Why no protest by CSL at Ling and Chan being singled out for corruption charges in connection with RM12.5 billion PKFZ scandal without any Umno personality being charged?

Many questions are swirling in the minds of Malaysians over the corruption charges against former MCA President, Tun Dr. Ling Liong Sik and former MCA Deputy President, Tan Sri Chan Kong Choy in connection with the RM12.5 billion Port Klang Free Zone (PKFZ) scandal which do not enhance public confidence in the independence, professionalism and integrity of the Attorney-General, the Malaysian Anti-Corruption Commission (MACC) and the judiciary.

Firstly, why the MCA President Datuk Seri Chua Soi Lek endorsed the Attorney-General Tan Sri Abdul Gani Patail’s prosecution of Ling and Chan as Chua had publicly said after Chan was charged in court on Monday that “anyone who had committed an offence in the eyes of the Attorney-General’s Chamber should face the music”.

It is no secret that there is considerable questioning, not only among the general public but particularly at all levels of the MCA leadership and membership, why the two former Transport Ministers who were MCA No. 1 and 2 had been singled out for corruption charges for the PKFZ scandal when there has not been a single prosecution against any Umno personality.

This is one reason why I had posed several questions to Chua in the past three days for everyone, particularly in the MCA, are entitled to know why the MCA President endorsed the singling out and prosecution of the two former MCA leaders as borne out by Chua’s comment after Chan was charged on Monday.

Why is there no protest by Chua and the top MCA leadership at Ling and Chan’s being singled out for corruption charges in connection with RM12.5 billion PKFZ scandal without any Umno personality being charged?

Would this be selective prosecution by the Attorney-General? Is this the result of selective investigation by the MACC?

These are valid and pertinent questions, but have they been addressed by Chua as the MCA President and the entire MCA leadership?

  2. As an indipendent political observer, the question in this article can only be sum up by 1 word. “POWER”. Current political climate is not favouring the MCA and the only way for MCA to stay in power is to kowtow to the UMNO. My personal view and i think popular view on the street is MCA, MIC and all under BN is under the armpit of UMNO which is being control by non other than Najib. So why should MCA, MIC and other in BN kowtow to the people. They are only a bunch of greedy politician who only look at the interest of them and not the malaysian people. Now if they are genuinely have the people interest, they should have left BN long time ago……

    Especially Ling Liong Sik…who claimed to represent the Chinese community for 18 years under MCA…is not shaming the Chinese too?

I believed the main cut in the PKFZ deal has gone to the pockets of UMNO’s men, but as usual MCA has to bear this disgrace in-order to uphold UMNOs credibility, for example, you can’t send Mahathir to jail or else UMNOs trust or good name would be tarnished but other parties like :MCA or MIC are dispensable. This incident shows that,MCA is in BN for the benefit of the few MCA members themselve and they don’t represent the Chinese long -long time ago . Please vote for DAP.

    Two persons could not have caused such an enormous loss……many are involved at all levels for this to happen.

  9. A scam of this magnitude can only mean the participation of many crooks. If Chan was charged with cheating on a sum of RM 1.9 billion, there must be conspirators. There must be counterparties who benefited from the contracts, participated in funds transfers, and structured the web of deceit.

    Who are these co-conspirators ? For a start, look at the Fishermen’s Cooperative. Check the accounts of the office bearers at the time. Then look at Selangor UMNO. Check the accounts of the Rahman guy, his son-in-law, and also the Toyol. Then look at Kuala Dimensi – Tiong and Feisal. Then look at National UMNO – the treasurer was Chairman of several companies linked to Tiong….

    Ling, Chan and OC Phang’s roles was essentially to get the deal approved by the PKA and by the Ministry they control. Beyond that, the execution was made by others. The funds flow was made by others. Of course they all think that the rakyat is stupeeeeeed.

    I don’t think the two have been rewarded for any special deal for facing the music. They know very well that these are not the only cases. But why should they be made the fall guys to make UMNO looks good.

    The Chinese community has been betrayed by UMNO through MCA while MCA leaders were laughing to the bank. Now they taste the raw deal themselves. Can’t pity them though because they deserve that type of treatment for betraying the Chinese community first for their own good. Maybe these two MCA have beens don’t have long to endure, and they certainly did not care about their name. In hindsight, they might be regretting that they had not done something good befitting their position in the party said to represent Chinese. They abdicated their responsibility but used whatever convenience for their own good. Quite happy to see them suffer, except that it is hard to stomach UMNO’s racist habit of bullying non-Malays.

    Malaysian Union was the suggestion made in 1946 by the British. So the history of Malaysia began from 1946, or was it 1846? Or was it from the Malacca sultanate that made Najib said that Malays were enslaved by foreigners for 400 years, and from the 20th century non-Malays should pay for the sins of the Europeans who conquered Peninsular Malaysia, the correct usage of the modern geographical term.

    One can simply pick a name used in history and claim that that is where the history begins. Certainly the person who said it is totally convinced. But other thinking persons do not.

    This land was a British colony until it gained independence with the cooperation of all the population in the land represented by the political party known as Alliance. Since then the country has to follow the so-called agreement in how the land is governed, based on the constitution.

There was no question of Malays agreed to change the name of Tanah Melayu, as if Malaysia absorbed the other three states. In fact the British recognized Peninsular Malaysia as Federation of Malaya before she granted independence to this land. Malaya and Malaysia began its life as a sovereign nation with the British granting it the status of an independent nation. Since then all relations with the rest of the world were made in the name of Malaya or Malaysia as the case maybe.

    So the statement confirms that Malays are as much immigrants as the Chinese and Indians. Mamakthir himself claims to be Malay and he did not deny that his grandfather came from India, and his father would not have been born without his immigrant grandfather.

    Dictators ruled the country with their idea of how the country should be governed. Mamakthir wants to change the way how the citizens live their lives including how they retain the food habit, language and culture as well as religion. That racist argument might be relevant in the 18th century, but no more. Mamakthir has obviously outdated way of thinking but he unfortunately had a longer natural life not befitting those who advance with time.

    Those later immigrants in the countries referred to migrated to independent country after the nation had been established. The immigrants, including Malays in Malaysia joined hands to form the new nation called Malaya and later Malaysia. The logic is too difficult for Mamakthir to comprehend. It should surprise any right thinking person that as Prime Minister for two decades, he would not consider his responsibilities in the elected office were towards all Malaysians. But he never felt his responsibility to Malays either and that was why NEP was utilized for his own wealth and staying power.

    ///8. After doing this they no longer think of themselves as being of their original country. They are Americans, Australians and Argentinians period. We don’t hear them claiming to be German Americans, Portuguese Australians or Italian Argentinians, even though they or their ancestors came from these countries.///–Mamakthir

    Whatever the ordinary citizens think about their status, they were allowed to keep them as their human rights. They did not have the government telling them that they were pendatangs. They were not asked to slow down so that the so-called natives could catch up. The leaders of these democracies did not have the national policy to help the rich and then hijack the policies to enrich themselves in the name of making the natives as rich as the later migrants. They did not polarize the country into race and religion to ensure winning elections.

    ///9. Malays are Malays and it is mischievous to suggest that when asked about their race they would say they are Bugis or Javanese. It is only if they are asked where their ancestors came from that they would say Celebes or Java. Otherwise they are just Malays.///–Mamakthir

    When a person is asked a factual question, there cannot be anything mischievous about the question. It is when the person considers that the answer might have some other connotations that spin in their own mind that they consider such issue in emotional sense.

    Malay as a race has a special meaning as indicated in the constitution, article 160. The Malay in the constitution is defined for the purposes of assistance provided under article 153. Thus outside Malaysia, Malay means differently. A legal expert said that driving through the states of Peninsular Malaysia a person could alternate between Malay and non-Malay. Sarawak does not recognise mix marriage as Malay, and Mamakthir is certainly not Malay in Sarawak.

    ///10. If you ask me I would reply that I am a Malay. I would not say I am a Malay or Malaysian of ethnic Indian origin. My mother tongue and home language is Malay, my culture and tradition is Malay and I am a Muslim. The constitution defines a Malay as a person who habitually speaks Malay, practices Malay custom and tradition and is a Muslim.///— Mamakthir

    Mamakthir did not realize that there are two other conditions to fulfil to become Malay. They are as follows:

    (a) Was before Mederka Day born in the federation or in Singapore or born of parents one of whom was born in the Federation or Singapore, or is on that day domiciled in the Federation or in Singapore; or

    (b) is the issue of such a person;

    Mamakthir should also note that the word Federation refers to Federation of Malaya. How could Mamakthir say, in para. 1 above that the term Federation of Malaya is not official when the term is used in the constitution? So did Mamakthir uphold the constitution like he swore while taking oath of office.

    ///11. However I am told that IC cards in Singapore ignore Malays and state that the person is Bugis or Javanese. The intention is clear; to kill the Malay identity and create the impression that they are foreign immigrants.///–Mamakthir

    Singapore does not pretend to be helping Malays through article 153, and as a sovereign state they do not have to follow the definition given in article 160 of the Malaysian Constitution. Singapore does not have to adopt the political classification utilized in Malaysia. The interference through this comment shows that Mamakthir could not be good neighbour, let alone be a political leader who could do business in a dignified and upright manner.

    Without Singapore as comparison Mamakthir should be able to claim that he did well compared to Iraq. How could Mamakthir explain why a country without abundant natural resources beat Malaysia in all spheres of life?

    ///12. Malays are caught in a dilemma. When challenged by the opposition on any racial issue, they are unable to respond because if they do then they would be accused of being racist even by members of the Barisan Nasional. When they do not reply then UMNO in particular would lose Malay support for not defending them. This will lead to UMNO being rejected by them.     This is the only land in the world when the issue of government is linked to the race of the persons who are elected to govern. The issue of race is perpetuated because race is the convenient rallying point to look away from corrupt practices perpetrated by the powers-that-be. The Malay dilemma as a novel was created by Mamakthir in 1969, and he has been rewarded for being in power ever since. The real dilemma has been created because Malays want to remove him, but yet loves the little crumbs that racial politics apparently gave it to them. Meanwhile they suffer the fate of low-income trap.

    Mamakthir quoted many western countries but never talked about how the government got elected. They bare their policies for voters to choose rather than divide the people by race and religion to force them into enemies.

    I have oft repeated that Mamakthir is not qualified to be called a racist in the sense that he cares for his race. His is Indian by Islamic code, but he claims to be Malay for benefit. He is an opportunist.

    If UMNO had not insisted that the people should live the lives according to their strategy so that UMNO can get elected all the time with them (UMNOputras) involving in grand theft of national coffer with impunity, they would not have divided the people into those who are entitled to more assistance and those who are destined, by UMNO policies, to be discriminated, and fair and clean election would have produced government that does not have to pander to issues regarding race and religion. Mamakthir started racial politics above the table in 1969, and held on to it until now before the above paragraph is written. He might not even be sincere in saying what he said above.

    Mamakthir criticizes APs as though APs scheme for corruption started after he left government. Mamakthir talked about racism as if this is a recent feature. To him, so long as he could blame others on anything he has his sin absolved. Where has he learned this method of operandi?

    Well, it maybe possible that Najib might have a telephone assurance that this is wayang. But there would be no compensation, for certain. Beggars cannot bargain. They are now living in humiliation. Every dog has his day, and these man have their dog-days.

  14. I have raised this issue many moons ago: why the letters of support issued by MOT were quickly interpreted as the guarantee of the government. Everybody is sucking the money of the government (or is it the rakyat), not just MCA ministers.

    Why only the MCA ministers are charged. Simple again. UMNO has lost hope of getting the support the Chinese community through MCA (CSL, please wake up). They have stop courting the Chinese. So what they are doing now is to embolden the Malays back to UMNO. Think about it, UMNO has ruled this country alone for the last 50 years, so what difference does it make whether or not all these token parties are still around. Last time they pretend BN is a multiracial party. Now they just have to openly admit that they are not. It makes no difference anyway.

    3. MCA leaders who are still in the party are there for self interest only and members knew this very well, will remain in the party but will vote Pakatan Rakyat en-masse in the next general election.

    4. The next general election is also MCA expiry date. This doesn’t mean they ceased to exist, only no longer parties with political ambitions, but as welfare organizations.

  22. To be sure Ling/Chan are not the only cabinet ex-ministers prosecuted.
    Deputy Minister of Youth Mokhtar Hashim was charged & convicted for murder; Kasita Gadam was charged or corruption and acquitted.

    Ling/Chan’s cases are different because they relate to alleged criminal acts committed in the course o their discharge of cabinet duties – ie misleading PM & cabinet colleagues.

    This sets a precedent of sorts in 2 senses with their implications:-

    1. it circumvents traditional immunity enjoyed by cabinet ministers in carrying out official function. It is customary international law of which Malaysia does not expressly reject that immunity from prosecution criminal; or civil is enjoyed by executive head of Government & senior cabinet members who perform certain functions of state. This type of immunity is based on respect for sovereign equality and state dignity and also allegedly public interest.

    2. Such a prosecution based on whole cabinet blaming a wrong decision on one of the ministers’ representations may be construed as undermining the constitutional convention of cabinet collective responsibility and decision.

    1 & 2 open the pandora box with the implication that for every failed mega project endorsed by the cabinet in the future that incurs public wrath, it could single out one of its own and throw him out to the wolves as scapegoat…..

    The question raised by many here is what is the criteria for a scapegoat.

    1st implication: Ling/Chan’s case shows that where the benefits or losses fall in implementation of our affirmative policy programme appears not to subsist at only the ordinary levels but have now reached even the apex govt level.

    That leads to 2nd implication : The idea that MCA is being needed by UMNO as its showcase of BN multi racial representation is put to serious stress test. For MCA leaders are thrown to the wolves…

    And the 3rd implication : Tuns & Tan Sri’s (the highest state honours conferred by Federal) may not be a reflection that the persons awarded are necessarily of ethical or financial probity.

    Lastly the fourth – the Federal govt itself has been conned to give such hours to people they prosecute for cheating the head of government and cabinet.

    If that’s the case the jury is still out regarding who is the smart or stupid one – the one who allegedly cheated or the one who was cheated!

  23. But the charges did not say that they were involved in corruption. So the two were negligent in performing their duties.

    But the citizens are concerned about the loss of government funds due to corruption when a one billion ringgit project bloated to 12.5 billion. So Najib is not against corruption and that is why the persons who pocketed hard cash are free, and the persons who got the PM’s signatures are in trouble.

  25. Re #33 – The context is cabinet “ex-ministers” prosecuted, so whether Mokhtar Hashim was deputy or full minister – that difference due to lapse of memory – does not materially or relevantly change the context of the point put across.

    The difference in describing Mokhtar Hashim as deputy minister (which he once was anyway before he became full minister at the time he was charged) is still selling and hanging meat of the dog – ( the very same mixed breed mongrel) for sale except perhaps the met hung up for sale freshly stewed whilst the one sold is left over from the day before.

    The difference is hardly selling dog meat by hanging a cow head which implies false advertisement and deceit. To point out so is like add additional legs to a drawing of a snake.

    Soon Ling Liong Sik and Chan Kong Choy…will go to court …postponed…on and on…hoping Malaysians are fools and vote for BN in 13th GE…and when UMNO B governs again..those two puppets will be happiest.
    If BN looses Putra Jaya….non stop arrests and charges…plus oil prices go down…all essential items prices go down too.
    Break that promise..PR will have one term and back to BN in 14th GE.

  28. I thought you are smarter than that. The sell dog meat part was when you are trying to convey that all ministers, whether from UMNO, MCA or others parties are all subjected to prosecution. I don’t think this is the message being conveyed here by the owner of the blog.

  29. I m making my comment on the matter independent of what ther owner of the blog wants to convey. I am talking about the backdrop before Ling/Chan of their being not the first ex cabinet ministers being prosecuted for a criminal offence but the first judging by the nature of the offence arising from the course of their work during cabinet briefings in a milieu traditionally categorised as collectiv cabinet responsbility.

    Lim Kam Put, What is so hanging cow’s head about this? Do you know what you are talking about before you shoot as if from a cow head?

    I mentioned that before them, Moktar Hashim was prosecuted – and convicted for killing some political rival. Thats a fact.

    I also mentioned before them Kasita Gadam was charged or corruption and acquitted. Thats also a fact.

    But I also said “Ling/Chan’s cases are DIFFERENT because they relate to alleged criminal acts committed in the course of their discharge of cabinet duties – ie misleading PM & cabinet colleagues” which is unprecedented.

    So LimKamput where , as you allege, did I try to convey that “all ministers, whether from UMNO, MCA or others parties are all subjected to prosecution – of the kind that Ling/Chan have been prosecuted?” When and where did I give the impression? And whats the relevance if Moktar was a deputy minister or full minister in this equation?

Rightly or wrongly you want to give an impression that MCA ministers are being charged fairly and squarely, nothing selective, nothing discriminative and nothing phoney. That is hanging cow head selling dog meat – as the saying go, difficult to prove even if you have eaten the dog meat still thinking that it is beef.     You are entitled to your opinion though it is not yours to judge whether it is necessary. If I were to comment what comments of yours I think are necessary or those not, this Blog will break down and be side tracked by repeated expose of irrelevancies of what I think. I like to believe I am more sensible than to do that.
