The year 2011 may come and go but time is continuum and 2011 or 2012 is an artificial marker, with each heralding expressions of hope of better things to come but have things changed? The problem here is mindset where everything is made competitive but a system that for 50 years pitch Malaysians against their own countrymen based on race, religion, haves and haves not. Such a system is iniquitous and I blame it because it promotes competition based on sum zero equation and such competition is the main driver for cheating hypocrisy and taking advantage. In such a milieu the old axiom “honesty or integrity is best policy gives way to cheating pays. The feeling is if there is no level playing field then I have either to emigrate (since I can’t beat the system) or if I stay I have to offset the advantages enjoyed by others with money, right skin colour or creed or political affiliation by cheating or trading positions by monetary inducements, whether in politics business or even social/private relations. Najib knows what’s he doing by giving financial benefits to school children, civil servants etc in preparation of the GE! Unless liberty, live and let live, integrity and truth lie in the hearts of greater number of Malaysians – instead of expedience or personal financial well being over other considerations – no change in year, constitution, law, or even government will take us out of our fast descent to the abyss.

Anwar is also not my favourite but so what, what has that got to do with anything? Don’t tell me RPK does not know Anwar all these years! In his posting on14 April 2011 in MT, RPK has already said that he merely repeated allegations – TV3 even reported that his SD of June 18th 2008 was based on information from other sources – and RPK further identified the so called other sources ie Ku Li’s aide and PKR strategy director describing meeting as having objective to engineer Ku Li into Najib’s seat! The whole revelation implicates and is intended to implicate PM’s rivals and dilute the effects of whatever he had said in the beginning. In the first place, if he had known all these conspiracies, why should he so irresponsibly stir up the Altantuya issue in public which after a certain time he so generously disclose to the public the conspiracy? What didn’t he put the caveat in the beginning? To me its all spin and counter spin than any responsible loyalty to what is true.

RPK said that Anwar had gone for 60 overseas trip in three years, instead of spending time helping Selangor as economic adviser he appointed himself to be.
RPK considered that it was a forgone conclusion that Anwar would be found guilty on 9 January 2012, and Pakatan should look beyond Anwar. Pakatan had to face the possibility that Anwar might not be available to lead; that is a fact of life.
What RPK said was his opinion, and if he has such a great influence, then that is his capability. He is not like Mamakthir brainwashing Malays to be racists.
I respect RPK’s right to say what he had said. It is for the people to decide whom they should vote.

If Anwar is found guilty and jailed, then Saiful, the person said to be involved in the same act with mutual consent should also be jailed. There is no law in the country which says that the person who informed the police first of a criminal act is free from prosecution, and yet the government is acting as if such a law existed. The whistle-blower Act was certainly not enacted to allow people who are involved in the same criminal activity absolved of prosecution. Or was it? If so then a law has been passed primarily for political purposes.
The Sodomy II shows that Anwar is a going to be political prisoner jailed by a criminal charge and god knows whether the court had conducted a fair trial.
The only proof the prosecutor could say was that Anwar’s sperms are found inside Saiful’s rectum. There were numerous ways that sperms of any person could get into Saiful’s rectum. The source of the sperms cannot be the proof of penetration; though the questions of why that sperms was made available should be of interest. But the law is not against the persons whose sperms went into Saiful’s rectum. Indeed, had there been penetration without leaving the sperms, the act alone would be against the law. The prosecution has not proved the act of penetration. Any doubt that exists should be for the benefit of the accused.
Had the case been placed before the Syariah court it would have not merited a trial. The fact that Syariah court is denied the accused who as Muslim has the right to be heard before it, shows that the criminal case is politically motivated. It is persecution to prevent opponent to avail of the democratic system to change the government at PutraJaya. UMNO wins the battle, but it will lose the war.
If the government claims that the people have the right to know the sexual orientation of political leaders, then it should stop at just that. The government should not use the law of a jail term to prevent people from contesting general elections. It is the right of Malaysians to choose whether they are bothered with the sexual orientation of the leader they want to elect. Sodomy one was despicable in removing opponent who presented imminent challenge, and Sodomy II shows that the present powers-that-be do not have the guts to allow the people a chance to choose a person they prefer to head a new government. In common law jurisdiction there is a tradition, and by law, such a thing called prosecutorial discretion where in extenuating circumstances serving public interest, and as a last resort, the State could keep an accomplice of an offence harmless and free from prosecution in quid pro quo exchange for his cooperation to testify and give convincing evidence against the other deemed in prosecutor’s judgment to be the principal actor of the offence of greater culpability, in relation to the witness regarded as significantly less culpable but whose evidence is considered absolutely necessary to secure the conviction of the one considered more guilty, without which public interest will not be served.
Continuing: The selective prosecution suspected here is not so much between the active and the passive actors of the offence but more of the prosecution of the charge, suspected to be politically motivated, against someone who is an opposition leader, perceived a political threat, where (a) having regard to the lack of solid evidence connecting the accused to the charge except for witness/complainant’s story line under circumstances that the witness is not credible or otherwise inconsistent, prosecution that has no
reasonable prospect, under normal and fair circumstances of securing conviction beyond reasonable doubt, is nevertheless proceeded upon; and (b) other than the one charged, no one else suspected/accused of same behaviour present or past has been similarly charged, except where it (sodomy) is as part and parcel of wider range of other criminal offences such as rape robbery etc committed at the same time. (One recalls that when it comes to others like the Petronas scholar, even if they marry someone else of same sex, the reaction and the route is via counsel and rehabilitation….) Again in common law jurisdiction political considerations are extraneous, and selective prosecution based on such considerations in deciding to level a charge is improper and mala fide.

Thank you Jeffrey for the response. Obviously this sodomy II is not serving public interest, in the sense of trying to stop a bad practice. Besides the resources of the state are being utilized by one against the other when both are involved in the same criminal offence, to settle their personal scores such as through a blackmail, assuming the state has no interest on the matter. But the people who heads the government is happy to help one party against another, and in the worse case scenario, the powers-that-be might have orchestrated the whole event!
