The exhumation of DAP political aide Teoh Beng Hock at the Nirvana Memorial Park, Semenyih this morning has been carried out satisfactorily and the second autopsy will be carried out at the Sungai Buloh Hospital tomorrow.
Thai pathologist, Dr. Pornthip Rojanasunand, who was present at the exhumation, said Teoh’s body is still in good condition for the autopsy.
Teoh Beng Hock’s mysterious death at the Malaysian Anti-Corruption Commission (MACC) headquarters in Shah Alam on July 16 has become a national and international cause célèbre and touchstone of the independence, credibility and professionalism of MACC.
Teoh’s death and the ensuing crisis of confidence in the MACC is undoubtedly one major reason for Malaysia’s worst ranking and score in 15 years in the recently-announced Transparency International Corruption Perception Index 2009, plunging 33 places from No. 23rd position in 1995 to No. 56th position in 2009 and a drop of .77 score from 5.28 in 1995 to 4.5 in 2009.
All were burdened with a heavy heart at the exhumation as it is a painful process which Teoh’s family, DAP leadership, friends and supporters had to go through so that there can be a second autopsy to get to the bottom of his death and to bring to book his killers, as no one believed that Teoh committed suicide by jumping off the 14th floor MACC headquarters.

The exhumation comes following the testimony of Thai pathologist Dr Pornthip Rojanasunand that the death of the political aide was very likely a homicide.
A team of ten police forensic experts had earlier cordoned off the grave area with the aid of several cemetery workers, who are helping with the exhumation.
Teoh’s family members arrived earlier, and began offering rites to the departed’s spirit. A feng shui master explained that the time of the exhumation had been chosen specifically to coincide with swallows beginning the day, for good luck.
Dr Pornthip is also on the scene to observe the exhumation process.
Following the prayer rituals, the casket was successfully disinterred and displayed to the media present, before being covered in plastic sheets.
The family’s lawyer, Gobind Singh Deo, said that all parties involved were satisfied with the way the exhumation was performed and added that Teoh’s body was still in good condition for the second autopsy.
Dr Shahidan Md Noor, the chief pathologist at the Sungai Buloh Hospital, along with Dr Pornthip are expected to carry out an X-ray examination on the body later.
The casket containing the body has been transported to the hospital, which will be the site of the second autopsy scheduled to run from 9.30am to noon tomorrow.
Teoh’s former employer, Selangor state executive councillor Ean Yong Hian Wah, said at the cemetery: “I hope the second autopsy will reveal the truth.”
Yong also stated his desire to know how much the government spent hiring the UK pathologist Dr Peter Vanezis — one of two foreign pathologists, along with Dr Pornthip, who will be observing the second autopsy.
Dr Vanezis, who serves as a director at the Cameron Centre for Forensic Medical Sciences in London, has handled over 2,000 autopsy cases involving sudden death, of which 1,500 were found to be homicides.
“The fact that they hired a foreign expert shows they have no confidence in the local pathologists,” Yong added.
DAP’s Lim Kit Siang and Ronnie Lie were also in attendance. Both expressed hope that a fresh autopsy will reveal who or what “killed” Teoh.
Lim also added that Teoh’s death may have been a contributing factor towards Malaysia’s worst ever placing in the Transparency International Corruption Perception Index.
This is Malaysia my friends. I am just as hopeful as everyone that the truth be prevailed but behind my mind which I had already said in my blog when 1Najib met with TBH’s family, 1Malaysia Najib already had the verdict in his hand and that is “committed suicide” or an open verdict. You can do whatever you want but the end result remain what 1Najib wanted it to be.
If the motive and the mastermind for the murder of Altantuya were not pursued by the government and the case seems to have closed with the conviction of the two men, what makes you all think that they will get deep into the death of TBH especially when every indication points to murder.

It’s an interesting question, though possibly not central: does the Inquest produce a full account of costs at the close? In the interests of the moral high ground, an alternative explanation for hiring another foreign expert would be to avoid problems of bias due to alleged ‘superiority’ of witnesses. From the outset, Teoh’s family, knowing that the integrity of the regime in power is in question, should have persevered and pursued the matter to the end to find out how Teoh died so that a second autopsy is unnecessary.
Anyway, just hope everything is not too late and the cause of Teoh’s death will soon be established.
I don’t know about Vanezis (professional fees) but I am sure that Dr Pornthip is not paid by Selangor State Govt or the family or any party at all. I believe her air ticket is covered by the Selangor State Govt.

If the motive and the mastermind for the murder of Altantuya were not pursued by the government and the case seems to have closed with the conviction of the two men, what makes you all think that they will get deep into the death of TBH especially when every indication points to murder.
Yes, it does seem strange as to why two ‘elite’ cops (who happened also to be part of the security team for government VVIPs) would want to murder a foreign citizen and try to dispose the victim’s body by blowing it up with plastic explosives, as if they didn’t know that their colleagues in forensics could follow the trail of the crime’s evidence back to them…
TBH’s death has also given rise to (obviously pro-BN/pro-MACC) theories of him having committed suicide (What could have pressured him to do so if he was being questioned/interrogated by MACC as a witness, and when he was about to get married and an expectant father?), or having taken the wrong step and accidentally falling out the window because of exhausted (If this is very plausible, shouldn’t there also be a subtantial amount of reported cases of office workers taking the wrong step & falling out of their office building windows due to exhaustion caused by doing too much overtime, for example?
Bringing in foreign pathologists this time round should not be a surprise as a local pathologist had already admitted that TBH’s autopsy had been contaminated by an earlier autopsy because someone had carelessly forgotten to wash and clean the examination table in between autopsies. And this was used as the reason to explain the presence of unidentified DNA traces on TBH’s body earlier on.
Of course, if the local pathologist happenes to be a government servant, there could be doubt about whether this person is 100% politically neutral…

It is “one-upmanship” on MACC’s part that I wholeheartedly support.
Pornthip faces major legal obstacles. Our Criminal Procedure Code (“CPC”) restricts post-mortem examination of a body to a government medical officer in which category Pornthip is not. Our Medical Act 1971 requires post mortem to be conducted by practicing licensed Malaysian physicians registered with the Malaysian Medical Board, which again Pornthip is not! So how is she going to give a valuable expert testimony, admissible in Cornoner’s Court in the face of such legal constraints if she’s not performing the 2nd post mortem personally?
The only way is for Pornthip supervise, give directions, give pointers on the side line as to what and where to look for crucial clues, have them recorded for interpretation and conclusions. Then the next question is how effective and credible is this indirect approach of a foreign expert bystander giving guidance on the side line in terms of the value of evidence in Coroner’s court if she did not perform post-mortem herself?
I think this approach is good if MACC itself appoints its own foreign expert in the person of Dr Peter Venezis. It means that the Coroner Court is willing to listen to foreign experts provided that there is fairness in the arrangements that if Pakatan Rakyat Selangor State government is allowed to bring in Thai expert Pornthip, so can Government/ MACC bring in UK expert Dr Peter Venezis. The worst case is Coroner Court not willing to listen to foreign experts because of the legal constraints of CPC and Medical Act!
Having established this, the next good thing is the fact that MACC wants to play upmanship and for this reason it gets internationally renowned reputable foreign expert, like Venezis, never mind he is expensive and comes at great cost to public expense. This is because there are greater issues at stake hanging in the balance regarding Teoh Bng Hocks death regarding which the Truth of how he died – suicide or killed – must be ferreted out.
Would we rather MACC engage at lesser expense a half past six unknown and unsuccessful and financially hungry foreign forenic parthologist to represent it and skew his judgment on the side of the party that pays him to rebut and contradict Pornthip just for the sake of doing so? He relies on his reputation and integrity for his professional success and it may well be harder to make a man like this to skew his opinion by a paltry bribe and appointment fee that MACC could possibly offer. He probably takes on the case because it is cause célèbre; the fact he is appointed will attract international media attention making this an international cause célèbre making it even harder for attempts at cover up!

It is but a simple question : was Teoh Beng Hock killed (never mind by who at this juncture) or did he commit suicide as government pathologists suggested?

Unlike government pathologists, Venezis is not under our government’s payroll nor does he need to maintain the good graces of our government. He needs the trust and confidence not only of his peers in the international medical and academic arena but also the respect of well paying patrons like billioanire Mohammed al Fayed, owner of Harrods! I am therefore not banking on Pornthip. I know her likely stand – 80% homicide, 20% suicide. Besides she is appointed by Opposition controlled Selangor state government. Detractors and BN admirers will say she is bias.
I am absolutely banking on the professional judgment and integrity of Dr Peter Venezis – that it cannot be compomised just because of his appointment by MACC. I hope I am not wrong on this.
However if I were right, and Dr Peter Venezis expresses an opinion in concurrence with Pornthip that it was homicide, can one imagine what are the implications if MACC’s own appointed foreign expert opines that Teoh Beng Hock was killed and did not commit suicide?
There are three immediate implications:
1. It will negate all allegations of bias (as in Pornthip’s case and accepted as truth because he is MACC’s own appointment! Our local forensic pathologists will have to go for refresher course and re-sit their examinations! But this is minor implication…
2. The fact that Teoh Beng Hock was killed within MACC’s precincts, when he was under the protection or control of MACC means that MACC – and by extension the government – is squarely responsible, never who did the killing (whether MACC’s rank and file or an outsider permitted to come in!
3. This puts the entire system which consists of the MACC, Police, authorities, the doctors (from Klang and UHKL), and officers in Putrajaya – everyone – on trial as to why in the beginning they, acting in concert, only look into the possibility of TBH’s suicide without considering homicide and without evben attempting to answer much less probe why TBH had injuries of the neck and anus!
In the premises, everything then hinges on Dr Peter Venezis’s testimony as MACC’sm own appointed forensic expert. What he says marks the turning and critical point of what’s going to happen later, for eg the Royal Commission of Enquiry and further police investigations if any.
We are absolutely depending on his repute not to be bias.
If MACC wants to spend a lot to engage at great public expense, a well renowned forensic expert for the sake of “one upman ship”, and this well renowned expert has less temptations to pawn his professional reputation for a one off engagement by MACC, then I say for once this money is well spent forb truth is priceless in this case!
This incident prove that our local forensic experts are either stupid or corrupted, unable to provide accurate autopsy report or force to provide false report.
This young and idealistic Teoh Beng Hock will be remembered in the history of Malaysian as spirited fighter for change. A new symbolism for young Malaysian generations to make this country free of tyranny rule under Umno BN.

Malaysia Medical Association (MMA) position on disallowed foreign experts to directly conduct second autopsy is something very disappointed. MMA owe public an explanation with regards to the doctor professionalism in Malaysia in so many ‘biased’ medical report happen in Malaysia.
Big question mark in Teoh BH case to MMA: Are government doctors conduct professionally in autopsy reports when they claim in testimony that Teoh commit suicide? Will MMA imposed any investigation and punishment is fault play found on these two doctors?
We have witnessed so many government hospital with highly suspicion medical report such as Anwar’s sodomy case and Kugan autopsy report. MMA had never initiate any investigation or call for inquiry into professionalism conduct of these doctors. The exhumation of TBH’s corpse for second autopsy is only for ‘show’ to appease the his family and rakyat. The UMNO Baru pathologist will say the high level of decomposition makes it impossible to conclude anything, and this will be supported by the UK pathologist. Thai pathologist, Porhthip Rojanasunand will disagree and protest but to no avail.
Najib will urge the rakyat to accept the expert opinion of the majority of pathologists. He will say ” We cannot charge anybody for murder when the experts already said they cannot say with 100% certainty the actual cause of death. The professional record of this man evinces that he looks for clues of homicide (1,500) where others said that they were not.
[He was engaged by Harrods owner Mohamed al-Fayed to determine if Henri Paul, who was driving the car in which his son Dodi and the late Princess Diana died, was drunk during the accident. The suggestion is if Henri Paul were not, then it could be foul play, whether by British Secret Intelligence (M5) or others – for it is Mohamed al-Fayed’s conspirarcy theory that Diana was pregnant with Dodi’s child].
The temper of mind and record of this man is to uncover foul play.
It’s a mystery to me why MACC wants to engage this man whose professional forte is to expose foul play – unless MACC itself is open minded enough to accept exposure of foul play which only serves to shoot its own foot & implicates the entire Malaysian system of criminal investigation and forensics!
To conclude suicide on the side of MACC, Prof Vanezis has to ignore injuries of the neck and anus sustained by Teoh Beng Hock (TBH) before death that Pornthip suggested.
How could a professional like Prof Vanezis ignore neck and anus injuries that appear like an elephant in the room?
Surely he cannot claim that THB’s decomposition within 6 months period is so advanced that these injuries cannot be inferred.
After all it only 6 months – a flash in the pan – compared to 5,300 years which was the age of the an Italian shepherd, whose mummified body was found at the tztaler Alps near the Austrian and Italian border in 1991 that the good professor conducted forensic tests upon on how he had died!
I’m quite surprised that the Govt “hired” this UK pathologist. Everything about this case has shown that there is a massive coverup so why bring in someone who will probably not agree with the initial autopsy?

Even if it is proven that TBH was killed, what is the remit of the Inquest? Do they continue investigating, or do they declare “murder” and pass the case back to the police? It seems unlikely that the outcome of today’s investigation will point the finger at anyone in particular. We can only hope.

It is well nigh possible – as I see no motive on MACC part (officially) to kill TBH (a part of Opposition DAP) when he (alive) he would be more useful as key witness to bring down Pakatan Rakyat Selangor state govt (as desired by their bosses in Putrajaya). Also if TBH was killed by accidental 3rd degree methods in the course of official interrogation, his death would be around 3 am during or when interrogation ended rather than after 8 am estimated time of death. There is a big question mark of why he stayed on in MACC after interrogation ended after 3 am. Of course the MACC did not release him or give him back his hand phone/ belongings which is just as consistent to the speculation that he could be cooperating (maybe due to earlier threats and coercion) and awaiting complilation of reports for signing…We don’t know this part.
MACC’s denial syndrome that TBH was killed is understandasble because whichever way one looks at it – whether by MACC’s personnel or accidentally or “subversive elements out to protect their own interests” – MACC would still be culpable as death occurred whilst he was under their custody, control and protection. If “subversive elements” could get to him within MACC precincts it shows that elements within MACC were in complicity with subversive elements – so MACC would still be culpable.
I assume ultimately we want to know the Truth of his death and it matters not whether investigations lead to who and open the pandora box – whether pointing at govt agencies, “subversive elements” or further to door steps of one or two miscreant Pakatan Rakyat assemblymen!

At this moment, before the question of who killed him may be addressed, it is trite that the other prior question of whether he was killed by others or he committed suicide in the first place must first be settled conclusively.
Once Prof Vanezis settles the issue that he was killed (homicide) it means clearly that there cannot be a closure to this matter, and no matter that the Inquest could not determine the identity of the killer, the finding of homicide (as opposed to suicide) will make it (1) imperative for police to re-open investigation or continue with more intensive investigations along that line of homicide, and also (2) provide all justification for public/opposition demand for the Royal Commission on the MACC itself to determine how and why murder most foul could occur in the course of MACC’s work in their premises!
Such a finding (of homicide) will effectively dispel all official pretensions that security agencies are performing their duties with professionalism. It immediately shifts onus on authorities and BN govt to show cause why they should not be booted out in the next election.
The simple reason why money politics is so prevalent especially in UMNO election is because when you are in position of power, you can emass tremendous wealth. How can it be logical then to think that just with the existence of MACC, these crooks who have used so much money to get to where there are will allow the MACC to really act as they should. We may propose great amendments to MACC that can really make the body effective but we will just be kidding ourselves to think that those powerful UMNO warlords or other corrupted officers will let these admendments see the light of day. The only way change can come is a change to the Federal Government in the next election. By the same arguement these mafias in the government will not easily allow that to happen even if they loose. … They will stop at nothing to remain in power.
I think it is reasonable to assume that it cannot be MACC’s official stance to see TBH dead when he was more useful alive to implicate PR selangor state assemblymen.
His probable death is – I would speculate – likely a private initiative, an unofficial and unsanctioned act of an individual or individuals with clear motives of wanting specifically to torture and kill him and who have access to him in the time between end of interrogation at 3.30 am and his death at 8 am.
Who the killer is – is likely someone whose interests or who represents interest that will gravely be threatened and prejudiced by his being alive…..
His being alive was of course of no threat to anyone (until he walked into MACC office for questioning as a witness). So it boils down to WHAT he was going to testify (after interrogation) that will truly determine the motive of his killing and who might that be.
The circumstances then point to him being prepared to cooperate with the MACC – consistent with him being held back and not leaving MACC after official interriogation ended at 3.30 pm.

Dr Pornthip claimed several cars followed her Friday night & to the Semenyih Memorial Park yesterday for exhumation.
Teoh’s case looks set to be 99% murder case. If those people had nothing to do with Teoh’s death, they would not have followed Dr Pornthip.
I am just wondering what the Malaysian pathologists who conducted autopsy #1 are going to do if the second autopsy reveals what they have not found or refuse to find in the first autopsy! Can we call them “professionals”? Are they qualified to be “professionals”? And just where are they going to hide their faces????? Malaysia BOLEH? Think again!

Thats true. As you said, “no right minded person will ever think so”. So its killing – that leaves two possibilities:
1. caused by MACC personnel during MACC interrogation; or
2. caused by MACC personnel or unknown persons (with complicity of one or two persons inside MACC) (after interrogation).
If you believe MACC interrogation ended at 3.30 am and TBH’s death was hours later after 8 am, then it has to be situation 2. In such a case, it must be asked, and one cannot escape the question, of who stands to benefit from the killing of TBH.
Agrre that in either 1 or 2 situation, MACC will be responsible as crime occurred within its precincts. That however however cannot prejudge who actually perpetrated the act and for whom. You can point fingers at MACC if you think it benefits from TBH’s elimination but do you really believe that’s the case? Is it rational to so believe?
Hopefully we and the World get to the truth of how this Gentleman Beng Hock died at the hands of Officers from MACC-another political tool of UMNO/Bn.
Malaysians need answers to the dead of over 1000 people in Police Custody (Over One Thousand !- a staggering number in a civilised democracy ? ) including Kugan !
No one will feel safe in a land where the Police & Law Enforcement Officers go about their duties on behalf of their political Masters, to be the Ultimate Judge,Jury and Executioner.

The 5 Indians shot dead recently has a pattern seen so often-they shot at polis DiRaja M’sia then polis DRM had to shoot back and kill them all !
No witness,only the Polis word against Dead Men !
These officers are giving the Royal Msian Police a bad name !
This is a Malaysian Issue that concern everyone not just Indians !
For Evil to continue,Good Men & Women say and Do Nothing !
Keadilan-Dap-Pas should raise this issue and ask for a Royal Commission to stop the ‘shoot to kill’ policy.
Teoh probably had accidentally overheard somebody or a certain party’s secret which he should not have heard. That probably led to his death.
The above is only my speculation. I have not been to the MACC office and I do not know whether it is possible to overhear talking going on in any of the rooms!

When a “Professional” association is making such a statement, it is already more “Political” than “Professional”.
A medical report from Penang GH by a “specialist” and lecturer of the Medical College as follows can also tell how “creditable” Government Medical Report be even for a simple Lawyer assaulting clients case:
1. The blood pressure for patient A, 8 hours after being assaulted, was 158 when his normal pressure was 110. An intravenous Infusion was done to bring the pressure done.
2. He was admitted also because of blurring of eyesight.
3. He was discharged after blood pressure resumed to 110 but still with blurring of eyesight, sore-limbs. Bruises were found 2-3days after discharged and was examined by the doctors.
4. The report was written saying
a) The Patient was admitted with biological data normal and was discharged…..
b) The medical report for Client B being assaulted: Blood pressure 158 – a known case of hypertension…
5. After a compliant to the Health Ministry, then the second report for Client A came with the blood pressure and the bruises but a 2nd reading was given without mentioning that Intravenous Infusion was given and blurring of eyesight remains. It was diagnosed as Cerebral concession but only x-ray of the skull was done and repeated to the chest even with repeated complaint of blurring of eyesight.
Head Chart examination was done.
5. The hand was numb after 2 days and blood shot out of the vein after a normal acupuncture.
Shouldn’t at least CT scan on the skull be the more appropriate examination? Or, at least some other examination to look into the eye-blurring?
Did Doctors think of Professionalism before they write a Medical Report, especially when it also related to Grievance?

You have been putting much time and effort making a lot of speculations on the possible causes of Teoh’s death.
However, you simply did not remember that the first immediate response from MACC officer on Teoh’s death was “Who the hell will expect that there would be an accident!” I am sure that the MACC staff who were on duty on the same day as Teoh’s death would have the some clue and a strong feeling on who really did it. However, as a matter of fact it is not a conventional practice for Barisan Nasional Government employees to voluntarily pinpoint the fault of other who works in the same department. The MACC top officer may just want a foreign expert to pinpoint the true culprit on his behalf so that he won’t have to offend the alleged by straightforward saying to the public that Mr so and so really did it! Sadly, to keep other colleague’s fault secretive and confidential has already become a bad office culture in Malaysia’s government offices! That is the reason why MACC needs to pay an expensive fees to engage a foreign expert in order to pinpoint the fault of MACC itself!

I am not aware that there was a “first immediate response from MACC officer on Teoh’s death” who said “Who the hell will expect that there would be an accident!”. If there was such an MACC officer who said that, was he called to testify at the Inquest?
As far as I know it was “first immediate response” from some journalist writing for mainstream papers – and RPK in MalaysiaToday speculating what could have happened.
