Warning to Najib not to discredit RCI by setting one to serve dishonourable and selfish political objectives and challenge to set up 5 RCIs on pressing issues of public importance

The Prime Minister Datuk Seri Najib Razak must be warned that he should not discredit the concept of a Royal Commission of Inquiry (RCI), which is an important device to establish government transparency, integrity and good governance, as by setting one to serve dishonourable and selfish political objectives as into the Carcosa sex video tape scandal.

Under the Barisan Nasional, public confidence in more and more key national institutions and concepts have plunged to unprecedented lows, whether it be the judiciary, the elections commission, the police, the anti-corruption agency.

All efforts by Najib under his 1Malaysia Government Transformation Programme (GTP) in the past two years had failed to check the rot as things have got worse instead of better.

For instance, in a matter of two years, the Malaysian Anti-Corruption Commission (MACC) has proved to be an even greater failure than its predecessor, the Anti-Corruption Agency (ACA) in securing public confidence in its efficiency, independence and professionalism in combating corruption, particular the “grand corruption” of political “sharks” and their cronies despite getting more powers, funds and staffing from Parliament.

Now, Malaysians don’t even trust the MACC with their personal safety after the scandalous tragedies of Teoh Beng Hock who fell to his death from the 14th floor of MACC headquarters in Shah Alam on July 16,2009 and Ahmad Sarbani Mohamad who fell to his death from the third floor of MACC office in Jalan Cochrane, Kuala Lumpur on Wednesday.

It will a real national tragedy if the RCI concept is discredited because it is abused to serve dishonourable political objectives to attack opponents in the political arena, as in the Carcosa sex video tape scandal, instead of serving national or public purpose.

The real issue of national public importance in the Carcosa sex video tape scandal is why after three weeks, the three persons constituting “Datuk T” have not been arrested and charged in court for offences under the Penal Code and Film Censorship Act when they had admitted to the crimes in the cloak-and-dagger illegal screening of offensive videotape in Carcosa on March 21?

If Najib continues to ignore the failure of the Attorney-General and the Police to uphold the law by failing to arrest and prosecute the three “Datuk Ts”, setting up instead a RCI into the Carcosa sex video tape to pursue a political vendetta against Datuk Seri Anwar Ibrahim, then the biggest casualty will be the entire concept of RCI as an important vehicle to ensure government transparency, integrity and good governance as well as Najib’s 1Malaysia GTP.

Sarawakians and Malaysians are entitled not only to question the motives of Najib, but his fitness to continue as Prime Minister, if he could set up a RCI for the Carcosa sex videotape just for the purpose to persecute and pillory Anwar Ibrahim when there are so many important public issues which deserve RCI treatment.

Since Najib is going to park himself in Sarawak for the state general elections campaign until the very end, I challenge Najib to set up five RCIs which are of great concern and import to the people of Sarawak, viz:

1. RCI into the mysterious death of Sarawak Department of Environment investigating officer Rumie Azzan who fell to his death from the 9th floor of Sarawak Timber Association (STA) in Kuching on 17th September 2004 before 11 am, as his family suspected that he was murdered as he was investigating a major environmental case in the state.

2. RCI into the mountain of allegations of corruption and abuses of power against the Sarawak Chief Minister, Tan Sri Abdul Taib Mahmud

3. RCI as to how in 30 years, Sarawak had degenerated into one of the poorest states in Malaysia when it is one of the richest states in terms of natural resources and yet could produce a Chief Minister who is one of the richest men not only in Sarawak and Malaysia, but the world?

4. RCI into the deteriorating state of religious freedom in Sarawak in the past three decades.

5. RCI into why the hopes and dreams of Sarawakians in the formation of Malaysia 48 years ago in 1963 – that Sarawak can enjoy the full fruits of development comparable to those enjoyed in Peninsular Malaysia – had failed and even causing a major brain drain of Sarawakians whether to other parts of Malaysia or to other countries.

Let SUPP President Tan Sri Dr. George Chan explain whether he dare to support the call to the Prime Minister to announce the establishment of these 5 RCIs during the Sarawak general election campaign?

Following a rift with in UMNO, he unsuccessfully tried to establish a new party UMNO Malaysia. In the general election of 1990, Abdul Rahman actively participated and widely campaigned against Mahathir Mohamad despite his worsening health. He died on 6 December 1990, aged eighty seven and his body was buried at the Langgar Royal Mausoleum in Alor Star.

  2. If you feel that Federal Govt has no concern about maintaining independence of institutions, why would it bother about integrity of the last remaining one like RCI?

    The more important question is this : if the PR opposition is of the opinion that RCI is denied if it embarrasses the ruling coalition or is invoked selectively only if further the ruling coalition’s political agendas, why can’t the PR opposition forms its own commissions of enquiry?

    By right the States government/assemblies controlled by PR can pass state laws. Unless there’s something in Federal Constitution to stop, which I think not, what is there to stop the state government from passing laws to form its own commissions of enquiry? (You have passed laws on Freedom of Information, didn’t you???)

  3. Reposting: The rakyat/public expects a commission of enquiry to be independent. If you feel that a commission of enquiry should not be vested in the discretion of the Federal Govt (which is influenced by partisan political considerations) my question what is there to stop PR that controls several state govts/assemblies from promulgating state legislations to have/invoke state commissions of enquiry into matters of public or state importance for which no Royal commission of Enquiry is invoked by Federal Government??? Who says this is not possible unless there’s something in Federal constitution to block it, which I don’t think so. You pushed through at state level freedom of Information that Federal didn’t agree, didn’t you???

  4. Testing moderation: Solution for PR – have PR controlled state assemblies pass state legislation to have your own state commissions of enquiry to enquire into matter o public importance for which no Royal Commission of Enquiry is invoked by Federal government.

    After the prime minister followed the red carpet trail leading into the hall to the sounds of hoots and whistles from the white-shirt supporters, hundreds were seen streaming out, choosing to opt out of listening to his speech. Instead they were seen loitering around the stadium complex chatting and feasting on the hamburgers and mineral water that were handed out. Even as Najib’s function kicked off large numbers were seen lounging in the buses and vans that had ferried them into the venue. When the prime minister began his speech large groups of people garbed in the 1 Malaysia t-shirts decided to stream out of the hall.

    So they came for the free food and t-shirt…..

  9. All these talk of RCI and the sex tape really at the core is about Sarawak election and THAT has changed. Its clear the chance of removing Taib is very high now given the progress of the Sarawak state election. Instead is now about WHO to replace Taib and if a RCI is needed, then its must be for a Dayak Christian to take over Sarawak CM post.

    The Dayaks must now be urged to vote as big against BN to get as good a candidate for CM as they can get. BN must sent a message that Sarawak is to be ruled by Dayak, trustworthy and capable Dayaks, not BN puppets to fufill the promise of Malaysia agreement. Its high time a Dayak Christian take the post of CM

  10. RCI on the sex tape would be one great big joke by umno and an insult to agung and the country. It was supposed to distract anwar and pakatan in the ongoing sarawak state election. Of course we now know that the distraction had ricocheted and had caught umno full in the face. As a result of that umno is now desperately trying to do damage control.

    RCI on the tape, for what purpose? To establish that the recording is genuine and has not been doctored? Nobody bothers. No one is interested in this. In any event, didnt the police anounce last week that the recording was genuine? (Oh yea yea. So what?) To establish the actor in the tape? What for? He is obviously not anwar. That is the belief most commonly held by the people. Against that, if umno were to force a RCI finding (another commonly held belief) that he was in fact anwar, umno would effectively be shooting itself in the other foot.

    No way out umno. And guess what. In the light of this development, Anwar’s conspiracy argument in sodomy I and now, II, has been given an additional and very large dose of credibility. Oops. Have you shot both your left and right foot at the same time in producing the tape, umno? If so than dont you RCI the issue now. Remember, umno. You have no more foot to shoot. You rambutan must be placed next in the line of fire, I am afraid.

    What are the meaningful results after PBS pulled out of Sabah? Firstly UMNO went into Sabah. Secondly UMNO created Project M to admit Muslims from outside Malaysia and they were made Sabahans with blue IC and they enjoy the status of Bumiputras. These illegal NEWMalaysians are the backbone of UMNO in Sabah. There were only 6,000 Malays in Sabah counted in the1960 Census. The immigration laws in Sabah prohibit free entry of Peninsular Malaysians into Sabah as a protection for the locals. Yet Sabah has more than half of the constituencies said to have majority of Malays as voters. Bajaus, the Muslim natives of Sabah formed only 23% of the population in 1963. Even if these Muslim natives are now known as Malays, betraying their own roots, the other 25% of the population more appropriate known as NEWMalays are in the state because UMNO through the state government manipulated the immigration law. Yet Najib thinks that Carcosa sex tape is more important than finding out how outsiders became Malaysians through Project M. Yes, Najib knows it well how the inordinate increase in illegal Sabahans takes place and counting and he does not need RCI, but the people of Malaysia want to know how this illegal practice can be stopped. Native Sabahans, that is, those who were Sabahans at the formation of Malaysia and their issues are now outnumbered by illegal preferentially treated NEWMalays. From that point of view Pairin Kitingan has a cause to express regret. The regret was that it joined the coalition with UMNO which would go dirty to the extent of changing the characteristic of the state. By the same token Sabahans should regret joining the other parties to form Malaysia. Yes Pailin regretted jumping out of the pot instead of being boiled like a frog. But he should have regretted that he had not the capability to do better than rejoining BN.

    Malaysia were happy that the 1969 election prevented the Alliance party from winning two-third of the parliamentary seats. Since then and with the need to whitewash coup d’etat NEP was formulated. The ill that we face in the country, which is moving towards the state of Zimbabwe, has no doubt been caused by the results of the 1969 election. UMNO wants non-Malays to regret that decision. But should a democracy be held to ransom by terrorism?

    One would expect a leader of the country, Najib, that is, to do some soul searching as to why Pairin Katingan made that remarks. Najib might have in mind that Katingan lost time in enriching themselves. That is BN politicians’ motive in joining the most lucrative enterprises, politics. Najib is in politics to take, rather than to give his time.

  14. Even if the state governments can set up RCI, what good is it if recommendations cannot be implemented? The IPCMC recommended by RCI remains on paper. The RCI on Koret Koret Koret has no follow up. RCI has been used to silence the opposition to say that the government cares. Now the government uses it as a political vehicle to influence voters. How low can the country go?

    By saying that Taib will step down as promised, Najib knows that Taib is not welcomed. Taib is not wanted as CM. Why should the head of BN allow someone the people do not want to continue in the post. Was the time given for him to make more money, and to arrange his wealth to look legal? Why should the interest of the people come later that that of the state Chief Executive? The position of the elected office as CM is not hereditary as if the people of the state owe Taib to enjoy himself like royals? Does Najib mean that Taib has yet to finish enjoying his entitlements that he should have a few more years? So Najib also considers his position as PM an entitlement?

    Other than changing the government, and offering an amnesty in return for the corrupted persons to return all their ill gotten gains, and earlier retirement, there is no way to prevent more unaccountable death not necessarily in the premises of MACC.

    ICAC of Hong Kong could be successful because corruption is not wide spread there. Corruption here is institutionalized and once anyone is hauled up for investigation, others who fear being exposed can turn desperate. Besides corruption has become an acquired culture particularly in the name of ameliorating the sense of jealousy whereby the government pioneered the practices that rewards are not connected with inputs. Corruption in the country will grow from strength to strength as long as NEP is alive.

    The police was certainly not smart to verify whether the tape was genuine. It certainly was since it would be difficult to doctor the tape. What was needed was to make the person looks like Anwar. How can the police look at the tape as say that the person in the picture look exactly the same as in real life? That was why a watch has to be in the scene so that DNA could become an issue.

    What went into the anus of the Ful of Sai according to the AG had to be introduced by the conventional mean, and that mean is sodomy. There was no need to prove that sodomy did take place. The watch bearing the DNA of any person proves that the identity of person in the video. How convenient?

    This true for matters within Federal jurisdiction regrading which nothing is implemented. However a matter comes under state’s it may be different.

    However whether or not there is implementation, exposure of the truth to the public via state commission of enquiry is as important for the political process. The public look to the States/opposition commission of enquiry for truth where the Federal’s one is deemed inadequate as ruling govt controls whether to invoke it, what terms of reference and who sit in panel.

    Taib Mahmud is like Interlok, which should have been dropped. But BN and more accurately UMNO wouldn’t dare to remove Taib now. If Najib’s words is meaningful, get Taib Mahmud to withdraw from the election. As soon as Taib announces it, and sign a letter resigning from the seat if elected, then Najib’s word does carry weight. But it is BN that made Taib Mahmud too big to handle, and Sarawakians should not only deny BN the right to form the state government, they should also deny BN the convenience to remain in Putrajaya.
