of Gorbachev. Even though he was being cursed and forced to resign as President of Soviet Union, in his premiership he managed to end the cold war and shift country resources to civilian section and began to introduce openness and reform the nation.

    With the little time that you left with, do think a little bit further. Stop following TDM footstep by sending everyone into ISA. Time has change. TDM time a lot of things can be covered up but not now in this internet age. You still have a chance to earn a good name by listening to the rakyat and stop using the ISA. Be a gentleman, if it is time to go, just step down gracefully and handover the battalion to a better candidate which might not necessary from your own party.

    This country does not belong to BN/UMNO. This country belongs to Rakyat Malaysia. Any rakyat Malaysia with credibility irrespective any party should be allowed to lead this wonderful nation once again.

    What I can see from PKR action :-

    Can I says that PKR are doing step by step as above to ensure that if they manage to form the Government; nobody can challenge the legitimate of the formed government because they have utilize all the sources available in constitution before approaching the King to form new government….

    chinymin is right. DSAI’s next court hearing is on 24 Sept. There is a chance that he may be transferred to the High Court and get locked up by the police for a period of time until a court decision on his sodomy case is reached.

    I think AAB is banking on the probability that DSAI will be locked up by the police and hence he intentionally refused to call for an emergency parliamentary session on 23 Sept next week.

  47. Just came back from Singapore and read an article there which is written by a strategist in the S.Rajaratnam School of International Studies which I hope will be not come true. He mentioned that there are just too much at stake for UMNO for PR to take over the government and therefore the BN have 3 alternatives to stop Anwar from taking over. One is to revoke his bail and arrest him which will make the PR crumble due to his absence. Two they could dissolve Parliament and call for a snap general election which would be risky under the present circustances. Three which is most likely is to have a State of Emergency declared on the grounds that the country is entering a period of prolonged instability and to prevent ethnic strife from blowing open.

  52. before march 8, i could easily ‘cari makan’ every time i meet friends and acquaintances. Now i can even earn an office boy pay. People still talks about blog articles (thanks to kit and gang), people still jump traffic lights, people still park their vehicle as if the whole road belongs to their grandfather, people still swears (some even by the holy book) and people are basically still themselves. The only thing that changes is that we find it harder to earn a living nowadays. Not much could be said for those kidnappers, dvd sellers, ahlongs, robbers, snatch theives.

  57. The power of incumbency is indeed enormous. This is what Malaysians have given to the BN beast for the past 51 years.

    Badawi is going for proportionate response. He’s got various tools with him – the judiciary, the police and the AG’s chambers cooked with Sodomy II – as the lightest approach to put Anwar behind bars and denied bail; or the nuclear weapon of ISA.

    He’d prefer the soft approach because using ISA will undoubtedly and immediately cause a conflagaration of anti-government protests, not that a denial of bail would do any different, but perhaps won’t trigger as much anger.

    Anwar has got limited options.

    Go to YDA, BN may refuse to resign on the ground that Anwar’s list is a lie. If Anwar goes to YDA with BN MPs, they will be stopped from entering the palace by special branch folks, police or even the military. Or their families could be held hostage.

    Anwar may not even make it to the palace. He could be arrested under ISA to prevent him from meeting the YDA – especially if they can’t deny him bail under Sodomy II.

    Whatever it is, this is bound to get ugly unless BN comes to its senses and allow for freedom of association by its MPs. That, perhaps, requires a miracle.

There is so much argument about BN MP’s leaving BN and joining PR; whether it is legal or illegal, acceptable or otherwise, frogging or toading (only joking), honourable or otherwise, betraying or loyal to voters, etc. Just a question: when the whole Gerakan in Penang joined BN one day in history, what do we call the movement? Did they betray the voters back then? Was it honourable? Could they have done a better job outside BN then inside where they had to answer to BN top guns?

    Hence, it is better to leave it to the voters to access and decide to accept/reject the BN MP’s joining PR.

    My humble 2 cents is why not give the BN MP’s a chance to prove themselves they could perform better in PR?

  65. I have clients who are actively seeking jobs outside malaysia. One of them successfully tendered for a soil investigation job in indonesia for a foreign project owner there. And the team of consultants managing the project are mainly foreigners.

    He said the standard and professionalism there in general is a lot higher than in malaysia. How could that be? I am a little amazed. But we have British Standards dont we?

    And the reason? In indonesia foreign investors are not required to have local indonesian business partners. So those investors simply import into indonesia their first world standards and practices and apply them there in full vigour.
