Tan Hoon Cheng makes ISA history – Syed Hamid acquires ISA infamy

Gutsy Sin Chew Daily senior journalist Tan Hoon Cheng makes Internal Security Act (ISA) history for being detained for the shortest period under the infamous detention-without-trial law – less than 20 hours!

She was detained in her Bukit Mertajam home on Friday, September 12, 2008 at 8.35 p.m and released at her Bukit Mertajam house at 4 p.m.

She spent the Friday night in the police lockup and the next morning was being taken down to Bukit Aman in Kuala Lumpur by car but U-turned at Ipoh to return to Penang as “instruction” came for her release.

All for a four-paragraph straight reporting of a speech by Umno Bukit Bendera division chairman Datuk Ahmad Ismail in the Permatang Pauh by-election ceramah on August 23 referring to the Chinese in Malaysia as “penumpang”!

Home Minister, Datuk Seri Syed Hamid Albar meanwhile acquired ISA infamy for his cynical, preposterous and contemptible explanation and justification for Tan Hoon Cheng’s arrest as well as those of Teresa Kok and Raja Petra Kamaruddin under the ISA.

Albar claimed that Tan was detained for her safety as the police believed her life was “under threat”.

I could imagine former Prime Minister who was also Home Minister for over a decade giving such a preposterous justification – which would be typical of what I had told Mahathir to his face in Parliament about “Mahathirish perverse illogic”.

But unlike Mahathir, Hamid is a trained lawyer!

Hamid has brought the legal profession into grave disrepute with such preposterous reasoning!

Hamid said the police had acted according to law.

Can Hamid quote chapter and verse in the ISA to educate MPs and Malaysians as to when it was amended to include a new-fangled objective to protect journalists from physical “threat”?

But Hamid could not resist providing the real reason for her detention, as reported by Malaysiakin:

Home Minister Syed Hamid Albar has implied that Sin Chew Daily reporter Tan Hoon Cheng was also to be blamed for the public furore over the ‘Chinese squatter’ remark.

“The whole thing was started by her, (so) it was best that we talked to her,” Syed Hamid said in reply to a question during a press conference at the federal police headquarters in Bukit Aman today.

Asked to elaborate, Syed Hamid said the ripple effects from Tan’s article had caused “the polemic and fear” thus warranting investigations by the police.

“That information is from her and it was published. (Since) it has been published, it is best that we get to the bottom of it by getting the information from her.

With such a dumb explanation, Malaysians cannot be inspired by the confidence that the country has a good, steady, level-headed and solid Minister responsible for national security, law and order.

On why Ahmad was not detained for making racist comments, he explained that Umno had already punished him by suspending him for three years and stripping him of his party posts.

    If she is really guilty of what she had be alledged to have done, then by all means.. lock her up! The incident could really have had lead to possibly yet another racial incident which we so rightly fear.

    If no evidence can be produced to back up tale spurn by Utusan… then her accuser and Utusan be taken to task by law…

    I personally don’t believe Teresa is stupid enough to so such unthinkable act… and believe she should be allow to defend herself in the court of law… and not have her rights removed via ISA!

  5. The opposition should point fingers to the police. What are these people’s dogs doing? Can they apply ISA to the robbers and thieves and get them arrested soonest?

    Indeed UMNO is shaking now. Rafidah also wanted a closed door meeting with Abdullah and suggested that the prime minister should not be brought down openly (thus secretly by her behind the door?). Suddenly these people are welcoming Mahathir that is kind of difficult to understand. And Mahathir wanted to expose Najix’s dirty linen… What are all these games?

The only thing I disagreed with Malaysian Insider is the use of one of the titles: When Umno sneezes we catch a cold. This is a wrong use of the phrase. It is relevant if we describe the economy of US or Japan that is great and that affects us (we depend on them).     Obviously ABB isn’t going to be up there for long, and everyone is just waiting to jump on him and take his seat as PM.

    Maybe, his next choice of PM, instead of najib or whoeever from UMNO, is actually Anwar? Maybe he has also lost faith in BN through all the internal squabbling and blackmailing that he is willing to forsake his party and give reigns over to PR? Maybe he knows that the moment he steps down as PM his own BN members are going to tear him apart for all the crap that has been done by his son in law? Maybe Anwar has promised ABB no action will be taken against him if PR comes into power?

    That’s why ABB and Anwar hardly criticise each other, and maybe that’s why Anwar is seeking an audience with ABB? I mean, I think even UMNO isn’t that stupid to use ISA so blatantly to the extent of arresting the female reporter, especially at this juncture in Malaysian history where public sentiment is very much against the government and abuse of power. They know that such blatant use of the ISA will only further erode BN’s popularity and credibility. Maybe it’s just part of ABB’s strategy of weakening BN? Maybe muhhydin knows it, that’s why he is asking ABB to step down?

    If not, I really don’t see how Anwar can be so confident of 916, eventhough I pray for it to happen everyday.

  8. After watching the comments made by BN Minister on TV3, it confirms my theory that ISA now only apply to non-BN members. A reporter asked about Datuk Ahmad Ismail & his reply was as expected. Datuk Ahmad Ismail was ‘punished’ within the UMNO party system. The ‘punished’ is like as if Datuk Ahmad Ismail is still a schoolboy. He even stressed the 3 years suspension. Big deal man !

    3 years is what we spend overseas to get our degree. Moreover, this Datuk Ahmad Ismail is going on a roadshow to defend his ‘pendatang’ claims??? Is this not encouraging sedition??? Whilst UMNO encourages its members to spread sedition, they lock up others using ISA who did no wrong & prevent sedition.

    All that was happening was to clearly intimidate the rakyat & opposition party. We will tolerate this for the next 4 years & vote BN out with mega-tsunami when that time comes. 4 years is not long. We have tolerated for 51 years. What is another 4 years. There’s no room for tyranny in Malaysia. If MCA & MIC have the balls, they should know what to do but dare not do it.

    YAB Teresa already issued a 7 day dateline for Datuk Botox & Utusan to respond. Time & time again Utusan has been putting words in other people’s mouth, esp. from the P-R or non-BN MPs. This is also sedition. Making false allegations & bringing up a religious issue that was not even an issue. YAB Teresa should sue Utusan & Datuk Botox if there is no public apology made. These are all personal attacks with a sinister plot behind it.

    All Malaysians stand united & with solidarity that all that is happening is false. BN Minister on TV3 claimed there is racial tension. What racial tension??? Pls provide prove.     I am not sure if this is right. In the photo in the Sstar he was flanked on side by the director of narcotics and on the other side by the deputy IGP. I wonder why the director of narcotics is in the press conference on the ISA arrest. Can anyone explain?

    That is one of the main reasons why there are more and more people hoping for the success of 916.
    We cannot afford to have such a government anymore, the whole world will die laughing at us. Malaysia is in a really bad shape now. For the sake of our beloved country, BN, please go, as we cannot see you having any intelligence and dignity to make this a better place, the longer you stay in power, the longer we suffer.

  13. In all fairness, if Sin Chew was issued a show-cause letter to explain why they printed issues which would have lead to racial disharmony, so should Utusan for printing out Teresa Kok’s issues which is not disimilar in nature.

    If Ahmad Ismell was suspended for 3 years, Teresa too should be punished in the similar manner if in truth she did what she had been alleged to have done!

    Remember that it is justice, fairness and equality which we want.

  14. When there is no rationale to arrest people under ISA, there can never be a logical excuse for the arrest no matter what.

    We can have these kinds of people without wisdom governing us is because we have unenlightened voters. History has shown us that the tyrant will eventually be destroyed in any circumstances. When the people are being fooled until there is no more dignity left, they will revolt. Then the fall of the government from disgrace will be inevitable.

    How long can this insincere and dishonest UMNO last is immaterial, they will definitely fall with this kinds of modern day undemocratic tyrants around. It is a matter of time. This is a historical fact.

    He spoke a lot about using the law alright, ie BN-Law not Malaysian Law. It was a shame to Malaysian Law after what happened since Friday.

    The ones who are a real threat to the country’s stability are still in UMNO. One of them just got away with a 3 year suspension because ‘he is an UMNO member…so, punished as an UMNO member’. So, an UMNO member can go around the country & cause instability to the country will get 3 year suspension. Reading between the lines, it appears that this 3 year suspension is worst than ISA. Moreover, it took over 3 weeks to act on this rogue UMNO man. While ISA was acted on YAB Teresa within a few days.

    1) Raja Petra – for starting an (unfinished) 513 article that struck raw nerves
    2) Teresa Kok – belated revenge for highlighting nude-squat incident
    3) Tan Hong Cheng – since we were forced to rap Ahmad on the knuckles, we shoot the messenger to pacify the hardliners in our party and to frighten other journalists in future.

    I support your move to overthrow the BN government on 16 Sept 08. It is our only hope. However, there have been some serious questions about your flip-flopping over your target date, which I think you ought to respond to.

    I agree that in usual circumstances, the exact date does not really matter. However, the exact date does seem crucial in your particular case, given that you’ve been reiterating the claim that your plan is on track. In your Al-Jazeera interview, you said that your plan would be achieved on 16 Sept, unless the government acted like Mugabe. We understand that overthrowing a corrupt regime is not an easy task. But we’re also well aware that no one forced the 16 Sept deadline on you – it was completely self-imposed.     Ahmad was suspended by UMNO for uttering racist statements against Malaysians. Why was the legal process or ISA not used against him? That was clearly not an internal issue of umno. Even the DPM apologised to the nation on his behalf.

    In the same manner, should not action against Teresa, if she really did wrong, be taken by DAP only? Even the caretaker of the mosque came out to clarify that Teresa did not even set foot in the mosques or involved as alleged and she is still held under ISA.

    Ministers in Singapore are among the highest paid ministers in the world. Yes, even more than what President Bush is getting.

    This is essential firstly, to get only the best people in the position. Secondly, giving them no reason to be corrupted. When the big guys running the government started to corrupt, the rest of the smaller components will then follow.

    This effort alone, differentiate the good leaders: Mr. Lee Kuan Yew, Mr. Goh Chok Tong and Mr. Lee Hsien Long to the damned ones in our beloved country (you know who).

    – You were doing your job well.
    – You told the truth.
    – You have offended BN or Ahmad Ismail by calling a moron a moron.
    – You have chosen NOT to keep quiet about a moron like Ahmad Ismail making racist remarks.
    – You are a hard working MP.
    – You are NOT a Toyol.
    – You are a politician that Toyol dislikes.
    – You are a non BN politician.

    – You are NOT Ahmad Ismail.

    Borang IS-4 can also be obtained from Ahmad Ismail as he goes on his nationwide roadshow.     Malaysian Seeks End to Decades of Firm Rule

    KUALA LUMPUR, Malaysia — By the most obvious yardstick, this country of 25 million people is a democracy: Malaysia has held regular elections since independence from Britain five decades ago.

    Yet during that time power has remained in the hands of one coalition, the media has remained slavishly pro-government, the courts have often hewed closely to the government line and critics of the country’s leadership have been detained without trial in periodic crackdowns.

    Now Malaysia may be on the brink of a liberal, more democratic era.

    The governing coalition is facing the very real possibility of losing its grip on power to the opposition leader, Anwar Ibrahim, who says he has enough votes to bring down the government and might do so as early as this week.

    Mr. Anwar promises that if he become prime minister, he would not only scrap laws that muzzle criticism, but also upend the father-knows-best style of government and end a longstanding policy that favored the country’s majority Malays over other ethnic groups.

    “I think we’re on an irreversible trend of democratization because it’s coming from the bottom up,” said Sivarasa Rasiah, a human rights lawyer and one of many opposition members elected to Parliament in March.

    If Mr. Anwar succeeds in taking over the government, his actions could have implications far beyond Malaysia.

    A onetime Islamist student radical, Mr. Anwar has emerged over the past decade as one of the leading proponents of the idea that Islam and liberal democracy are complementary. He has cultivated friendships with leaders who share his views in Turkey and Indonesia, and he has built bridges to the West.

    He once served as a catalyst for the increasing religiosity among Malaysia’s Muslims. Today he walks the fine line between the secularism of the country’s Constitution and the demands by some Islamic forces, including those in his own coalition, for socially conservative policies.

    Mr. Anwar, a former deputy prime minister who once mingled with the very establishment he is now challenging, was re-elected to Parliament in August.

    As he and his allies in the opposition gained increased political backing over the past several months, the government under Prime Minister Abdullah Ahmad Badawi has begun to strike back. In July, Mr. Anwar was charged with sodomy for the second time in his career in a case that a large majority of Malaysians surveyed in opinion polls say reeks of politics. And several newspapers have been warned about stepping out of line.

    On Friday, a member of Parliament for the opposition, a newspaper reporter and a prominent antigovernment blogger were detained under the internal security act, which allows for indefinite detention without trial. Syed Hamid Albar, the home minister, told reporters on Saturday that the blogger and Parliament member had been detained for inciting ethnic tensions but that the reporter, who was released Saturday after 16 hours, was only questioned about her reporting on a recent controversy involving a member of the governing party.

    The governing party has leveled accusations of corruption in the opposition’s campaign to win over defectors: Khairy Jamaluddin, one of the party’s most articulate members, has denounced what he calls “underhanded tactics,” saying members of Parliament have reported being offered money and positions of power in a future government, a charge the opposition denies.

    Last week, the battle between the government and opposition flirted with absurdity. First, the governing party dispatched about 50 government lawmakers to Taiwan for what it called an agricultural “study trip,” which appeared to be an attempt to stop them from crossing over to Mr. Anwar’s side.

    On Friday, opposition lawmakers followed them to Taiwan, checking into the same hotel in the hopes of convincing would-be defectors to take the leap.

    Mr. Anwar initially vowed to bring down the government by Tuesday, saying he had written commitments from enough lawmakers to force the government’s collapse. But he now concedes that the governing coalition’s move to send lawmakers to Taiwan could succeed in drawing off some support, forcing him to delay his bid for power.

    The changes that Mr. Anwar has proposed could change Malaysia substantially and fast.

    “All the draconian, oppressive laws must go,” Mr. Anwar said in a recent interview.

    He promises to repeal Malaysia’s toughest laws that give the government the power to detain opponents without trial, ban unauthorized protests, bar students from participating in politics and keep the news media in line by requiring newspapers and magazines to apply for annual publishing permits.

    He would also free all “political prisoners.”

    Perhaps most explosive, he said he would end many special privileges for his own ethnic group, the Malays, who are given a variety of advantages, including discounts on houses, exclusive rights to government contracts and a reserved quota of stock-market shares. The privileges have angered the country’s two other main ethnic groups: Malaysian citizens of Chinese and Indian descent.

    It was that anger, directed at the ethnically mixed governing coalition, that helped the opposition win just under half the popular vote, by far the best showing for the opposition since independence.

    Mr. Anwar contends, and many experts agree, that most of the special privileges are enjoyed by a minority of Malays connected to the governing party. Still, it remains to be seen whether Malays will accept Mr. Anwar’s proposal of policies based on need, not ethnicity. Ethnic tensions have flared in the past, notably in 1969 when at least 200 people were killed in race-related violence.

    Mr. Khairy of the governing party argues that Mr. Anwar is moving too fast by proposing to scrap the country’s harshest laws: Malaysia needs them to guard against ethnic strife, he said in an interview.

    “We are a maturing democracy,” Mr. Khairy said. “These issues, to me, still need a lot of debate. We need to continue the way the Abdullah administration has done it, which is to reform gradually.”

    At least as challenging as balancing the rights of ethnic groups would be managing the struggle between those who prefer a secular government and those who want a wider application of Islamic laws for Muslims, who make up 60 percent of the population.

    In a recent interview in his sparsely furnished office, Mr. Anwar apologized to a visitor for the heat and stuffiness; he keeps the air-conditioning off during Ramadan because fasting from sunrise to sunset gives him chills.

    But he criticized the decision of the Prime Minister Abdullah to suspend Parliament during Ramadan. “He thinks he’s representing himself as a good Muslim,” Mr. Anwar said. “I think it’s reactionary.”

    “If you want to fast, go ahead,” he said. “But go on with your life. If you fast and it causes productivity to drop there’s something wrong with that.”

    Some Muslim groups have called for greater punishments for apostates, those who leave the religion, and stronger enforcement of social laws like keeping unmarried couples chaste.

    While Mr. Anwar clearly has a strong following, many Malaysians, especially those in the elite who have much to lose if the opposition takes power, question his sincerity and wonder whether a leader who has gone through so many permutations in his career can be trusted.

    Mr. Anwar rose to prominence as an Islamic student radical before joining the governing party and eventually becoming deputy prime minister. But he is perhaps best known for his sudden downfall in 1998 shortly after challenging the prime minister at the time, Mahathir Mohamad, for power.

    Mr. Anwar was detained under the internal security act, beaten, given a black eye by the chief of police (who lost his job over the episode) and sentenced to 15 years for sodomy and abuse of power in trying to cover up the sodomy allegations. In 2004, the country’s highest court struck down the sodomy verdict and released him, citing faulty procedures by the prosecution, but the judge, in a highly unusual statement, said he believed that the sodomy allegations were true anyway.

    Like the charges in the first trial, the latest charges of sodomy, which were lodged by a 23-year-old campaign aide, are considered highly politicized. The deputy prime minister, Najib Razak, a chief rival of Mr. Anwar’s, initially denied that he had anything to do with the case but then admitted that he had met with Mr. Anwar’s accuser before the allegations were made public.

    Salehuddin Hashim, a high school friend of Mr. Anwar’s who is now the secretary general of his party, admits to doubts about Mr. Anwar’s past, especially his years in the governing party. Even the party’s leaders admit that money politics and corruption are rampant within the party’s ranks.

    “Anwar wasn’t a paragon of justice or virtue,” Mr. Salehuddin said. “He was part of the racket.”

    But he said that six years in prison changed Mr. Anwar and made him more sensitive to injustices in Malaysia, a relatively prosperous country with one of the highest levels of income inequality in Asia.

    “It’s a credit to Anwar that he managed to galvanize people into focusing what they are unhappy about,” Mr. Salehuddin said. “He personalized injustice.”

    It is just a joke but judging from the flip-flops and the unimaginative (to use Jeffrey’s expression) plans and justifications for the recent ISA arrests, it seems not very far from the truth about the ability of our politicians.

    Another good one which I heard last night from my daughter is the following.

    Bush, Blair and Badawi were somehow in Hell and all had to make calls back to their Ministers to be updated on the latest in their respective countries. Bush called and spoke for 5 minutes and was charged by the keeper of Hell a few million USD. Blair also spoke for a few minutes and was charged a few million GBP. Badawi spoke for more than an hour for there were much happenings in his country but at the end of the call was only charged 20sen. Bush and Blair complained to the Keeper and the reply was that while Bush and Blair had made long distance calls, i.e. to the USA and UK respectively, Badawi was only making a local call, from hell to hell!

    Again, it is only a joke. Would I be ISAed? Or slap with a sedition charge for inciting hatred against the government? But I think it is beyond hate now; I just want it to go away.

    “I know I am breaking rank here … I am prepared to face the consequences. If I am to resign, I will do so.

    “I am not a trouble maker and I don’t want to cause any trouble for the Prime Minister, but I have my principles and will always be a vocal critic of the use of the ISA,” he added.

  75. I have been praying for the release of all those ISA detainees ….each day.
    As my heart weaken, I started to pray that SA’s children will die off tragically one by one , right in front of his eyes the same way that he lied to the whole nation.
    This kind of heartless and brainless creature brought about massive shamefulness to the highly respectable race that he happens to wear the same skin color.
    I would like to see his children pass-overed one by one including all his wives… leaving him alone to survived until old age.
    My thoughts may have been evil now ..as I am mirrored his actions of damages done to this country.

Dear Minister you as a trained lawyer and as a seasoned politician make us feel more shameful and at the same time realized how cruet is politic in real life. You have choose to associate without all those incompetent to continue using ISA to create fear among the Malaysian. Dear Minister it is time for you to resign for the good of the nation. Your colleague Zaid Ibrahim has a least come strongly against the abuse of this law and wish he can influence the government to immediate release all those remain retained under ISA.

    Lain kali di Parliment sila nasihat menteri undang-undang Zaid aturkan sessi latihan undang-undang untuk BBCC supaya dia orang lebih matang dan lebih faham undang-undang terutama sekali apa undang-undang untuk mempertahankan rakyat dan mana undang-undang untuk penjenayah serta anasir-anasir yang menggangukan ketenteraman rakyat. Sila minta Datuk Zaid menasihat mereka cara debat yang betul jangan macam binatang liar di parlimen dan bikin malu kepada rakyat dan negara. Jangan basirkan duit rakyat dan negara untuk lawatan ke Taiwan dan belaja cara pertanian semasa “typhoon” berdekatan. Apa mereka dapat belajar dalam keadaan cuaca begini. This Botak is also ‘pushing’ his responsibilities & blamed that the Police acted on their own to arrest RPK, Theresa Kok & Tan Hoong Cheng under ISA. Do the Police have such authority?
