Malaysians sympathise and support the decision of Teoh Beng Hock’s family to pull out of the Royal Commssion of Inquiry as it has no confidence in its independence and professionalism to get to the bottom of Teoh’s mysterious death at Malaysian Anti-Corruption Commission (MACC) headquarters at Shah Alam on July 16, 2009 after falling from MACC’s 14th floor.

The family’s confidence in the independence and professionalism was greatly crushed when the RCI today refused to accede to its requests, made through lawyers Karpal Singh and Gobind Singh Deo, firstly, that Commission Chairman Tan Sri James Foong should recuse himself as he is a sitting Federal Court judge and secondly, to be given time to seek judicial review over the appointment of deputy public prosecutors from the Attorney-General’s Chambers as conducting officers of the RCI.

How can anyone have confidence in the independence and professionalism of the Teoh Beng Hock RCI when on the one hand, officers from the AG’s Chambers are responsible for the conduct of the RCI while on the other hand, the Attorney-General is actively seeking a revision of the “Open Verdict” of the Teoh Beng Hock inquest?

As nobody believes that the Attorney-General wants to overturn the “Open Verdict” of the inquest because the coroner, Azmil Muntapha Abas, should have returned a finding of “death by homicide”, the only conclusion left is that the AG wants to repudiate the Coroner’s finding and return a verdict of “Death by Suicide”, i.e. that the MACC is completely exonerated for Teoh’s death.

How can the Teoh Beng Hock family or ordinary Malaysians have confidence in the independence and professionalism of the RCI when the officers responsible for the conduct of the RCI are officers from the AG’s Chambers – when at the very same time the Attorney-General is actively seeking to challenge the inquest finding ruling out “suicide” as the cause of Teoh’s death?

The least that the Attorney-General should have done to ensure public confidence in the Teoh Beng Hock RCI is to withdraw his application for revision of the inquest finding into Teoh Beng Hock’s death into one of suicide and to allow the appointment of independent counsel not beholden to the Attorney-General for the independent conduct of the proceedings of the RCI!

The coroner Azmil Muntapha Abas chose not to pronounce that it was ‘death by suicide’ because he was not convinced it was so, particularly when TBH sustained pre-fall injuries. The AG now wants to get the person which a higher authority to pronounce a verdict which he would be happy of. That proves that the AG is not interested in the truth. The Royal Commission of Inquiry has been convened to establish the truth, so it seems, and so the government should allow the process of seeking truth based on learned justifications.
Having established the Royal Commission of Inquiry, the government should not allow any institutions in the country to disturb the inquiry process. As the AG continues with seeking to overturn the ‘open verdict’, what would become of the RCI if it was decided that the open verdict becomes death by homicide? Would the police then proceed to investigate the murder, and the RCI is disbanded henceforth? On the other hand if it is returned ‘death by suicide’ would the AG declare that the case is over and RCI is not required? It appears then the RCI would be disbanded unless the ‘open verdict’ is maintained. In that case, shouldn’t Najib tell the AG to stop his intervention on the ‘open verdict’ now that he had acceded to the request by Malaysians to have the RCI so that the truth based on RCI could be established?

If Najib allows AG to have his way, then it would be reasonable to believe that Najib was only interested to be seen to do the right things while covertly allowing the wrongs to be perpetrated.

  2. It is always side shows to fool Malaysians….be it corruptions or death cases.
Press by demands made by Malaysians…..they comply…then outcome their nonsense…with the said sickening side shows that the same sickening verdict expected.
When Teoh’s family rejected the RCI….it speaks for itself…how much Malaysians trust our PM.

  3. It is a nightmare for foreign investors to learn of such manipulated legal justice system being practiced in this country!

Foreign investors’ eyes are sharp; they are not stupid!

The rakyat are no longer living in the 1960s. They now have analytical and discerning minds and they cannot be easily fooled.

  4. sorry, no feel good sentiment can be generated from this charade before a snal GE

the Teoh family has enhanced their moral position and do remember they were arrested and harrassed when they went to canvas moral support during the Tenang by-election. With this RCI (Remarkable Cover-up Initiative) it is really adding acid plus salt onto injury

this episode should be recorded in a revise history text book

  5. The Najib Administration has dragged TBH’s case for almost 2 years, hoping matters will cool down with the passage of time. Since they have painstakingly planned and come this far, who would believe that the RCI will be fair and professional because they all sail on the same ship.

That being the case, I am for the Teoh family to pull out of the RCI to save themselves further disappointments. The earlier they do not hope for anything fair from this No-Action-Talk-Only government, the earlier their pains will heal. Time is a master healer.

It is my fervent hope that God will help to ease their pains faster. I want the Teohs to know that like all Malaysians I share their griefs in their hour of need. Being a father with children myself, I post this comment with tears in my eyes.

    Teoh Beng Hock RIP

  6. Taxidriver, where are you heading? No connection this this path of our memory lane.

Another Kangaroo court story to laugh whenever i read thier illogical senses. What happened to thier intellectual ar?I thought their are supposed to be highly educated and professional. Are they are our deserved to have ministers?Sakit dan tak tahan kepala gua.

  7. The findings of RCI will be in MACC’s favour. This is a 100% certainty and will cause TBH’s family more hurt. Then any protest by any quarters over the findings will advantage the government who will say PR and its supporters do not respect the Law. I believe this is part of their scheme.

Let them win now, but work hard to make them lose the 13th GE.

  8. Home Min rubbished RCI’s proposal (remark #14)? But RCI’s proposal is actually the agong’s proposal. So kerimuddin bin lembudin rubbished the agong? He actually did that?

    Wow.

He is a brave man. Bravo umno. For having a truly brave fella in your ring.

In the name of the agong (“royal” this and that) umno set up the commission with one aim – to cover its gaping rearside.

  9. Does this bum Attorney General thinks people are so gullible and stupid enough not to use their heads to think. He might as well conduct the RCI while at the same time and given by his own sweet time to challenge the inquest of the coroner’s finding of ‘Open verdict’Like that ar..100% percent sure win 1.
