Teoh family rejects Cabinet decision and demands comprehensive RCI into TBH’s death

I have come to Alor Gajah for the media conference by the family of Teoh Beng Huat who has just announced that they reject the Cabinet decision yesterday on the mysterious death of Teoh Beng Hock, who went to the MACC Hqrs as a healthy, vigorous and idealistic political worker but ended up as a corpse.

The Prime Minister, Datuk Seri Najib Razak and the Cabinet Ministers seem to be Malaysia’s David Copperfields, creating the illusion of a Royal Commission of Inquiry (RCI) in Teoh’s death when actually there is none.

Like Teoh’s family members, I had at first welcomed the Cabinet decision when there was at first news that it had decided on a RCI on Teoh’s death but when the details of the Cabinet decision became known, we were all dumb-founded, shocked and outraged.

What is the use having two inquiries, with an inquest into Teoh’s death but a Royal Commission of Inquiry strictly prevented from delving into the causes of Teoh death but only to probe into the MACC’s investigative techniques?

I support the Teoh family’s stand to reject the Cabinet decision as it does not represent what is wanted by the family and the people – a RCI into the causes of Teoh’s unusual death.

The Teoh family has called on Najib to respect their wishes and those of the Malaysian public for a comprehensive Royal Commission of Inquiry into Teoh’s death and to alter the Cabinet decision accordingly.

Najib has said that he wants “the truth, the whole truth and nothing but the truth” about the causes of Teoh’s death, and if he serious and sincere, let him accede to the wishes of the Teoh family to have a comprehensive RCI into Teoh’s death.

Najib said he would meet with the Teoh family after the outcome of the inquest into Teoh’s death and the Royal Commission of Inquiry. What is the use of meeting the Teoh family when the damage had been done.

Najib should meet with the Teoh family to hear their wishes for a comprehensive Royal Commission of Inquiry.

I will write to Najib conveying the Teoh family’s request for a meeting with Najib and I am prepared to accompany the Teoh family to a meeting with Najib.

    If the purpose is to find the cause of death, whether it was suicide or the result of foul play the inquest would be the way to go.

    Clearly there is foul play. So the way forward would be for the police to investigate, find enough evidence to charge the perpetrator or perpetrators and the rest is up to the AG.

    The Royal Commission is to look into a broader range of issues.

  2. Anyone for that matter will see red and duped, what more the feelings and anguish of Teoh’s family members who demand and want a Royal Commission of Inquiry into Beng Hock’s mysterious and suspicious death and not just an inquest led by a magistrate which has limited powers.

    The whole truth should be revealed and not half-truths, and no stone should be left unturned into the circumstances surrounding young Beng Hock’s sudden demise.

    There should be only one commission to look into firstly, Beng Hock’s death and secondly, the MACC’s standard operating procedures (SOP) in questioning witnesses and other duties. There are no two ways about it!

  4. This is bigger than Teoh Beng Hock. Setting up a Royal Commission to look into what happened to a witness in the custody of an investigative body like MACC, would pave the way for more Royal Commissions to look into the workings of the justice system starting with the Altantuya murder trial.

    Najib is smart enough to know that we are handing over a rope long enough for him to use and hang himself with it. He is not stupid.

    More and more, this looks to me like a CYA (Cover Your Ass) approach by the govt. If it smells like a CYA, acts like a CYA, sings like a CYA, walks like a CYA, wags like a CYA, then IT IS A CYA. The question is: “Whose Ass or Asses is Najib trying to cover?”

    Najib always talked about people should judge him by his action. But, when the tyre meets the road, he fails to come through. Obviously Beng Hock’s life is worth less than the MACC stupid investigating procedures. What is there to find out when even a fool knows what MACC is up to.   8. PDRM is one of the best in the world. We have trained by the British and have undergo many many test such as during the communist era. PDRM is very experience not with standing that corruption was the norm.

Without doubt, he has a massive following and is highly respected in Malaysia. That’s what most people see him. His accomplishments as a stateman.

    But most people failed to reason and see his controversies. His mismanagement of the country and abuse of power. We inherited a corrupted system from him, where some said to the point of irreversability. The government, government agencies, the police, the courts, the ACA (now MACC) and you name it are linked to the system of management called Mahathirism. It is corrupted to the core. His successor, Abdullah tried to reform it. He failed.

    Now the MACC is on the latest list of Royal Commission of Inquiry formed to investigate the MACC standard operating procedure in relation to the investigation process following the death of an opposition aide in a highly suspicious manner.

    Public institutions such as the police, the courts and the MACC in the list of Royal Commission of Inquiry shows the grave and serious breaches during Mahathir’s era has yet to recover. Yes, there is Royal Commission and there is reform but what’s the results? Still the same?

    Mahathirsm is here to stay for a long time. It is invented by the great, or should I say the greatest Prime Minister of Malaysia we all come to admired of. No matter what Royal Commission, what reform and what 1Malaysia concept, Mahathirism is there to fill the gap in case of doubt and delusion.

    I would say we would be better off without Mahathir.

  17. Some skeptic might think that police investigation will do to find the truth. That is correct but in this HERO TEOH BENG HOCK ‘murdered’ case, it is more than finding the truth about the death.
    The whole world want answers from an open RCI with broad scope of investigations. That I think BNajis can’t afford to face.
    TBH is a hero because of his resistant of MACC!
    RCI with wider scope is imminent.

  18. If you can remember the erasing of the Immigration records of Atlantuya’s entry into Malaysia and the judge subtlety avoided mentioning of this during the inquest is an indication of how Teoh Beng Huat’s inquest will be.

    To my mind the MACC is quilty as hell. The government is obviously protecting them and “you scratch my back and I scratch yours”. This is the in thing between UMNO and these Institutions which includes the Police and judiciary, other tha the MACC. That is UMNO’s trump card to prolong their survival.

The forum to determine cause of death is the inquest; the organisation to investigate whodunnit are the police; the party to accuse and institute the charge to do justice for the family of the victim and society is AGs and the forum to determine guilt with right to defend accorded to the accused are the courts. The RCI determines wider issues of interrogation methods of MACC & whether they violate human rights of those interrogated. This is the right way it ought to be.

    However people are not interested in the right way according to the system. This is because a large section of people now perceive there is a systemic breakdown: they don’t trust the impartiality and independence or fairness of MACC or police, the magistrate in an inquest, the AG or the judges in the courts. So they keep on falling back on the RCI which is (hopefully) the last bastion in their perception to garner a measure of impartiality, fairness and independence from the government perceived to be determined to perpetrate and perpetuate all wrongs and injustice.

    So it is difficult to discuss or debate what is right and wrong because with the kind of distrust and alienation with the existing institutions – from police, MACC, Public Prosecutor toi the Courts – none is acceptable!

    It is a system breakdown. When one talks what is right, it is usually based on what is right within an accepted system.

    Here the whole system has been rejected by large swathes of people. So any debate obn what is right or wrong flies out of the window. there is no more framework and or frame of reference with which to debate and argue what is right and wrong within a system because the entire system is perceived wrong and anything goes ie anything over which govt/ruling coalition has the least control will be right! :)

  21. What the aggrieved want the RCI to determine is who are the culprits who caused death. This is for justice.

    In other words they want the RCI – perceived comparatively more independent – to play multiple roles of police, AG, and Judges/Courts that no more command their confidence and trust. That is all what it is all about here.

    None of the RCI above mentioned by Raitman concerned itself with homicide. Probably none in the world too. However here people expect it to do so. Even if it has no such powers/capability to execute all the functions expected of it simulataneously; even if it is unheard of the RCI plays role of investigator, accuser and judge flouting every principle of separation of functions for check and balance.

    The system – police, inquest, AG and courts are supposed to play and specialise in separate functions for check and balance and together in combination will yield best results.

    But people here say “no” there is no more check and balance, each and all are controlled by central will of UMNO/BN and therefore the system no more works, screw it, we look for something else, anything is better to try.

    Such being the previaling sentiments, don’t even try to rationalise and analyse what is right or wrong because as I earlier said, right or wrong in conventional sense benchmarked against a familiar system is no more in vocabulary. Anything that govt cannot control is right – anything that it can, is wrong! Am I not right? :)

    It seems that Pakatan Rakyat people have lost their confidence in the judicial court (as indicated by the rejection of an inquest into Teoh’s death, over which is to be presided by a magistrate), the Police (as indicated in the questioning of the Police’s impartiality and independence or fairness in the investigation on the cause of Teoh Beng Hock’s death), and the MACC (which is the suspect to be held responsible for Teoh’s death), and the Attorney-General (who is believed to have frequently misused his official power to launch the political persecution upon the Opposition through selective prosecution).

    DAP is keen to expand the power of the approved-in-principle and to-be-set-up-soon RCI and to seek power for the RCI to make inquiry into the cause of Teoh’s death. Since Pakatan Rakyat people, including DAP leaders, have no confidence in the government institutions of the BN Federal Government, is it really useful for the Malaysian people to have the RCI looking into the inquest of Teoh’s death?

    Even if the RCI is able to find some useful, strong and convincing evidences to prove that the MACC is to be held responsible for the cause of Teoh’s death, what legal authority does the RCI have in order for the RCI to take further action to pursue the follow-up matter of prosecuting the culprit? As Lingam case had shown that the RCI would never have the power or authority within our current legal framework to invoke a prosecution, there would not be much benefit which Pakatan Rakyat could gain at the end of the RCI’s inquisition!

    If Pakatan Rakyat is to continue to struggle and fight with Barisan Nasional along a non-violence peaceable line in order to permit Pakatan Rakyat to set a goal for peacefully taking over the control of the Federal Government in the future, then Pakatan Rakyat should at least give some values to the present system which is currently operated by the Barisan Nasional Federal Government. The police are not going to truly investigate the cause of Teoh’s death but they are veering in a different direction; that is to show that Teoh is mentally unstable and suicide-prone; that he has ties with criminal elements; and that he has some differences with someone else that cause that person to kill him. Just notice all the people that the police called in. The police are trying leading questions on them and steering them into unrelated matters hoping that they can prove that the MACC did not kill Teoh.

    Firstly, I am not sure it is true that Pakatan cannot even find a trustworthy person among many officers. There may be some or many trustworthy officers but one may still distrust the civil service, bureaucracy and institutions if the ruling govt. only puts the few “untrustworthy” amongst them into key positions making decisions in favour of incumbent govt.

    Secondly even amongst the many untrustworthy, they may be so by reason of their taking the tone and example from their current political leaders, setting bad examples. So, thereotically speaking, if a change of govt brings in another set of leaders dedicated to good governance – assuming this the case – then many of the rank and file will have the incentive to embrace higher standards.

    Such a question you are asking shows that you’re still uncharacteristically ignorant or sleeping. It’s not for the Pakatan to choose who they want to be appointed on any committees. They don’t have the power to do so. There are many in the civil service and legislature who are capable for the job but as past cases goes, the government tends to appoint junior judges to take over important cases. Some examples: the sacking of Salleh Abbas and 5 senior judges, Anwar Ibrahim cases, the Perak state government grabbing case and many others. Even when there are some judges who are conscientious and brave enough to go against the government’s wish they will always find that their judgement will be overturned by the Appeal or Federal Courts.

    The hold of the government over the level of powers is so complete and total that it has always abuse the trust of the people.     I totally appalled by the fact Malaysia has turn into this state of no return.

    I voted DAP in last election and will vote for them again. The reasons are very clear as most of us complain about Umno, BN, MCA, MIC, gerakan, Najib, Badawi, Mahathir for everything they did to us. The way they treat rakyat is unbelievable!

    Why then, they are still in power if most of us know they are crooks.

    Reasons: There is no other leader that can fill the space if BN tumbled. For one, Anwar is far away from being a good and effective leader. He can’t even control his own party’s members, let alone Pakatan parties or the whole country. Look at the mess he created when he lauded for frog jumping. Although, some of his members are good sincere and doing excellent to Rakyat but most of his crews are all sitting on the fence waiting for someone to push them over. All have different personal goals. How can one allow them to govern the country. Yes, mind you it is to govern a country not party nor states.

    2. DAP is great but do you think majority of Malay goes for a Chinese leader? Try not to compare M’sia and US. There is no way to compare these countries. M’sian mindset is still way behind. If DAP wants to lead, then the party needs to have more members from different ethic background, more groups that represent different ethics. Till now, most Malays still see DAP is chinese/indian party only. DAP needs to change strategies and structures so they can change how they are being viewed.

    3. PAS on one hand is “we” as in general will not accept their leadership. They are TOO leftist or rightist (depending which way you look at). There are TOO many hidden agenda behind the party curtain. TOO many issues that general M’sia (Malay, Chinese, Indian…) will not able to accept. TOO many ideologies that will bring Malaysia to a standstill and TOO many ridiculous regulations/laws that will collapse the entire Malaysia economy.

    Well, who else that can turn M’sia around?

    We can complain all we want now but if we do not have a clear strategies how to handle the next elections, we as rakyat will continue to suffer.

    Ummm, or shall we wait for a new 4th party that will sweep all parties as in “The Romance of Three Kingdom”?

    I would strongly suggest Pakatan create a internal and external (open to public) elections to find out what rakyat wants and who will be the real, NEW suitable leader that can glue all parties together and be acceptable by all M’sian. I don’t know but maybe we can really find a great leader from the haystack.

Please do not insult his memory with this charade. If you cannot do the decent thing to find out the truth (or want to find out the truth), please do not try to spin a story for his parents and make use of them to justify your sleight of hand. It is the lowest thing you can do.

    As for Teoh’s parents, my suggestion is to snub him and refuse to see him if the RCI is not to investigate the truth of Teoh’s death. It is a waste of time. Do not give legitimacy to his manipulations. You owe this much to your son’s memory.

    The reason why they don’t want RCI to be involved in TBH death might be clear that it will tarnish the Police credibility, therefore let the police do their job to proof first.

  56. When call up by the police to give statement, it is a standard procedure that after statement was taken, officer will ask us to read thru thoroughly prior to signing. Thereafter we are free to go.

    MACC claimed they have released TBH at 345am but where was the document signed by TBH after statement taken?! If no signature mean TBH still in MACC custody and MACC is fully responsible for his safety.

    Why his hp still with MACC after ‘being released’?! MACC needed more than 10 hrs to investigate hp records?!
