Anwar Ibrahim has been released on police bail this morning.

Yesterday, the Prime Minister Abdullah Ahmad Badawi promised that there will not be another “black eye” trauma for Anwar as happened ten years ago.

However, the police has received a “black eye” of its own making, in its highly-provocative, unprofessional and unjustifiable arrest of Anwar by police commandos in balaclava at 12.55 pm yesterday – when the former deputy prime minister had already promised to report to the police at 2 pm.

This is the second self-administered police black-eye within a week – the other being the completely unjustified three-day 1,600-personnel police operation to lock down the Federal Capital and the Klang Valley to thwart a massive demonstration in Parliament on Monday when there was not a single protestor – causing great and unnecessary inconvenience and hardships to hundreds of thousands of people, plunging public confidence in the efficiency, competence and professionalism of the police to an all-time low.

The two self-administered “police black-eyes” in the past week raises the question whether the Royal Police Commission set up in the early months of the Abdullah premiership and which made 125 recommendations to create an efficient, incorruptible, professional world-class police service – with its most important recommendation for an Independent Police Complaints and Misconduct Commission (IPCMC) – has turned out to be a total waste of time, resources and funds!

    Yes, i do hope that we can change government ASAP but perhaps you need to tell DSAI when you meet him that if he really can’t form any new government by Sept then maybe we need to move a step back and stop talking about the jump ship issue for now and let us concentrate on preparing for the next election and let collapse BN by using a people power.

  2. My strong feeling is that Abdullah Badawi is being advised correctly. The self administered highhanded approach by police is completely destroying Abdullah’s credibility and his leadership quality.
    Pak Lah has to remove both IGP and AG to restore confidence in both institutions. If they fail to change the next opportunity comes UMNO and BN would be completely gone.

  3. The 02.00p.m. dateline was not even over yet and the “smart” CIDs went to arrest DSAI. This is getting out of hand. The other issue is why waste their time “creating” traffic jams all over K.L.? Why can’t the Police go and do something more constructive like reducing crimes. What I cannot understand is that the Police Dept always claim that they don’t have enough police to fight crime. What a bullshit!

We should concentrate on strengthening the governance and unity of PKR rather than trying to take over the government from BN in September which looks like quite impossible. PKR has not yet to convinced or prove to the Malaysian rakyat that they can formidably form an alternative government but instead they are still pointing fingers at BN and talking about “jump the ship” which is actually becoming very irritating. What has happend to all your promises made before the March 08 elections? Prove your capability first and the next government will be yours naturally. And DSAI please be humble and see to the rakyat’s needs first. As Jesus Christ said a leader has to serve rather than be served. That’s why he washed the feet of his apostles before he gave up his life for us on the Cross. That’s a leader to be admired. Even the great Mahatma Ghandi served his people to the end. Our Malaysian politicians should learn from these great leaders.

    The Hamid Alba person sounded like Zam, former Minister of Information (not necessarily in voice) when he spoke to the international media regarding Anwar’s arrest. In CNN he was prevaricating and not answering the tv journalist/host’s questions, especially, why the hasty arrest of Anwar before 2pm. When asked if the govt is worried about the impending backlash, Hamid said a straight no, because it is not anything political and the tv host evinced disbelief with the answer given. Further emabarrasment for our beloved country.

    The only hinge of hope, however flimsy, is on the independence of ACA.

    ACA had scored a major point last week with the arrest of the Immigration Director and his Deputy. Would ACA remained subservience to the IGP, the AG and their political masters? We know the desperation of that three institutions; a factor that we can connect directly to Monday traffic jam, the arrest of Dato’ Anwar and lately the arrest of Raja Petra.

    Before the 8th March tsunami, I used to comment that the BN was in defensive over their administrative records.

    Now that know the majority votes had been against them, they are desperately holding on, and using government machineries to prop this very unpopular regime. I am not surprised of the latest actions from the government, but I believe this is just the beginning. The people are tired of lies yet the administration is desperate to hold on; a sure sign that clashes would continue.

    We had hoped for the King to step in. But no, not likely. Now it’s left for the independence of the ACA. Somebody need to be arrested and he is not Anwar.

    Recent new in M’sia Kini : US AGAIN expressed “deep concerns” on Anwar’s arrest yesterday and urged the the matter to be resolved in ways to restore confidence in rule of law.
    And guess what, this time even Japan spoke up. They will bring this up during ASEAN meeting in S’pore next week and seek more info.
    Let’s see if our beloved leaders will protest to Japan also this time..or will Syed Hamid call DSAI a “Japan-snitch” this time? Lol..

  12. Police say they have to get to the bottom of the allegation that DSAI committed sodomy. That’s why they arrested him. This is based on an allegation.

    What about the sworn SD made by RPK that DPM and company were involved in murder of the Mongolian girl? Why don’t they get to the bottom of the allegation. Why don’t they hold roadblocks and arrest the accused like in Annuars case? Instead they want to arrest RPK. Why don’t they arrest DSAI’s accuser? It is so clear that the arrest of DSAI is politically motivated and has NOTHING to do with upholding the law. In fact as far as the police is concerned, upholding the law is the least of their priorities!

    In Australia one’s sexual preference has no bearing on one’ leadership qualities.A typical example is Penny a self-confessed lesbian who is in Kevin Rudd’s cabinet.Thus if you have the same scenario happenning in Australia the police will first go for the murder case first cos it is the more serious and urgent matter to be given priority for investigation.

  56. The past week the ACA seemingly scored points by making a nearly clean sweep of the Immigration Dept. The dept is now disredited and the staff feeling discouraged. Quetions abound. Why this sudden show of force against fellow civil servants? This is unheard of in the past. A move towards a reformed and independent ACA? BN govt’s openness?

    Please ponder on the ‘raid’ on Immigration. Please look deeply.The dept was being referred to during the SEEFOR case when a certain personage from Ghenziz Khan former country entry record was ‘missing’. Who could have tempered with the record? Did anyone of those arrested especially the big guns know someting? Will they be coming out with SDs? Or they will be silent?

  73. The police will undoubtedly be able to get a court order compelling DSAI to provide a DNA sample (blood). There is no reason to believe that “evidence” will then not “materialize” consisting of blood stains etc. If possible DSAI should take measures so that any sample of blood taken will be with an identified “trace” that allows it to be proven to be from the sample taken as DNA sample. I know it all sounds like something out of CSI, but we are dealing with hardened criminals here and must be ready to be one step ahead of them.

No one else, who is not criminal, has yet been charged for sodomy. All Malaysian and Singapore cases involving a prosecution of unnatural sex whether oral or anal also involve other criminal acts of battery, assault, robbery, rape or having sex with minor (stautory rape). No gay homosexual, lesbian, bisexual, travestite (“pondan”) estimated to form anything from 10 to 15% of the general population, who has otherwise perpetrated grame crimes as stated above, has ever been prosecuted….

    Sodomy is a law that is a colonial relic, almost never invoked except to aggravate the prosecution and punishment of a criminal. Otherwise prosecutorial discretion is always to look another way or to leave the matter to religious officers to do the necesary whether counselling or punishment. As Tun Dr Mahathir said, “there are certain habits which are not easy to be rid off. Habitual smokers will tell you that. So will drug addicts”, and this (especially when it is consensual) is tacitly acknowledged and dealt with by turning a blind eye unless in extreme cases of collateral harm to the victim.

    So when sodomy is turned against a political icon like Anwar who is otherwise never accused of any other crime then regardless of whether he really has this occasional queer habit or is baselessly accused of it, the public and people will always give him the benefit of the doubt because deep inside there is already a irrefutable perception that it is a political prosecution. The simple fact is non other, who is not otherwise suspected of criminal acts inflicting harm on victim, has ever been prosecuted.

    And a political prosecution, even if proceeding on the most solid ground of fact and evidence, will never be accepted when large sections of the rakyat have already given up hopes on BN to bring change for the better in the country and pined their collective hopes and aspirations on Anwar to bring such change, whether or not these hopes are corectly placed or misplaced. This is the main challenge facing the government in trying to grapple with the problem of changing public perception to dymystify the persona of Anwar. It faces a Court of Public Opinion that repeatedly delivers judgment of guilt against the accusers (government) as if truth be told many are not even bothered at the veracity of the accusations against Anwar, whether well founded or not, for what they are more concerned with is that the change of govt and reform agenda is not derailed at any costs.

    It is through Anwar that public hope of a better life and country finds expression and by reason of this Anwar could for now leverage extensively on this aset of a vast reservoir of public goodwill and sympathy to face his accusers.

  99. Unnatural sex is difficult to prove. Section 377(A) deals with unnatural sex between conssensul parties. How to prove that? Which homosexual partner would snitch on the other when disclosure would bring equal shame and social ostracision (in this conservative and hypocritical society) to one ownself? The only way to prosecute is to force an unwilling participant to give evidence against the other partner which is difficult because you have to use trickery and coercion to extract the confession, which by reason of the trickery and coercion would render his evidence inadmissible in court.

    The only way is to prosecute under Section 377(C) which is rape by sodomy. Here one has to prove not only taht sodomy occurred but also that it was forced onto the unwilling participant. How does one prove the second part of “force” in one-one situation, short of a hidden camera or presence of witnesses? Especially in a case where 90% of the public already favour the accused against the accuser???

    If one cannot prove beyond reasonable doubt the second element, then in spite of evidence of the first, the whole charge of rape by anal sex will have to be dismissed.

    So what is the point of the whole prosecution?

    Is it to just to have it on trial record that the accused engaged in homsosexual activities never mind that he canot be held accountable for any crime because force and rape was not proven?

    If that were the modest objective, forget it lah becauser you have already the 2004 Federal Court Judgment acquitting Anwar for sodomising driver Azizan. There the Federal Court judges by majority already expressed the opinion that whilst they ‘believed’ Anwar engaged in such activities (here “belief” is not same as proven) yet their belief was irrelevant to the fact that the specific charge relating to Azizan being sodomised was not proven beyond reasonable doubt (as Azizan’s testimony was not corroborated by other independent facts), and for that reason acquittal must be given to the benefit of Anwar.

    1. What is the function of the press in Malaysia, like The Star, NST and so on?
    2. Are the Chief Editors of the major newspaper in Malaysia appointed by Government officials?
    3. Why is it after more than 50 years of independence ( so called independence), we are still chained fro voicing out in the press. There are many people voicing out in the blogs, but the majority of the people in the country does not read blogs or internet users.
    4. What has been the result of voicing out this concern in the Parlimen. I’m sure it was voiced out before, but why didn’t the opposition take up this matter seriously.

    On Saturday, 12-07-2008, the police came to my house to serve a Section 111 Criminal Procedure Code notice, harassing my family and demanding my presence at the IPK Kuala Lumpur (Federal Territories Police headquarters) at 2pm on Monday, 14-07-2008 despite an earlier agreement with my lawyers for me to come to the IPK on Monday 14-07-2008. On the next day, Sunday, the police also served an ex-parte court order, prohibiting me from physically being within 5 km from the Parliament on Monday 14-07-2008. As you can see, my house and the IPK KL are within 5 km radius from the parliament building. The court order effectively put me under house arrest on Monday and at the same time prevented me from going to the IPK.

    On Monday, 14-07-2008, the presence of police personnel outside the compound of my house strengthened our suspicions that they would be prepared to arrest me as soon as I left the compound of my residence, on the pretext of me violating the court order. The issue here, is which order should I comply with, the ex-parte court order or the Section 111 notice from the police?On the same day, the police through the Investigating Officer, one DSP Jude Pereira wrote and faxed to my lawyer at about 1.06pm, informing that I was required to be present at the IPK KL on Wednesday, 16-07-2008 at 2.00 pm to assist with the investigation. I conveyed my agreement to the appointment and it was communicated to the police through my solicitor, Messrs S.N Nair and Partners via telephone and letter on the same day.

    On Wednesday, 16-07-2008, I was at the Anti Corruption Agency (BPR) head office to record my statement pursuant to the police report lodged by me at IPK Shah Alam on 01-07-2008, against the Attorney General Gani Patail and the Inspector General of Police Musa Hassan for their involvement in the fabrication of evidence way back in 1998. To ensure that we will be able to attend the appointment with the police at 2pm, we cut short our statement at the BPR’s office, and this fact was clearly conveyed to the BPR officers present.

    At about 12.45 pm, the IO, DSP Jude Pereira called Mr Nair to confirm about our attendance and Mr. Nair confirmed that we would attend that 2pm appointment. We were about to have a quick lunch at my house before proceeding to the IPK. 5 minutes later, we were ambushed by a team of masked and heavily armed police personnel near my house.

    I was arrested and brought to the IPK. I cooperated fully with the police by giving my cautioned statement from 2.30 pm to about 7.30 pm. At this particular point, the IO and the other officers handling this case were doing their job professionally. I was then given assurances by Assistant Commissioner of Police Razali and later Senior Assistant Commissioner II Khor (through my lawyer) that I would be released on police bail on the same day.

    However, later on, upon my return from Kuala Lumpur General Hospotal (HKL), the IO, DSP Jude Pereira informed me and my lawyers that I will be detained and put in the police lock-up overnight for the purpose of recording a further statement in the morning.

    I and my lawyers protested, giving our undertaking that we will be back anytime required by the police to continue with the recording of the statement, and there was no need for me to be detained overnight, and that I should be released on police bail. The police, through the IO were adamant that I should be detained and put in the police lock-up overnight, despite them knowing about my physical condition. I had to spend the night sleeping on a cold cement floor, which aggravated my back injury which was due to the beating I received from the then IGP, Tan Sri Rahim Nor on 20th September, 1998.

    This morning, after a short statement that was recorded for about 30 minutes, I was released on police bail. I was in pain and had to immediately receive some medical treatment upon my return home.

    I now wish to deal with the statement of the Criminal Investigation Department (CID) Director, Dato Mohd Bakri Mohd Zinin as appeared in Utusan Malaysia today, inter alia

    “Pasukan khas bertopeng polis terpaksa memintas kenderaan DSAI di Bukit Segambut di sini dan menahan Anwar ekoran tindakan Penasihat PKR itu mengubah haluan kenderaannya pada saat-saat tempoh yang diberi kepadanya untuk menyerah diri kepada polis pada pukul 2 petang ini hampir berakhir”

    This is a blatant lie from the CID director to cover up their shameful act of abuse of police powers. I have given the assurances and had just informed the IO 5 minutes before the disgraceful ambush by the police through my lawyer who was with me in the same car.

    In addition to the above, the Deputy Home Minister, Wan Farid said, as reported in Star Online that, I “went voluntarily to the police car without any incident.” Again, this is also a blatant lie by the government.

    I take to task the IGP for this abuse of police power against me through the events I’ve narrated above. It appears that the events of the last few days, the nature of my unwarranted arrest, my overnight incarceration which was actually absolutely unnecessary, were an act of personal vengeance against me in retaliation to the reports I lodged earlier against him, which are now being investigated by the ACA.

    DNA

    I have reasonable grounds for having no confidence in the system. In the course of the trial of the false allegations of sodomy in 1998, DNA evidence was fabricated and used against me. The persons responsible for the fabrication then were the IGP, SAC Rodwan and the AG, are new key players in this investigation.

    Until now, I have been denied access to the police report made by the accuser against me.

    My accuser is still under police protection and as such, any fabrication is possible if they take my DNA. My decision to refuse a DNA test is taken through advice of my lawyers and DNA experts, both local and overseas.

  132. Why the obsession with getting a new DNA sample ? possible reasons:

    1. Police lost the old samples which can’t be surprising given the efficiency of the force.

    2. Samples deteriorated to the point of them being unusable. Unusable as in being useless for planting evidence.

    I think it is more likely the Police lost the samples of old, and can’t make a positive ID of whatever that was left behind in the “victim”. It would be too embarrassing of the Police and the AG’s chambers to admit to losing the original samples.

A person accused of manslaughter was acquitted when the witness was able to confirm seeing the accused pointing a pistol at the deceased but could not confirm that he saw the accused pulling the trigger. The bullet could have gone out of the pistol automatically, and so there was benefit of doubts to be accorded to the accused.

    Now even if, for the sake of argument, DSAI’s sperms were found on Saiful’s body, has there been evidence that the sperms got into Saiful’s body through sodomy?

    The police is said to have DNA evidence from DSAI, and it requires DSAI to provide his DNA to prove ‘mismatch’; a match would confirm DSAI guilty as charged. The ministers including the PM are claiming that a mismatch is guaranteed if DSAI is innocence. Is it?

    DNA sample could be obtained anywhere from body besides blood sample. It could be the hair, the sweat, or the saliva. Such DNA samples could be obtained easily by any person who was able to come physically close to the accused. In fact it would be possible to obtain a condom-full of sperms, if there was a scheme to get it, without sodomy. The police should prove that the act against the law had been performed.

    The pattern of DNA does not change, and the police would have DNA data of DSAI on its files. The police should have evidence to charge DSAI for sodomy based on the standards before the advent of DNA. DNA alone cannot prove sodomy when sodomy was not the only means when DNA sample could be found on Saiful.

    PM AAB said that the DNA sample of DSAI was too old to be useful. Is he suggesting that the police has been keeping DNA samples of DSAI all these years? It would be a waste of resources if police actually keeps DNA samples of accused persons, rather than the data on DNA patterns. If it is not the case, why does the police have a special interest in keeping DNA samples of DSAI, and now finding that the sample has deteriorated over time.

    guilty.
    02. Police must produce the warrant of arrest before arresting.
    03. There must be a police report before a warrant of arrest is
    issued.
    04. A warrant of arrest is issued by a magistrate or court.

    My logical conclusion
    01. Warrant of arrest was not shown to Anwar during his
    arrest.
    02. If there is no warrant of arrest, then Anwar was kidnapped.
    03. The police cannot produce the police report against Anwar
    til todate.
    04. Hence there is no warrant of arrest.
    05. ANWAR IS INNOCENT SINCE THERE IS NO POLICE REPORT.
