RPK’s bombshell allegation on Altantuya murder – Abdullah, Najib, Rosmah cannot remain silent

The Prime Minister, Datuk Seri Abdullah Ahmad Badawi, the Deputy Prime Minister, Datuk Seri Najib Razak and his wife Datin Seri Rosmah Mansor cannot remain silent on the latest bombshell of blogger Raja Petra Kamaruddin.

In a statutory declaration on June 18, 2008, Raja Petra accused Rosmah as among three individuals who were present when Altantuya was murdered on Oct 19, 2006.

Raja Petra alleged in his statutory declaration: “I have been reliably informed that between about 10pm on October 19, 2006 and early hours of the following day, the night Altantuya Shaariibuu was murdered, three other people were also present at the scene of crime.”

He named the two other individuals as one acting colonel Aziz Buyong, who is described as ‘a C4 expert’ and the latter’s wife, known only as Norhayati, who is also said to be Rosmah’s aide de camp.

Raja Petra further alleged:

“My informer states that Aziz was the person who placed the C4 on various parts of Altantuya’s body witnessed by Rosmah and Norhayati.

“I make this statutory declaration because I have been reliably informed about the involvement of these three people who have thus far not been implicated in the murder nor called as witnesses by the prosecution in the ongoing trial at the Shah Alam High Court.

“I also make this statutory declaration because I am aware that it is a crime not to reveal evidence that may help the police in its investigation of the crime.”

Raja Petra said he had been “reliably informed” that the Prime Minister “has received a written report from military intelligence confirming what I have revealed and this report was subsequently handed over to his son-in-law Khairy Jamaluddin for safekeeping”.

Raja Petra also claimed that “one of the Rulers has been briefed about this matter” and “is fully aware” of the allegation.

The credibility and legitimacy of the Abdullah premiership and government will suffer a mortal blow if Abdullah, Najib and Rosmah remain silent on Raja Petra’s bombshell allegations.

    On the other hand as was also pointed out, the parties named must come out urgently to cleanse their names & to refute their involvement in such a dastardly cowardly & unpardonable deed. If these parties remain silent but defensive then they have more than something to conceal in which case they are more than likely guilty of the murder as the abettors.

    Malaysia’s national dignity & reputation as a civilised law-abiding nation is starkly at stake now. Be silent as a mouse or nonchalently shrugging it off as a joke means most defintely that the parties named are guilty as hell in the capital crime & deserve capital punishment.

    There is no two ways about this matter. Explain & come out clean or be damned by GOD & all mankind besides ruining the image of our nation………..

    Is some Minister going to say: “Fresh investigations will serve no purpose, will involve alot of public funds and waste alot of precious time. The investigations will reveal nothing new as we already got the culprits. Let us just give everyone an ex-gratia payment and close the matter.”

    Will the Defence Minister say: “Actually there is no “Military Intelligence” to speak of because they all only have SPM qualifications. Besides, they all only obtained C4 in Explosives.”

    Will the PM say: “I don’t know anything about it. I slept through it all. Ask Jeanne, she’s my alibi”?

    And will the Ka Jang (KJ) satay man say: “Who? Me? I thought it was my Insurance Policy”?

    And will Rose say: “I wasn’t there. I was definitely at another Guy Fawkes bonfire party that night bogeling away”?

    And will the ACA DG and IGP say: “We are awaiting for instructions from higher ups. So far nobody has filed a complaint”?

Actually her best course of action is to totally ignore the allegations and keep very quiet and quietly ask the police not to probe further.

  32. When RPK says “I have been reliably informed”, it implies the likelihood of him having the informant ready on the standby, though hidden for now, to testify, when the time, place, occasion and forum is right for disclosure without jeopardizing the witness’s safety.

    The gauntlet he throws at the government – is I have this: do you want him to come out, subject to the right conditions, to tell the truth? If the government prevaricates, dithers or maintains in-elegant silence without giving an appropriate response, the most negative and adverse inference will be drawn against it for not wanting to know the truth. Either way susah lah!

    I am not even surprised he may have a copy of the alleged military intelligence report.

    The part of an undisclosed Ruler being privy suggests that RPK is giving a veiled warning that if the situation is escalated by a C4 being used against him, the matter will not end there and that there is a Ruler out there who will pursue the matter.

    The wonder of it, assuming the information is accurate and reliable, there could be such a fourth person hidden from view witnessing the proceedings of the other three, unknown to them, and that witness to a crime, until now not known to exist, keeping silent all this while and recently disclosing it to RPK.

    Are these three man mere scapegoats or ‘stunt man’ or fall guys? Were they paid million of ringgit to go through the trial with a promise of an acquittal? So, is the trial a sham?     You are right that the wonder of it is how RPK’s informant knows so much. However, note that RPK did not state that the three new individuals were the only ones present when Altantuya was murdered. RPK said that these were three “other” people – implying that they could possibly be in addition to some or all of those presently on trial. The possibility of even more people being present is also left open.

  40. There are so many injustice done by BN and BN related people that are still on the table but nothing done. One of them is the the BMC PDRM brutality and Altantuya. If you go deeper all the police report about crimes that PDRM ignored can also be a type of injustice. How we end up this end God knows.

    So, do you think a # 2 in Malaysia will be prosecuted by the government. Tough luck and it will happen only if we have PR in power by September. However, if PR does come to power the priority is to clean up the food on the table and fuel in the economy issues first. This case need to be hand off to the court to decide and the only involvement need to do is pressure it to be given to another DA and in another court room with different judges. Let these judges decide on the ruling. That is the only way to not politicise this issue.

Even though we all have a sneaky suspicion who was behind it all from the missing Immigration records and the explosive outburst from Baginda’s wife in court, this SD from RPK is the first legal action directly linking this dastardly crime all the way to the top in the corridors of power in Putrajaya.

    As some have posted here, it is damn if you do and damn if you don’t for AAB. This SD, if true implicates him and his SIL as well. They are accessories to the fact by keeping quiet all this while. And why give the report to the SIL for “safekeeping”? For whose safekeeping? The reports or the SIL? I can imagine the report will be very useful if the SIL has this report in hand when and if Najib do become PM.

    Is this the cause of the delay in handing over power? Is it because the horse trading is stalled and we have a Mexican standoff between the PM and DPM? When you have both parties with shit in their pants trying to extricate themselves without smelling bad, it does take a fair bit of acrobatics.

    Two of the accused should have been found guilty of the crime of murder. In my opinion, the confession or confessions were wrongly ruled out by the trial judge.

    Evidence against the remaining accused is one of conspiracy which is more difficult to prove. I have not been following the trial. For a trial to last this long is an indictment of our legal system. Shame on us!

  47. Plastic explosive aka C4 in the military are strictly accounted for; there is logging in and out, just as bullets rounds are accounted for, and are audited. That is in the Malaysian military.

    The police, well you need to chat up with those field force police personnel how they account for their rounds. It may be quite different.

    C4 is not just strictly for military. The police, and approved blasting companies are also allowed access to generic C4. However, they have their own C4 dna, that is to say they are traceable to origin of manufacturers and by inference suppliers and buyers.
    Even minute traces of explosives, general explosives of any kinds, have their own dna so to say.

    The military is under the Defense Minister; the police under the Home Minister.

    Just as the military have their explosive specialist [the experts are always dead], so do the police. Buy yes, you need an explosive specialist to work or handle explosive for the simple fact than non trained personnel will have their balls shivering so uncomfortably they would not be even be able to walk with explosives in their hands.

    Explosive specialist are usually in specialist positions.

    Comments on cases sub judice under our legal system is an offence leading to contempt of court proceedings – especially in criminal cases. It is deemed as an attempt to interfere with due process.

    It does not sit well with our constitutional right to free speech. The courts should not be too strict about such comments. But then the court will have to balance the right to free speech and the right of the defendant to a fair trial. We should be careful because public comments on an on-going trial may lead to the overturning of any conviction later on. We do not want that!

  66. The Lingamgate issue demonstrates the standard modus operandi of the den of thieves.

    First, you deny the rumours. Haul in the rumourmongers for interrogation. Charge them with something, preferably a charge that is non-bailable.

    Second, tell the mainstream press not to bother with reporting anything.

    Third, when confronted with evidence, say that the evidence is fake or contrived. When there are calls for an indpendent commission or expert determination, shoot down such calls. Term this as “unnecessary” or “a waste of taxpayers’ money”.

    Fourth, if the calls for an independent commission are too strong to ignore, agree to the formation of the commission but make sure the commission members are friendly. Wave aside any protestation of incompetence or conflict of interest.

    Fifth, if the commission somehow finds some merit in the accusations, ask the AG and the IGP to investigate, but don’t give a timeframe. Just tell the rakyat the cheque is in the mail. In the meantime, get the guilty parties out of the country. Pay for their picnics along the Swan river, or pay for their tea in Bayswater.

    What immediately comes to mind is that, which one of us bloggers dare to print/write such sensitive declaration against those powerful people? We just write, write, and write but that’s it!
    We are all fully aware of members of the DAP, and other political opposition parties, being detained under the ISA, but that is political.
    Which of us bloggers are willingly to be detain under the ISA for seditious writings as Raja Petra Kamarudin has done and gone through.

    BN may be the “ruling party” in some states but in states like Kedah, Penang, Perak, Selangor and Kelantan, BN has become the “opposition”. This makes the situation a balanced one and eliminating the term “opposition”. Therefore, it is time for BN to wake up and take steps in ensuring “equality” in treatment of MPs, VIPs, and what nots from the other camp! Times have changed and so has the tide!

    The Attorney-General Tan Sri Gani Patail must come forward to give proper explanation to end the thousand-and-one questions swirling around the last-minute change of prosecution team in the high-profile Mongolian Altantunya Shaariibuu murder trial or Malaysia’s system of justice is in for another chapter of adverse publicity both nationally and internationally, ending up as the greatest casualty.

    Gani should know that his explanation that the last-minute switch of prosecution was to enable “a fair trial” raises more questions than giving an answer.

    It explains not only nothing, but implies that continuing with the original prosecution team of DPPs Salehuddin Saidin and Noorin Badaruddin could be against the interests of ensuring “a fair trial” and if so, clearly the Attorney-General must explain why, since it casts a serious reflection on the professionalism and integrity of Salehuddin and Noorin.

    Furthermore, why if there has to be a switch of the prosecution team for whatever reasons, the change was not made earlier as the charges of murder against the three accused were first made in November 15 last year while the trial dates for 25 days starting on Monday was fixed by the Shah Alam High Court as far back as March 9, 2007.

    Gani should explain whether the last-minute switch of the prosecution team was to strengthen the chances of securing convictions in the Altantunya Shaariibuu trial and if so, how.

    Why was the whole prosecution team switched, instead of directing DPP Tun Abdul Majid Tun Hamzah to lead the prosecution team but still comprising Salehuddin and Noorin since they had been involved in the preparation of the trial right from the beginning?

    Gani should be aware of the political implications of and the world-wide interests in the trial and should be wary of taking any steps which can only give wing to speculation of political interference in the conduct of the trial.

    The Attorney-General cannot continue to keep silent as the reputation and international standing of the Malaysian system of justice, which is trying, not too successfully, to regain national and international confidence after two decades of relentless assault and erosion by the Executive, will otherwise be the greatest casualty.

This is the AG that shouted “unconstitutional” at anything that moved regarding royalty, and then failed to back up his own convictions.

    Fair investigation ? Nah. Short of RPK having a copy of the military intelligence report or a videoclip of the execution, nothing is going to be done.

    According to report:

    1. Police to call on RPK to invetigate;

    2. AG Chambers “has lodged a police report against RPK over the Statutory Declaration.

    Nothing wrong with 1. something not quite right about 2 here. :)

    The normal way would be for police to investigate allegations such as those made by RPK, submit findings of investigations to AG Chambers which will decide whether there is a basis to charge those implicated by allegations and investigated, a prosecutorial discretion that ought to be discharged – in public eyes – impartially.

    As it happened before police investigations have commenced much less completed for AG chambers to make a determination, the latter have already jumped the gun and lodged police report against RPK on grounds that this allegations are highly defamatory.

    This would be undermining its own future course of action when exercising prosecutorial discretion if it should turn out to be not to charge…

    For the lay public would say, of course that would be an expected result since it has already prejudged the allegations as not having merits based on its act of lodging a police report against RPK even before police investigations have commenced much less completed to present to it the results of the investigations!

Aside from question of not charging those implicated in RPK’s allegations, even if it were to subsequently decide charging RPK later for criminal defamation, it would be open to question by public in respect of whether there is impartiality and objectivity when it has prior lodged a report against him before investigations of RPK’s claims. One can’t lodge a police report and charge and prosecute at the same time without questions like these raised.

    AG should (constitutionally) be an impartial judge on the high benches above the fray below but it has unwittingly descended into the arena prematurely and got affected by the dust of conflict…

    The police should be investigating the allegations made and not the party who makes those allegations – unless they are saying he could be one of the conspirators to the crime of murder! That is absurd. Even a nincompoop could tell you that that is not the way to proceed. If upon investigation they found the allegations were baseless, then they may want to investigate the party making those allegations to see if a crime has been committed, if there is enough evidence to charge him with the crime.

    We know why they are interested in investigating the messenger than the message! By investigating the messenger and appearing to find the message false or baseless, it would be one way to exonerate those against whom the allegations were made.

    The duty of the AG is to prosecute. The police investigates the crime supposed to have been committed and identifies the party or parties. Once the investigation is completed, they pass the ‘bundle’ to the relevant section of the Attorney-General’s Chambers and in high profile cases, the AG would personally decide whether there is enough evidence to proceed. This is the stage of the process most susceptible to political interference.

    Clearly a case of prosecutorial misconduct and his license should be withdrawn. Those falsely accused should commence legal proceedings against the AG for prosecutorial misconduct and claim damages for false imprisonment among others and the anguish they have had to go through. It is unlikely to succeed though.

    We have a case recently over here where the DA lost his license and made to pay damages to the victims of prosecutorial misconduct.. Over here the office of the DA is an elected one, and often times these prosecutors feel the need to show results or lose the election. The office of the AG in our case is not an elected one

Probably this person and RPK had some sorts of written agreement hidden somewhere. This person must have briefed RPK before making the SD.     From what I read from LKS latest thread, he has not yet being given leave but has merely served notice for an adjournment of Parliament under S.O. 18 (1) to tomorrow, so Godfather may be right that tomorrow only the Speaker would still have to rule on whether the mater raised is a fit and proper subject for parliamentary debate based on criteria of “urgency, specific and of public interest”.

    It depends on the Speaker – he is the key – but assuming he rules against LKS’s motion, the question after is whether the rightness or error of his ruling may also be contested and put to a vote that will test the majority principle in lieu of using Sharir’s motion on govt’s measures to ameliorate the price hike.

    In any case, besides the advantage of testing majority (if that could be done), LKS’s bringing it up in Parliament in presence of media/public observers would hopefully raise public profile of RPK’s allegations that our Mainstream Media has mostly – and cowardly -not done their professional duty of reporting importanty news.

    For example, “leave” to appeal is not the appeal itself. It is just permission by the trial judge to make the appeal. If the grounds for an appeal are not satisfied, leave would not be granted.

    In the Parliamentary setting, leave has to be applied for and granted by the Speaker of the House.

    a) RPK was of unsound mind or drunk or under threat while making declaration.
    b) Persuruhjaya Sumpah was also of unsound mind or drunk or under threat or was bribed when she witnessed the declaration.
    Both of them had been cautioned. The declaration is null and void. Case closed, No more wasting of public fund and time for unnecessary investigation. All Persuruhjaya Sumpah are cautioned not to witness any declaration from any unsound mind or drunk person.
