Police – back off, be neutral and stop being catspaw to Umno leaders

Why was DAP Selangor State Executive councillor, Ronnie Liu arrested in so rough and high-handed a manner just before the Selangor State Exco meeting yesterday at the Selangor State Secretariat in Shah Alam?

One would have thought that Ronnie had become a dangerous criminal or had been guilty of some capital crime from the police operation, refusing to allow Ronnie to attend the Selangor State Exco meeting although he promised to surrender himself at the Puchong police station later.

In the event, Ronnie was in the Puchong police station for about 15 minutes when his brother came to post RM2,000 bail – to be charged at the Petaling Jaya magistrate’s court on Monday.

What was Ronnie’s crime? For allegedly obstructing a Subang Jaya Municipal Council (MPSJ) officer from carrying out his duty. When? Nov. 2 last year.

Is this the latest case of malicious prosecution?

Without going into the merits or demerits of the charge, one is entitled to ask why the police took more than a year to decide whether to arrest and charge Ronnie or not on such a simple and straightforward matter?

Is the police action against Ronnie related to the campaign of the former Selangor Mentri Besar Dr. Mohd Khir Toyo for Umno Youth chief election?

This is a very normal question that is being asked.

Was this Umno-linkage another reason why the DAP Selangor Senior State Exco and MP for Seputeh, Teresa Kok, fell victim to a Internal Security Act (ISA) “sting” operation resulting in her being detained for seven days in September?

The Police should back off, be neutral and stop being catspaw to Umno leaders in their high-stake pursuit for power, positionn and money in the current Umno party elections.

Or was Ronnie’s arrest yesterday a reprisal by the Selangor Police Officer for the avalanche of public criticisms for his high-handed arrest of peaceful participants (including three DAP elected representatives, Tony Pua (MP – PJ Utara), Lau Weng San (ADUN – Kampong Tunku) and Ronnie) at Sunday’s candlelight vigil for justice, freedom, democracy as well as for free, fair and clean general election?

Public respect for the police have fallen to a new low with the high-handed arrest of Ronnie yesterday as the instant reaction in Selangor and the country is how ordinary Malaysians can expect respect and fair play from the police when even a state exco member could be treated in so rough and high-handed a manner?

  1. It’s sickening and disrespectful of what the ‘men-in-blue’ uniforms could do to a Selangor state executive councillor in the person of YB Ronnie Liu. The police never showed whatever due respect and decorum to a state cabinet minister who can be their political master. The case concerning the YB is a small and trifle matter and it happened more than a year ago. Is the unwarranted and high-handed action of the police politically motivated? If there is a poll on this case, the so-called law- enforcers will get ‘zero’ marks and scorn for their biased and shameful action!

Just look, how “efficient” they are when bullying and catching innocent people. It is really amazing on their timing of the arrest of our rep Ronnie.
    Their acts are not only shameful, disgraceful but downright stupid.

  6. The police force is accountable to the RAKYAT first, the RAKYAT second, the RAKYAT third, and the RAKYAT last.

    It is the duty of the police to protect and defend the RAKYAT from any kind of criminal or dangerous activities happening in our society.

    But they have to make a very clear-cut differentiation between real criminals and ordinary citizens who are voicing their rights and assembling in public to show their displeasure on matters concerning them, and extend protection to them under such circumstances and not turning them into victims of convenience.

    If the heads of a police department cannot differentiate between criminals from harmless ordinary citizens, he/she should not be in that position in the first place, and had to be removed immediately.

    The police must always remember that they are not there to show their “power” and “arrogance”. The rakyat’s interest and safety should be their prime concern and consideration. That’s the reason they are hired.

    The police must not work on the premise that it is their duty to protect only those in higher government offices. That is gross injustice to the rakyat. At no time must the police be subservient to any political party or leaders and have to stay non-partisan at all times. If the political party leaders so desire protection, they should hire their own bodyguards. The police cannot and must not be used for that purpose. It should be construed as an abuse or misuse if they are used for private and personal purposes.

    It is different if a citizen ( just anybody ) is given police protection in cases where the he/she is facing intimidation and threats which are criminal or civil in nature, and they are duty bound to do so.

    The police force have to earn the rakyat’s respect and approval through their performance and adherence to strict codes of conduct and discipline in discharging their duties with integrity and impartiality, and in the most transparent manner without fear or favour.

    They have to be accountable and not fall for corrupt practices at all times. They must uphold the principle of independence and non-partisanship, and not be influenced by any party. Until and unless such standards are displayed and upheld fully, the police cannot expect to be respected and approved by the rakyat.

  9. Mahathir is right that Malaysia is now a police state. No thanks to a very subservient and willing senior police officers who think that their pay comes from Umno. I used to think there may still be good officers in the department but I’m not sure any more. They are now rotten to the core.

  11. Come on, afterburner73. You are just being illogical, slanted and unrealistic with your biased views. It’s not that YB Ronnie Liu is above the law. It’s the police that acted unprofessionally and arrogantly towards the Selangor state ex-co member just because he is from the DAP. It was so clear that the warrant of arrest was unnecessary as YB is an elected assemblyman. No way he would run away. In fact he didn’t even put up any resistance of arrest at that point in time. He has been with the people all the time seeing to their needs and grouses. The police didn’t accord him due respect as a law-maker. If he were a BN ex-co member, I suppose it would be otherwise!

    Wake up, the Selangor CPO and his ‘men-in-blue’ uniforms. You are serving your duties in a state governed and controlled by Pakatan Rakyat (PR). They are the government of the day. The PR rules the state. BN is in the opposition. This is a stark reality! They cannot be in a state of denial!

    The police are government servants and they should be apolitical in discharging their duties. YB Ronnie Liu is a Selangor state executive councillor and as such a state cabinet minister. At protocol in the state, he is ranked higher than the state CPO. So the least the ‘men-in-blue’ uniforms should do is to accord him due respect and position when they want to record a statement from him.

    The latest news is that YB Ronnie Liu has sought a court order in the Shah Alam High Court through his lawyers that his warrant of arrest by the police is improper.

    For too long, the police have acted in ways that causes hardship
    to innocent citizens. And they get away? How many more of these oppresive action have to be carried out before it is address, if it ever will?

    Its cheap excuses for ‘them’ to say they are just carrying orders.
    No police ever being reprimanded or put to jail or stand trial for disturbing the peace of the rakyat. Someone has to pay for all these trouble and its always the rakyat, even though the police are the ones that spark all this troubles?

    If it is shown that Ronnie defended a brothel during an enforcement raid, than there is purported proof that he is involved in vice
    activities or on the take to protect the vice racket.

    The allegation that he is involved in vice activities will provide the fair comment and public or civic justification against the libel suit he filed against those who made the allegation.

    That is why, action is suddenly taken, a year after the raid.

    If, as is said by the police officer in charge, that they need such a long time to investigate and build a case against Ronnie before acting, then something is certainly not every right with our police force.

    A month, let alone a year, to conduct and conclude such an investigation is already too month. This shows how efficient our police force is.

  15. The police only capable in arresting and bully the ordinary citizens, not the bads who robbed or killed someone in this country.
    Last time when my sister was robbed in Klang, guess what the police said when we reach the police station to lodge a report.
    “AH, KAMU ORANG YANG KE_SEBELAS DIROMPAK PAGI INI DI KAWASAN ITU. SILA BERATUR DULU”
    That make us feels bad. “So dangerous mer?” The worst thing is that we realise one of the robber did touch on my sis car with his bare hand when their motorcycle about to lost control, we inform the police for finger print test. Please see the conversation below but i’m not allowed to record it that time:-

    Sis: Bang, tadi kita nampak penyamun tu tersentuh kereta kita sebab lost control. Boleh tak bang tolong check cap jari?
    Police: Oh, boleh rasanya. Mana kereta? Dekat luar ye?
    Sis: Erm, dekat rumah la.. Adik hantar saya datang ni..
    Police: Erm.. Rasanya sukar nak check cap jari juga la, sebab orang indonesia selalunya yang rompak. Susah nak check la..

    Because we do not want to create trouble, we just leave it without expecting much the police will help. In fact, we do police report also BECAUSE WE WANT TO APPLY FOR NEW IC cause old one lost to the robber already.

    They feel like this is normal to them in this high crime area, but do they know that we live in fear everynight whenever we heard some sound on the rooftop? Why you know the area is targeted by robber yet no initiative taken to take care of our fellow citizen.

    I believe i’m not the only person experince this before. It is nothing to complaint about as we being robbed is not thier fault. However, as a police who do not feel the seriousness on it. IT IS A BIG BIG PROBLEM.

    Imagine a normal citizen like us who do not have fame nor much money in this country. Seems like the police can do whatever things to us like what happen to YB Ronnie, who will help us or who will bring us as a ‘small potato’ to REAL JUSTICE?

  21. For them, criminals also include opposition leaders. They have a list of opposition leaders to be arrested and it is so easy to arrest them because they don’t resist much.
    At the end of the year, they will prepare a report saying they have solved many crimes (of course, most of it for arresting opposition leaders) to whitewash their shortcomings.

    So is placing your hand on the arm or shoulder sufficient to signify arrest. The timing of the arrest is important usually because of the need to read his Miranda rights. We do not have the equivalent of the Miranda rights to read or to observe.

  26. when I look at the policemen I feel bad, I just think of them as corrupt and playing favourtism. The lower ranks do not have much choice but those higher are not being neutral. They are more like PBNM and by right they should be like our majesty DYMM, neutral and do what is best for the country and the people. Instead we can see very clearly how the police are closing one eye in some case.

  28. We never see the Police do this to BN politicians. For BN politicians they are requested to turn up at the Police station at a time of their convenience. They have not been arrested in front of the Public.

    Our Police is never impartial in whatever they do. For BN esp UMNO members they are accorded the best manners. If this is not double standard, we don’t what is. All they want is to shame the Opposition.

    The crime in the country is getting worse. Yet we do not see them arresting the suspects. They are good at harrasing the innocent and asking for settlement on the spot. When will they get the respect from the Joe Public?

  29. It is common enough the general perception based on 3 decades of public experience that police in general are beholdened to the ruling party/government : police are acountable to federal rather than state government.

    Whilst not disputing or addressing the merits/demerits of above general perception, the question is whether you can defend publicly the reasonableness of your charge that Selangor police is a “catspaw” to UMNO leaders at this crucial time when they are vying for power in UMNO party elections – in the specific instance of the arrest of Ronnie Liu for allegedly obstructing Subang Jaya Municipal Council’s (MPSJ) enforcement unit/police from conducting a raid on a massage palour, on Nov 2 last year.

    [The expression “catspaw” is a reference to a person used by another as a dupe or tool.]

    Ronnie’s arrest is a culmination of 3 processes taking place:

    1. Subang Jaya Municipal Council’s (MPSJ)’s lodging a police report and being prepared to stick to it to testify against Ronie;
    2. Police’s Investigation and submission of its report to the Public Prosecutor’s Office; and
    3. Public Prosecutor’s decision to prosecute or not prosecute the case.

    The immediate arrest is Public Prosecutor’s decision – one year later – to prosecute the charge and as a result of that police has to arrest Ronnie.

    So is the police a ‘catspaw’ to UMNO leaders when its action is precipitated by Public Prosecutor ‘s exercise of its prosecutorial discretion to now prosecute? Shouldn’t the catspaw allegation be directed to the Public Prosecutor’s office instead?

    At the same time, it may be asked would the Public Prosecutor have the will to prosecute unless it is reasonably confident that its office can prove the case? And for it to prove the case, there must be no change in stance or complaint – and there must be full cooperation extended – by the complainant, the Subang Jaya Municipal Council (MPSJ)’s officers as witnesses in the trial to come that they were obstructed in their duties by Ronnie?

    Which raises the question, isn’t MPSJ, a local authority, under the control and jurisdiction of the Pakatan Rakyat (“PR”) controlled Selangor State Government led by the PR controlled State Council?

    Wouldn’t you agree that it is quite anomalous for a Selangor State Councillor like Ronnie to face prosecution arising from a complaint by MPSJ which itself is controlled by PR controlled State Council but blaming the police from being catspaw to UMNO leaders???

    Is the PR state governmment in Selangor wielding its powers properly?

    I am sure PR Selangor govt can find some rule, bylaw and regulations to carve/demarcate out areas as “safe havens” for various vigils and sit ins in support for ISA abolishment where it would not be so easy – without legal complications – for police to intercede, disrupt and arrest on grounds of unlawful assembly.

    Has anything been done to explore this option?

  30. For prosecution to proceed there can only be 2 positions :

    1. there is basis and substance in Subang Jaya Municipal Council’s (MPSJ)’s allegations/complaint against Ronnie Liu; or

    2. there is no basis.

    If it were 2., why is it that PR state govt, controlling MPSJ, could not make it retract the compliant/report or refuse to testify along lines earlier complained in Nov 2? How could Prosecution proceed?

    If it were 1., then there is nothing to say, both police and Police Prosecutor would have to take its course since the law must take its course and favour no one, a state councillor included – which has all along been what the Paktan Rakyat advocated.

  31. Why does it take so long to lodge a police report and then make an arrest? 1 week is already too long, needless to say 1 year. Even if the police do not like Ronnie Liu, they should still respect him as a State Councillor. Where have all their manners went? Pity their mothers that have tried so hard to teach them to be respectful.

One of the thing that you notice that is different about police now and 10-20 years ago is the police top officers, instead of just taking orders from their political master, have their own opinion of politics and reflecting even expressing it in their work. Instead of just opportunistic in their work, they are now pushing the limits, taking initiative of what is acceptable following their political masters lead.

    They are in fact intepreting what is their duties rather than following the interpretation of their political masters. This is the NEP/Ketuanan Melayu insidious virus…

  34. If Malaysian police is not good enough, why didn’t DAP urge a particular community they represented to join the police force? If they really love and sincere to serve the country, go for the lower ranks and not just eyeing for the top positions. Why complaint, if they are not ready to sacrifice?

How could members of a particular community join the police force when they feel that in spite of working hard and smart they will not be recognised and promoted? Case in point is the strong lobby against Mdm. Low Siew Moi as the Acting GM of PKNS.

  38. ryan123, if they know what is “JUST AND FAIR”, we will not be what we are today. Remember these words were “enshrined” in our Rukunegara which was supposed to have been implemented for 38 years? But have they done the least bit to realized its objectives? They have not even achieved what was written in four words in this holy piece of paper – “membina masyarakat yang ADIL”. So in fact, the Rukunegara is nothing but a tattered piece of paper meant for wiping asses and thrown into the toilet bowl.

    And today, they are so afraid the younger generation might question them with these words that they have mutilated the Rukunegara. Take any school exercise book of school children today and read the Rukunegara printed at the back. You will find the preamble missing and they only print the five principles! This is in a way cheating our younger generation. I don’t know how many people have noticed this, but I did!
