Teresa now being released

At 12.56 pm, at lunch in Ipoh, my mobile phone rang. I saw the caller was “Teresa” and wondered who was using her phone.

But it was her on the line and wondered how she wangled the use of her phone while in detention.

But no, she did no such improper thing. She told me that she was being released.

Bravo. The irresistible pressures against her unjust and undemocratic detention had succeeded.

While in celebratory and jubilant mood, we must also be mindful that the recent spate of ISA arrests demonstrate that this iniquitous law must go.

Sin Chew reporter Tan Hoon Cheng’s 18-hour ISA detention and Teresa’s 6-day detention are testimony.

Now, only RPK is still in detention from the recent spate of ISA arrests. He should be released immediately too.

The Hindraf Five and all other ISA detainees should also be given back their personal liberties and released from Kamunting Detention Centre.

  8. Teresa… when I read about how you had to stay in an 8′ by 8′ cell, I shuddered. I can’t imagine how I would take being forcefully separated from my family. I would die thinking of my kids missing me and not being able to see me.

    My heart is filled with joy for you.

  11. Releasing RPK would be more difficult. RPK has many more enemies compared to Teresa, so the investigations into who is threatening RPK’s safety will have to go on much much longer.

    My bisnes partner Kasim Amat is trying very hard to help into the police investigations on those who are known to be RPK’s enemies. That’s why he has no time to write to us.

    What has the regime achieved from the ISA detention of Tan and Teresa? Domestic and international condemnation. Anger and disgust of the rakyat. A Minister has resigned. Their allies MCA and Gerakan have been weakened, if not castrated. Political instability, investors flight and stock market down.

    What have they gained? A big fat zero!

    Lost a lot. Gained nothing. Is this how they run the govt?

  18. Getting RPK’s release will be more difficult than Teresa. The reason is not that he has more enemies but he has less public sympathy. He’s a man for a start (women victims always gets more sympathy). But essentially, he went and twist the Lion’s tail knowing what he was doing. He was warned but twisted it some more. In contrast, Teresa did nothing to invite harsh measure.

    I’m not saying RPK deserves it. Nobody deserves ISA no matter what he has done. But we should not delude ourselves that we live in a real democracy where peaceful dissent is tolerated. If we are brave enough to do it, we should be brave enough to take the consequences.

    I knew that Teresa would be released soon as the political cost of holding her is just too high. As for RPK we should keep on the pressure. As I see it, the earliest hope for his release may be the expiration of the 60 days detention period, and that is only a hope.

  20. Released after 6 days!!! That means 5 days, 23 hours and 59 minutes too late. They should not have wasted more than a minute to dismiss the need to arrest and detain teresa. It was that obvious.

    Now that she is again back in contact with fresh air and I say: “Have some rest and decent home food. Welcome back. You know who is behind you all these while.”

  22. Theresa’s harbeus corpus hearing is to be held on 23-Sep-2008 (next tuesday) and they release her before that.

    They know they have no legal grounds to hold her and the court would have have ruled in Theresa’s favour anyway.

    In order for the Home Minister not to look too stupid, they better release her.

    However, no matter what the Botak Clown Minister do or say, he will infamously look stupid in the eyes on Malaysian Public for perpetuity.

  26. AAB had to wait for the UMNO MT meeting to be over before he even dared to agree to doing the right thing. AAB has no political courage at all, and he might as well leave before 9 October 2008 when UMNO Divisional meetings begin.

    It was reported that at the UMNO MT meeting yesterday five MT members, including Muhyiddin and Rafidah Aziz urged AAB to reconsider himself, meaning that he should step down early, before 2010; some suggested before 9 October 2008. It was only after Najib intervened to say that he would have detailed discussion with AAB that the urging process stopped. It is most amusing that the direct beneficiary is Najib who, once taking over the position, would be the new emperor. Why did others show their exceptional keen interest to have Najib ascend the throne, and offended AAB for no direct benefit in return? It is not as though Najib would appoint Rafidah to the Cabinet, since she too has stated her own transition plan, and might have to follow the out-going presidents lead for an earlier exit.

    Muhyiddin certainly hoped that Najib might reward him with the position of deputy, if the latter was willing to forgo the transfer of the position of the deputy to within his family. Muhyiddin is betting that he would be the deputy come December, either to Ku Li, or to Najib. He is more certain of the position if Ku Li ascends the throne, rather than Najib who had an obligation that charity begins within the extended family. That could be the reason why Muhyiddin had arranged for TDM to apply for entry into UMNO.

    TDM had never said that he had changed his mind in conditioning his reentry to AAB’s removal as President. In showing his preference to TDM, Muhyiddin implies that AAB should go. The urging that AAB leave soon has to be timed so that TDM is seen not to retract his statement, so that he can hold his head high as in-coming Chairman of a presidential council for UMNO. That might allow Ku Li a chance of getting enough nomination to stand. However if Anwar was able to show that he had the support of the majority of the House, and that AAB made a slip in dissolving the parliament, then the next general election would be held before December party election. Under the circumstance, would a outgoing president or the sitting deputy president get to decide the next BN election? It is unlikely, so it would be a collective leadership under Chairman TDM. If TDM wins, now that ISA machinery is running smooth with the recent practices, he can be the next PM. He will then appoint his successor. Who do you think he will be Najib, Ku Li, Khairy, Muhyiddin or Mukriz Mahathir?

    When that comes through AAB will have to weep in silence. He would regret for making the greatest mistake in life, forever.

    Anwar has not caused AAB his position as PM. They are the members of his own party starting with all the heroes competing to be saviour of the race and religion, and who wantonly showed that they wanted to bully the other communities, just to act sombong. There are others who even before the March election has created the foundation for UMNO to defect from UMNO, urging them to vote for the persons, rather than the party they were able to call for AAB’s removal. The UMNO policy at government malfeasance would have the same outcome no matter who sits as head of the party.

    Anwar has not contemptuously asked AAB you to leave the position, like the members of MT. He sent AAB a letter asking for his agreement to meet. Anwar now follows up asking for him to convene parliament. In open meeting AAB might not have the choice to resign so that the government could change hand smoothly. So, while AAB still has time, until the UMNO Divisional meeting bringing him news that he was not nominated as president, he can still demonstrate that he is a gentleman doing the honorable act as a statesman to leave the position when he ought to step down. He should meet Anwar.

    RPK should not be released because his interment was due to the disparaging of religion. Even now, under an article entitled “Spitting in the wind”, RPK has again displayed sheer ignorance of the faith he claims to profess. Approx 70% of the info he attempted to give to the readers was wholly incorrect and without basis. I believe calling RPK a “deviant or a blasphemous Muslim of the worst kind” (as was done by syed) rises from the fact that he is very unlearned and ignorant about Islam and therefore he makes statements that are construed to be blasphemous but perhaps without intent for them to be so.

    RPK is an example of an individual who seeks infamy through wrong means. He may hold deviant beliefs and espouse blasphemy, but he is not of the worst kind because he has no real grasp of Islamic history or indeed Islamic creed and principles of jurisprudence. Therefore his excuse of ignorance should hold water. We should note that his statements may be hasty and ill-advised but this excuse pardons him from being a blasphemous Muslim of the “worst kind”.

  55. The ISA is a draconian instrument that curtails and violates all fundamantal rights. Necessarily its use – if such legislation were not repealed – should be sparing and only under the most convincing circumstances of credible proof that the persons detained are justifiably detained.

    The ISA detentions of Reporter Tan Hoon Cheng and MP Theresa Kok show an almost cavalier attitude on the part of those who invoke ISA to the need for credible proof.

    Theresa was detained for 6 days, reporter Tan, after detention of 16 hours, in each case, police explained that there was no reason to detain the further. Was there a reason to detain them in the first place? Upon release Tan told reporters ‘I still don’t know why I was detained under ISA,’ raising questions whether the police knew so or merely just took the line to arrest first at the first complaint by certain groups and investigate later rather than investigate first, and if there were credible evidence and reasonble suspicion of threat, arrest thereafter.

    This is one of Datuk Zaid’s complaint of how authorities misuse the ISA by putting cart before the horse and using it as an instrument for investigation!

    Is this misconceived way of invoking the draconian ISA due to police operating outside oversight of the Home Minister or the Home Minister does not understand how ISA is supposed to work or both ?

    One thing is certain is that the ISA is not intended, as Home Minister alleged, to extend protection to the detainees from attacks of those rightly coming under the fit and proper category of within contemplation of the ISA but who nevertheless not detained in travesty of justice.

    Does it make sense to seek the release of all 65 detainees while at the same time condoning or rather supporting the use of ISA on “armed terrorists and those out to topple the government by force” – the very charges faced by the Hindraf 5 and those supposedly linked to the JI movement.
    As long as the ISA is in the statues it will be open to abuse. The government can classify anyone a “terrorist” if it wants to, as conveniently as Anwar is made a sodomite and as conveniently as the Hindraf 5 are linked to the Tamil Tigers and as conveniently as Teresa Kok is made national threat.

He should now have the final version. If the whole affair of detaining Teresa, and releasing her were entirely decided by Police, an episode that had brought shame to the country, the Minister Syed Hamid should demand a report on how the fiasco was initiated in the police, and who was responsible.

    The press statement of YB Teresa indicates that the Police had failed to perform their basic duty to verify whether the allegations based on newspaper writings were facts. From the questions asked of Teresa Kok, even if the accusations were true, Teresa Kok could not be charged for endangering national security. In detaining Teresa, the police had only created tension in the society in demonstrating that Police no longer act within the rule of its role.

    It is ironical that the ministry which is charged of maintaining national security against violence should be the one which created the impression of national insecurity to the citizens and investors abroad. Japanese officials would have resigned. We don’t expect our people to be sensitive to their image. But they should apologize for the fiasco.

    This has demonstrated a major flaw in the ISA. Next, all parties should focus on freeing RPK, Hindraf 5 and other detainees under the ISA. There is no clear protocol in using the act. Accountability is zero. A judiciary reform is therfore vital.

    Who should be held responsible for the detention fiasco? Answer is no one. Imagine the following scenario:

    Hypothesis arises where a weak ISA case is to be built. PM passing the ball to home minister. Home minister says leave it freely to IGP or acting IGP. IGP says since this is ISA, it is not required to consult attorney general and push it to the investigating officer. The investivating officer with the unique intelligence gathering capability, reports back to superior and recommends to make an arrest. There goes the start of an operation. PM says he does not interfere, home minister says he leave it to head of police while attorney general is not involved. Head of police leaves it to the investigating officer and no one will eventually be held responsible. The police has too much power with the ISA.

    1. From the ministry governance point of view: As the police reports to the home minister, has the home minister received and checked the report from the police before the arrest? To date, what we have been hearing is that he leaves it freely to the police to investigate.
    2. From the law enforcement point of view: Has the head of police verified the evidence before substantiating the charges against the detainee?

    I am not saying the whole police force is corrupted. The police has been doing a great job fighting crimes. Their records have been outstanding. Nevertheless, the arrests made under the recent high-profile case, the force has demonstrated the unprofessional and substandard manner, in the way it has handled the situation which is the opposite of “BERSIH, CEKAP dan AMANAH”.

    To uphold the dignity of this slogan and the force, the head on top owes the public a kind explanation.

    The parliament should later have a debate on this issue to protect our liberty stated in the constitution. To get to the bottom, may we know:

    1. How many detainees currently being held under ISA, without having the chance for fair trial?
    2. The longest duration the current detainee is being held. How long?
    3. Has there be medical attention provided when required?
    4. How often their family members get to pay them visit a year?

    They have been denied the rights to be reunited with family and love ones. With absolute power, abuse is imminent. So is absolute freedom I admit, disorder can prevail.

The recent fast released of reporter Tan and YB Terresa were due to the unanimous voice of the rakyat, a voice so loud that even had caught the international attention, and had shaken within BN itself. How about those innocent lives whom are still in the ISA detention. Many had been hauled up in the 6′ by 8′ detention cell for many many years. They had been torn down & silenced.   145. Why should Teresa take a lie detector test? I’m surprised he didn’t ask her to swear by the bible since rule of law means nothing in this country nowadays thanks to our PM showing us the way. Who is the guilty party here? The mosque has denied it and now she has to take a lie detector test cos Utusan thinks that is the best way to prove her innocent. Lets not forget that the police has released her. Utusan seems to have better intelligence and investigation skills then the police. Utusan more often than not is the culprit that stirs racial discord and does it without fear of punishment cos they are protected by UMNO and the police closes one eye to Utusan. There just seems to be double standard in terms of law enfocement when there is involvment of UMNO and its ‘partners’. Take a hike Utusan.

    I can’t technically say “Congratulations” to Teresa because she shoudn’t have been detained at the first place.

    However, Teresa’s release must be credited to a Divine’s intervention, loving parents, faithful colleagues and leaders of DAP, PAS and PKR. Not forgetting her resilient and courage.

    The public outcry against the detention of Teresa Kok under ISA does not end with her release, the public now will further demand for the release of Raja Petra and the other ISA detainees. Then, the rakyat expect nothing less than the ISA to be repealed or abolished within the shortest time frame! If the current government is unwilling to do so, the rakyat will then anticipate for a new government which is willing to repeal this draconian and abusive law.

    Nevertheless, the Government and the Inspector General of Police must publicly APOLOGIZE & COMPENSATE Sin Chew Reporter Tan and YB Teresa Kok to further ease public’s outcry.

    The police’s statment for YB Teresa Kok’s release is just as absurd as the reason was given to Sin Chew Reporter Tan’s detention under the ISA. I thought in common law of justice that police is to investigate (or interrogate at max. 24 hours for investigation) and achieve a considerable authentic evidence before detaining someone pending for trail. However, in Teresa’s case, everything seems to be OUT OF LAW AND ORDER.

    As for the Utusan Reporter who questioned if Teresa is willing to take the lie detector test to prove her innocence has only earned himself/herself a two “tight slaps” from the Rakyat.

  153. Thank GOD that our ‘Saint’ Teresa has been released from the double-egdes sword law ISA. ISA is used to guard against elements which posed danger or instability to the country(C). Now, Teresa(A) was targerted by the police as one of the element . The police(B) detented her under ISA. Now, after the interrogation , the police found out that she is no longer the element who caused the problem. Now, the country should back to normal before her detention. But the actual situation is not the case. The rakyat and all those who released by the detention now started to demand for justification(C) . In another words,. our represent situation is worst than before the arrest . Isn’t it the element who started the arrest of thses elements under ISA are responsible to arrested under ISA because they(B) have caused the unrest and danger to the country ? Unless, there is justification that after all those who were arrested by the ISA the country’s situation is back to peaceful and stable situation that the authorithy who started the arrest should arrest themself now, because the sword has the ‘double-edge’.

  154. Even as we rejoice in YB Theresa Kok’s release, we must not forget the dangers lurking that got her arrested in the first place. These dangers are still lurking and ever present. I wish to say something about them.

    No one doubts that Malaysia is replete with more than our share of repressive preventive detention laws inimical to civil liberties, eg the ISA, the Public Order (Preservation) and Prevention of Crime Acts, Emergency (Public Order and Prevention of Crime) Ordinance and Emergency (Essential Powers) Ordinance etc.

    Repressive laws per se don’t represent a problem if they are properly applied. Society is protected from terrorists, jihadists and bombers and triad societies by judicious application of such repressive laws.

    So what is the real threat to civil liberties, rule of law and democracy in Malaysia?

    It is this trend – a compound and mix of these several elements:

    1. An overly sensitive attitude of people or groups of people who get easily offended by others remarks or actions alleged to be sensitive in terms of race, religion with the scope expanding to cover other tyhings as well. I call them the ‘egg shell’ cases because their feelings are as fragile as “egg shell” easily angered and overly sensitive.

    2. Their modus operandi : coalesce as a group and lodge police reports. They seldom file a civil suit to seek redress to their injured feelings. Why ? Because they have to prove their case before court of law which they know they cannot succeed because basically they either have no justification in law/cause of action or the evidence to prove it, and if they lose the case they not only have to bear the cost of engaging their lawyers but also pay costs to the other side for an unsuccessful action. Now lodging police report incurs no cost but is beneficial in terms of ingratiating themselves with certain political groups or persons when such report lodged advances the latter’s political agenda.

    3. The problem of 1 & 2 above is Ok and manageable provided the investigating and police authorities do their work properly, which requires of course (i) they’re familiar with the law (ii) investigate the facts thoroughly and if unsure of how the lawapplies to the facts investigated consult at least capable officers of the AG’s chambers and (iii) arrest only after investigations are completed, and the facts suit the offence. Now we have a real problem if they use the repressive laws to arrest first on the first complaint and do the investigation later using the extensive time afforded by these repressive laws to remand the person complained against to investigate the facts. This is bad because if the person is innocent as as Theresa Kok’s and Reporter Tan Hoon Cheng’s case have shown (where they are freed within a shortwhile after investigation) their civil liberties would have already have been violated. They have gone to jail for nothing, and have been released subsequently without knowing what they have done wrong!

    4. The problem of 3 is compounded by lack of accountability and oversight on relevant Minister of Home Affairs’s part when he said he did not give the Ok for either arrest or release of the detainees.

    The above 4 phenomenae interacting in combination is a clear and present compound of threat to our civil liberties and development of democracy.

    Problem 3 may be addressed by IPCMC and 4 perhaps by change of Minister. I am worried about the trend stated in 1 and 2 above, about which I have got more to say.

Continuing from my preceding posting, Malaysiakini’s Athi Veeranggan | Sep 19, 08 7:32pm have reported , “a Penang group comprising 15 people calling itself ‘Concern Citizens’ lodged a police report against Datuk Seri Anwar Ibrahim for creating “instability, disharmony and disorder” over his Sept 16 plan to seize power. Group spokesperson Wan Abidin Zain claimed that Anwar’s relentless pursuit to take Putrajaya from BN’s grasp was “undemocratic, immoral and irresponsible”. The group, comprising about 15 people, rapped Anwar of being selfish and inconsiderate by embarking to grab power last Tuesday, causing Malaysians to press the panic button fearing that the country was about to descent into unrest and uncertainty.
    The group claimed that some parents did not even send their children to school and many went on a buying spree to stock up essential household goods. “Anwar creating a near chaotic situation and panic among Malaysians. He posed a threat against the country’s economy and shook the confidence of foreign investors. “He triggered a political crisis and stalemate on Sept 16,” said Wan Abidin, calling on the police to investigate Anwar for sedition and causing public disorder.”

    Now please note this fits in very well – hand and glove – with what the Prime Minister had said on last Wednesday that Anwar was a threat to the country’s economy and security.

    So even if the PM said ISA won’t be used, will other repressive laws be used by the police to arrest DSAI first and investigate later?

    If this is done DSAI can forget about his cross over scheme even when Parliament resumes session on 13th October.

    An arrest of DSAI will throw a wet blanket on whosever intending to cross over to PR under his leadership.

    What is sauce for the goose is also sauce for the gander. There have been police reports filed against Ahmad Ismail, Tempe Toyol, Utusan, etc for fanning racist sentiments. If Anwar is arrested under the ISA “for the purposes of investigation” or “for his own safety”, then why are the UMNOputras not given the same treatment ? I don’t think we should be worried of charges under the Sedition Act because these would be heard in a court of law, and it would be incumbent of these clowns to prove why Anwar’s antics “harmed” the government and the people.

    I am certain Anwar would love to have his day in court if he is charged with sedition.

  159. Legislation which is used to suppress political opposition and stifle the growth of informed public opinion like the Printing Presses & Publications Act must be reprealed.

    The ISA in its present form must be abolished. It should make way for an anti-terrorism law with all the necessary legal safeguards like judicial review and more. It should be renewable by a two-third votes of members of Parliament every two years unless repealed.

  161. You will note RPK was detained under ISA because reports were lodged by certain Islamic groups against him for insulting religion. Theresa was arrested because PPIM and Pewaris lodged reports against her.

    Even as far back as 2003 Umno Youth today lodged a police report against malaysiakini over a letter which was published on the website on Jan 9 allegedly questioning Malay special rights, instill hatred towards the government in non-Malay Malaysians etc.

    This unhealthy trend of lodging police reports to settle scores is not confined to UMNO youth or groups sympathetic to BN but also the Opposition including DAP. Everyone filed a report against Ahmad Ismail’s racist remarks reported by Sin Chew – not just MCA, Gerakan but the DAP as well. So tit for tat Utusan would report and police reports by relevant interest group would lodge reports against Theresa Kok or reporter Tan.

    What kind of society have we become? Supposing now for a political motive I want to fix someone well and good. It is sory easy to generate Police Reports against target by using certain groups, they declare they are hurt by what has been said or done, and presto a few days later, he is arrested (for investigations)!

    How do we solve this problem of the intrument of police report and police action being constantly used to settle scores including political scores and mediate conflicts including political conflicts?

    Everyone wants to be a cry baby : my race or my religion is offended by what you say.   167. The ISA should only be used to arrest terrorists or trouble-makers who go on shooting sprees in the street and plant bombs in buildings, buses and trains, i.e. people who pose a PHYSICAL threat to the nation.

    The ISA / Sedition Act must not be used against politicians and civilians who criticize the government. After all the government can choose to listen or ignore their criticisms. A progressive government is one who is willing to listen and study the views (be they positive or negative) of its citizens. The government is only justified to use ISA against these people if their criticisms are accompanied by PHYSICAL destructive acts e.g. burning down of government buildings, assembly halls and buses.

    “You are a THREAT, so we use ISA for detention without trial.”
    “No, you are not at THREAT level yet, so we use something else e.g. sedition act”

    It is truly unconvicing. There is no guarantee in making mistaken arrests, but as we see, the precedence has been set long before.

    The home minister and cabinet throw the ball standing aside to be an oberver, while watching the police to freely exercise the licence to “detain” individual deemed a THREAT; selective justification from the mix of facts, truth, make-believe sources, twisted information filling the atmosphere.

    This is madness. We cannot simply silence blogger by putting them into detention cell, because of their criticism to the government and their views in the current political development.

    Jeffrey, when a police report is lodged against someone, the right thing for the police to do is to call up the persons concerned and investigate. If found guilty, then charge him/her/them in court. If not guilty – end of story. Or better still, charge the person who made the false report. You don’t go around putting people behind bars and then investigate. Cart before the horse. More so, why the use of ISA?

    A Commission of Inquiry is needed to review all aspects of the arrest of YB Terasa Kok just before midnight on Friday. The Public Complaint Bureau intends to examine some of the areas of harsh treatment like the lack of food during her seven days based on her media statement on her release. What she gone through several hours in the wee hours of Friday until she arrived at a destination in a Police Station at 4.30 a.m., as reported is subject to sort of unofficial ‘torturous’ moments. Was she arrested for her ‘protection’ like the Sin Chew’s reporter? Personally, I had a strange and disturbing experience with a taxi driver in Johor Baru where I paid RM40 for two hours of familarisation round trip about noon time there but the driver was chanting in unknown irritating language throughout the trip in 1996. Why should two police vehicles with a few professional Policemen move around Kuala Lumpur without traffic jam for about 4 hours at public money carrying Terasa? Was she accompanied by a Police woman?

    Also the Muslim Consumers Association of Malaysia (PPIM) and the Islamic NGOs, Heritage Associations, Malay Cultural Organisations and Related Bodies Cooperation Network (Pewaris) Sunday lodged police reports against Selangor state executive councillor Teresa Kok over her alleged act to prohibit the “azan” call to prayer at mosques and surau in Kota Damansara, Sri Serdang and Puchong Jaya.

    Would the Police charge those who had lodged such questionable Police Reports for false police reports as the facts of the case have been distorted.
