Perak political crisis can be ended in 30 days – with snap state elections

UMNO leaders, particularly, the Prime Minister, Datuk Seri Abdullah Ahmad Badawi and the UMNO Youth leader, Datuk Seri Hishammuddin Hussein should co-operate with Pakatan Rakyat to keep the palace above the political crisis in Perak as the issue in contention is not about the institution of constitutional monarchy but the popular will of the voters.

Tengku Razaleigh Hamzah has rightly pointed out in his blog about the real nature of the constitutional crisis in Perak – it is not about the status of the Rulers like the 1993 constitutional crisis “which arose from an ugly confrontation between Umno and the Rulers over a question that had direct and profound implications on their sovereignty and that of the Yang Dipertuan Agong” but about the legitimacy of the process by which a new state government has been formed in Perak.

This is why Abdullah and other UMNO leaders created consternation yesterday when they sought to present the Perak political and constitutional crisis as a crisis of the system of constitutional monarchy using the language of “disrespect the Sultan” and even “treason” when it is solely and strictly about whether UMNO should be allowed to orchestrate an immoral, undemocratic, illegal and unconstitutional power grab in Perak.

The best way to uphold the system of constitutional monarchy in the country is for all political parties, whether Barisan Nasional or Pakatan Rakyat, to keep the Rulers above the political fray – especially on the question as to who should form the legitimate and democratically-elected government in Perak.

The immoral, illegal, undemocratic and unconstitutional Umno power grab in Perak has created a political and constitutional crisis of two Mentris Besar in the state – and the best and most democratic solution is to return the mandate to the voters of Perak by the dissolution of the Perak State Assembly for a fresh state election to be held to resolve the political and constitutional crisis.

In Abdullah’s final 40 days as the fifth Prime Minister and Datuk Seri Najib Razak’s pre-40 days as the sixth Prime Minister, both of them must act as leaders for all Malaysians and resist the temptation to use the powers of the Federal government to deny the people of Perak their democratic right to resolve the political crisis in the state as by resorting to emergency powers or draconian laws like the Internal Security Act or the Sedition Act.

The incendiary speech by Hishammuddin last night is most deplorable, as he delivered what has been described as a “thinly-veiled threat” against Pakatan Rakyat “that those who are willing to destroy or damage the royalty and betray the country will pay the price” – a description which will be more apt for UMNO for its role in the 1993 constitutional crisis as it has no application whatsoever with any political party in the Pakatan Rakyat in the current Perak crisis.

It is a great disservice to the institution of constitutional monarchy for political leaders to drag the royalty into the political fray by distorting political differences as one of treason or whether one is “willing to destroy or damage the royalty and betray the country”, when this is not the case.

Malaysians should be united to face the worst global economic crisis in 80 years instead of allowing our body politic to be divided and poisoned by Umno’s undemocratic, immoral, illegal and unconstitutional power grab in Perak.

Instead of months of stand-off and stalemate in the Perak political and constitutional crisis, let it be resolved swiftly in the most democratic manner which could be accepted by all Perakians without poisoning the Malaysian body politic for years and decades so that national energies could be mobilized to face the looming economic crisis – by holding a snap Perak state elections which could be held within 30 days although the law allows it to be held within 60 days of the dissolution of the Perak State Assembly.

This is the most acceptable and democratic solution to the Perak political crisis. Let Pakatan Rakyat and Barisan Nasional leaders agree to return the mandate to the voters of Perak to elect the government of their choice – which will also further enhance the institution of constitutional monarchy by staying above the fray of political parties which is best resolved in the hustings.

  1. Najib will never allow snap elections in Perak because he knows that Bn has no chance of winning enough seats to form the govt. It is the same case as India not willing to have a referendum on Kashmir because it knows that the Muslim majprity there will vote to join Pakistan.

    hold power in Perak. The only solution for PR is to send a petition to the conference of Rulers to request for the dissolution of the Perak
    Assembly. Ordinary poor people will suffer the most as this crisis
    prolong. The world economy is already so bad and yet our BN politicians never bother to think about the people welfare.

  4. Can the BN-led federal govt be allowed to interfere too much in the Perak state govt crisis?
    First, the role of fed govt leader no.2, who then happens to be the Perak state BN leader, in enticing 3 state reps to leave PR and become ‘independents’ who suddenly happen to be friendly to BN.
    Second, the role of no.2 again, of course ‘officially’ in his capacity as the Perak state BN leader, to meet HRH Sultan of Perak and ‘convincingly’ present his case that 28 BN state reps and 3 ex-PR ‘independent but BN-friendly’ state reps have the majority over the remaining 28 PR state reps, in order to form a new BN-led state govt.
    Third, the role of fed govt leader no.1 in meeting HRH Sultan of Perak to reinforce or back-up the earlier visit by his no.2.
    Fourth, when the news broke that HRH Sultan of Perak has consented to the formation of a new BN-led state govt, the fed govt no.1 told the media that the earlier planned federal govt projects in Perak can be resumed.
    Today, the NST reported that no.1 had said that snap polls and federal rule in Perak will be ruled out.
    Is the federal govt actually allowed to make such decisions and which is clearly a blatant interference in the affairs of the Perak state administration?
    If so, shouldn’t such interference by the fed govt be regarded also as a disrespect to the sovereignity of the Sultan of Perak as the head of state?
    I believe that the current stalemate should have already come to the attention and knowledge of HRH Sultan Perak, and if there is no quick workable solution in sight, hopefully HRH will consent to dissolve the state assembly and return the power of govt back to the people of Perak via the ballot box.

    The on-going political impasse in Perak has demonstrated that neither party is willing to surrender power just like that i.e. losing power following defection(s) of legislators to opposing camp/party. Therefore, even if Pakatan Rakyat manages to secure sufficient number of MPs from Barisan Nasional to defect in order to form the Federal government, UMNO and BN will not be giving up without a fight. The definition of fight here could mean to take part in legal recourse like what Pakatan Rakyat is doing through MB Nizar Jamaluddin, to call for sudden snap election like what YB Lim Kit Siang and most of the big wigs in PR are asking for in the case of Perak and of course the most dreaded path, ie to take part in physical struggle in trying to overcome the impasse. In other words, Malaysians should be prepared for all consequences brought about by politicians who are struglling to advance their respective ideologies. I believe no one in the right frame of mind would be so naive to believe that UMNO is sincere in defending the rights of the Sultan. UMNO is merely using the palace to advance themselves and its interests. Therefore, it is true indeed that all politicians say things that will only benefit themselves. They are less inclined to ensure the rakyat are well protected prior to achieving their self interests first. This is the sad truth and applies to many politicians out there. They say different things at different times, suiting their own political agendas.

Do you think they would listen to you?? Of these many suggestions, how many have actually be agreed to by them?? You can suggest until the cows come home, gone out and come home again but I believe, no one will agree to you, for obvious reasons.     It shows that the Minister does not know what he was saying, or more correctly logic does not work with his brain. He is interested that declare that the people will pay the price for mismanagement of the government, to the extent of emergency rule when it suits them. They did it in 1969 when the faired badly in the election and now they will do it belatedly as AAB is on the way out.

    There are 13 states in the country, nine headed by hereditary rulers and 4 headed by Governors appointed. The role of the Heads of state government is the same, to uphold the constitution, without fear or favour. The governors are selected by the government which considers the candidate capable of performing the duties expected of the position as Head of the states concerned. The hereditary rulers are entitled to the position and are expected to perform as well as appointed governors on pedigree consideration. As all states have equal status so are the power of the heads of the constituent states of Malaysia. As constitutional rulers, the official decision of the Rulers who are born or appointed to the position as head of the constituent states should be in accordance to the constitution. A request for court decision does not damage the royalty, and the country is not sold because of court action. In a similar situation that happened in 1966 when the Chief Minister of Sarawak Stephen Kalong Ningkam was dismissed by the Governor of Sarawak the federal government and the people including the UMNO Youth accepted the verdict of the court civilly. Tunku was the PM then. That implies of course that the quality of the PM we have has sunk to all time low, and certainly, the quality of UMNO Youth Chief can at best equate those of ruffians.

  22. In every node and corner, Umno has its man planted there to ‘safeguard’ its position and members whether it involves graft, threats and other ‘dirty tricks’. So soon, the MACC has shown its hand that it’s nothing more than the usual crap reform promised by them.

    By now we should know that those who seek true justice and reform are walking on thin ice. A party in its death throes will resort to any underhand tactics to stay afloat. The other component parties in BN are muted, Umno is the one pulling the trigger and it may well go its own way eventually to continue its hegemony.

  41. People are quick to pour sympathy and praise Eli Wong for the “work” she has done on environment. Well, may I know what she has done? I remember I wrote this piece on May 17, 2008 when she became the Selangor Exco and I leave it to you to judge.

    The hot and dry season is again in our midst. I can’t help but notice that the sky is getting hazier and my breathing a little more difficult. But what irks me most was the press conference interview given by Elizabeth Wong, the Selangor State Exco for Environment that I read this morning. According to her and as reported in the Star: “The illegal immigrants are the major culprits who carry out open burning in Johan Setia, Klang, causing the air in the area to deteriorate. About 200 of them living in the area have been doing open burning for agricultural purposes on the 350 acre forest area. The authorities including enforcement officers from the immigrations and the Department of Environment (DOE) have been trying to catch the culprits but all efforts seem to be in vain. We will organise a joint effort together with the Immigration Department, police, the DOE, Rela, Klang Municipal Council and Fire Department to catch them. But we will not tell when it will take place.”

    This is a real baloney, Elizabeth Wong. How can this happen – illegal immigrants burning state forest for agriculture purposes and the authorities have problems apprehending them? Either the illegal immigrants are super humans who can disappear into thin air each time enforcement officers come a calling or you are just a gullible fool listening to cock and bull stories.

    State forests are being burnt openly for agriculture and in some instances the lands even sold by syndicates to landless farmers. We have litany of enforcement agencies – Immigration Department, Police, Department of Environment, Rela, Municipal Council, and Fire Department – but they all seem so helpless.     Look, we are not here talking about house break-in or petty theft where the culprits can be anywhere. It is really beyond me to comprehend how the state forests could be burnt by illegal immigrants for agriculture purposes and yet there is nothing much that the authorities can do about it. It is agriculture, remember? There must be some form of semi-permanent settlement. The land must be tilled and crops planted. May I know who come to attend the crops; who come to harvest the crops? The authorities have problems catching them and the State Exco believes that? I think we need a smarter Exco. For a while I thought Pakatan Rakyat is going to make a difference. The more I follow the events unfolding, the more the problem stays the same. I am sorry, this is not personal. I don’t know who is this Elizabeth Wong, never met her and never heard of her before March 8, 2008.

  44. Below is the reason why V. Sivakumar suspended the Perak Mentri Besar Datuk Dr Zambry Abd Kadir and his six executive council members from assembly sittings:

    Sivakumar noted that under the state constitution there was no provision stating that any party suddenly claiming to have the majority could or must see the Sultan of Perak to ask to form the next government.

    He said Article 16(6) of the state constitution stated that the mentri besar of the day could seek an audience with the Sultan of Perak to dissolve the assembly if he ceased to command the confidence of the majority.

    “The Clause clearly refers to the mentri besar at the time which was Datuk Seri Mohammad Nizar Ja­maluddin. No one else but the mentri besar has the right to seek an audience with the Sultan,” he said.

    “After meeting the seven assemblymen, it was clear that they had committed wrong under the state constitution. Therefore, I had no other choice. I had to follow the rules,” he said.

  45. The Perak Sultan made his decision on the change of government in Perak. UMNO leaders AAB, Hishamuddin, Muhyuddin, Rafudah Aziz, Ali Rustam, Syed Hamid , just to name a few, claimed that the wishes of the Sultan are the command of the people, and in their words, it was disrespect, disloyal, and treason for not accepting what the Sultan has commanded.

    The MACC has now been turned into Malaysian Agency for Cars and Cows which was quick to act on the wishes of UMNO leaders in detriment to the interest of the nation. The ACA in the past had found 18 sharks but they are still swimming freely in Bolehland.
    The Sultan of Perak has no doubt been aware of public perception about UMNO leaders. The Minister of Education asked the people to rise up against any opinion which differs from that of the Sultan. So the issue of right or wrong should be settled by the prestige and position of the person expressing such opinion, rather than on the truth of the issue concerned. If the students follow the thought process of the Education Minister, they will clearly be misfit. So Hishamuddin is not fit to be Minister at all, and the Sultan would do the nation a favour in asking him to quit politics. From the ways Hishamuddin has expressed his loyalty to the Sultan of Perak he would leave politics if he is asked by the Sultan of Perak to do so.

    Hamid is clearly unfit to be Minister of Home Affairs when he used ISA to provide personal protection for a lady reporter. He did not know his duties, and is not fit to be a minister. He claimed that it would be disloyal to the King for not following the wishes of the Sultan. The only way he would leave would be if he is asked by the Sultan of Perak to do so.

    The Sultan of Perak would have taken note that many among UMNO ministers are unusually rich compared to what the salary and wages they received in their official capacity. MACC are now concerns with cars and cows, and in any case would not act against BN ministers. The corruption in the government is acknowledged by all government leaders. They know very well that they needed only to pay lip services to prove that they were above board. They will leave politics if the Sultan of Perak would command them to.

    The Sultan of Perak has now received confirmation that his words are the command of UMNO leaders, who urged others to accept without question. The population will not be able to vote corrupted UMNO leaders out of their party positions, or government posts. With those unfits in politics and government, the country is doomed. The Sultan of Perak has now the unique opportunity to clear the unwanted politicians by his command. His Majesty needs only to tell those UMNO opportunists to leave, and they would do so willingly without showing disrespect or defiance, out of their loyalty to the Sultan. .The question for the Sultan is not whether he could save the country from those rotten UMNO opportunitsts, but rather whether he was willing to do so. His majesty’s words are UMNO leaders’ command.

    The people have accepted the fate that the system constitutional monarch adopted by the country renders the fate of the people at the mercy of UMNO leaders. They are pleasantly surprised that the country can be saved according to the wishes of the Sultan of Perak, if only he believes a shared destiny for the people of all races. The people are waiting for the Sultan to act. Just like he acted in Perak, we believe he could do the right thing for the country without fear or favour of a small group of people. He has the wellness of the country in his heart.

    Don’t be misled by the polite language used when it comes to matters of the Palace. It is the same thing. Even if it is not why consult the sultan on a personal issue like that? We ask the sultan to give due respect to the institution that he represent and has come to symbolise and has taken UMNO to task for failing to show the respect the institution deserves and now we are doing exactly the same thing!

    This woman should think about her party first and resign. If she had done this earlier, PKR and PR would not today be in the eye of the political storm. PR is not in the position to take such shots at its fragile political coalition. It is fragile, not because Karpal shows it so but it is so because Karpal makes it so.

  47. There is a big difference between the problem she is responsible for and has put her party into, and the one involving the Selangor MB. The former is about the poor lack of judgment which has put the integrity of her party and party leadership into dire straits. The latter concerns a legal matter. It involves a legal issue and the courts would be the place to go to in order to resolve it. The MB can go about his duties as MB without being distracted in the way this assemblywoman could not hope to do.

    Of course the entire thing is politically motivated but the fact that it is so does not mean she should not resign. Resign and spare the party leadership from continued embarassment. Her problem with the media is a serious distraction to her and the party leadership.

    I call on the PKR-PR party and coalition leadership to extract immediate resignation from her, and be done with and sends the clear message to its members that if they intend to vie for party positions in government they better come clean with both their public and their private lives.

Why you want to use this dirty tactic while you know very well that the mentality of people at this age have been very much matured and well informed and therefore they will not believe in all BN butshit any more.

    If you BN believe in the result of the survey. You know very well Perak people have lost trust in total in BN. survey say majority want to go to fresh election and and decide once and for all yet you BN fellow coward out and hide behind power shield and Now begging for the People Trust.

    Do you really believe this is the way of politic in Malaysia? You BN has total lost your heads and mind.

    The more dirty tactic BN use the more repel the people will be. Don;t you know that you BN are digging your own political grave?

    Why don’t you BN make the necessary changes and equip your self and fight gentlemanly with PR?

    The trust from the people can only be won by real action and fair action that was needed.

    Well Mr. limkamput…. i am not sure exactly what point you are trying to point out here.

    But just to share a story i heard from someone who actually operates a farm in the vicinity.

    Yes, is is very hard to catch these illegal immigrants. The owners who employ these illegal immigrants have contacts within the authorities who inform then beforehand when raids are going to occur.

    The illegals are then told to basically go hide as deep as they can in the jungle. They are given nothing except the clothes on their back and maybe some supplies.

    They live like animals with no roof no nothing. The person who related the story to me comments that’s it was impossible for him to imagine how these illegals survive. Maybe some actually don’t.

    When the coast is clear, the illegals come out from the jungles again and continue life again as normal.Even if some are caught, they are easily replaced with new illegals and so it goes on. The illegals cannot be linked to the employers so nothing happens to the employers.

    Hearing these, do you think you could do better than Elizabeth Wong? Tell me what you would have done if you had been in charge?

    To restore the reputation of the EC and to ensure fair, free, and clean by-elections in April, I urge the opposition leaders to appeal to Yang di-Pertuan Agong, or at least to debate in the upcoming parliament meetings, on the following agenda:

    1. To allow postal votes for all voters who find difficulty of returning to their hometowns to vote on April 7;
    2. To challenge the refusal of the EC to vacant the state seats of Changkat Jering, Behrang, and Jelapang for the by-elections;
    3. To update the electoral roll to provide the opportunities to the qualified ones to participate in the by-elections;
    4. To expand the postal votes to the qualified Malaysian voters who work overseas however not fall into the categories of armed forces, Police Field Force, election officials on duty, government officers serving overseas, students studying overseas, and spouses.
    5. To order Abdul Aziz to step down from his position should he fail to explain how the decision regarding both nomination and polling days was taken with consideration of the interest of ALL parties involved.
