Anwar Ibrahim will be the new Parliamentary Opposition Leader after he wins the Permatang Pauh by-election on August 26, 2008.
This is to take effect from August 27.
This was one of the decisions taken unanimously by Pakatan Rakyat leaders of Parti Keadilan Rakyat, PAS and DAP at a meeting last night.
A joint statement by Pakatan Rakyat leaders would be made at the Kuala Lumpur Court Complex before Anwar’s court appearance this morning.

The EC fixing polling day on a Tuesday certainly smell fishy as it would effect voters turnout. But declaring a holiday on account of a by election while the rest of the state is not involve directly is irresponsible. The people who are eager to be involve should take leave from work. Anwar Ibrahim’s appointment as the opposition leader is applauded to show support for him to continue to voice out the discrimination done to him and to ensure further injustice not done to another Malay or other races in Malaysia.
Would Anwar Ibrahim speak for all the races or will he be another Malay fighting for his rights for the moment and could he be another ‘Dr.Mahathir in the making’. Dr. Mahathir too was seen to be patriotic when he wrote the book, ‘The Malay Dilemma’, although banned when it was published but was sold when Dr.Mahathir came to power. Dr.Mahathir’s book may have boosted the making or creation of the NEP in 1970.
Would Anwar Ibrahim sieze the political advantage by making a comeback and continue to be ‘Bapa Ketuanan Malaysia 2’ ( Dr.Mahathir being the ‘Bapa Ketuanan Malaysia 1’ ) or would Anwar Ibrahim fight for rights of Malaysians of all races?
I don’t totally trust Anwar Ibrahim. We have seen from the past how the Malay politicians have used their popularity to come to power and push for the Malay agenda and strengtening further the NEP policies.
If Anwar Ibrahim decides to abolish the NEP ( Dasar Ekoomi Baru) if he wins in Permatang Pauh and eventually leads the country, then, and only then I see light at the end of the tunnel for the minorities in Malaysia. Until then, lets wait and watch the drama that’s unfolding.

It is simple: if Police, AG and Judiciary are found wanting as most of you said, then the livelihood of him being found guilty is almost a certainty. So what strategies does PR have if Anwar is found guilty and sentenced to jail. There is almost a vacuum. And that is why you find UMNO-BN have only targeted Anwar and no one else. It is almost like telling all Malaysians that UMNO-BN can almost write off all other PR leaders. To me it is also reawakening and “soul-searching” for many other PR leaders.

I suggest PR expedite taking over of federal government before 10 September, after all, 16 September is only 1 week away from 10 September.
Once the federal government is changed, there will be fair hearing for Anwar.

The above statement by YB Lim goes to show that the spirit of power sharing and togetherness among the members of Pakatan Rakyat grew rather more solidly after five months after March 08, 2008. This also goes to show the willingness and acceptance of members of Pakatan Rakyat to let Anwar Ibrahim to become the new Prime Minister should they form the Federal Government as widely announced by them. We can now see the spirit of speaking in one single voice among members of Pakatan Rakyat appears more cohesive. the case is going to be a big waste to the tax payer money and in the end Anwar will be found not guilty.
2. On the nomination day, BN candidate fill up a wrong borang pencalonan. They will use borang mangsa rogol HKL to submit to SPR, thus SPR announce DSAI as winner
3. Come 16 Sept, the whole BN government will collapse and state of emergency declared.
Summary
Pls start to prepare 3 months supply of can food, ikan kering, rice, sardines, diapers, milk etc etc.
Based on developments so far relating to charge against Anwar, there are a few interesting anomalies.
For examples:
1. One would have thought that the charge preferred against Anwar would be under section 377C of Penal Code relating to sodomy in sense of anal rape. However as it turns out the charge formulated by AG’s chambers (Solicitor General) is that of sodomy on Saiful under section 337B of the Penal Code, which section 337B refers to consensual homosexual sex, not anal rape. [ 377B : “Whoever voluntarily commits carnal intercourse against the order of nature shall be punished with imprisonment for a term which may extend to twenty years, and shall also be liable to whipping” , key words being “voluntarily”]. Straightaway prosecution puts itself at disadvantage by reasons of 2 major discrepacies: (a) Saiful’s first complaint and report to police published by RPK in blog referred to sodomy “tiada kerelaan saya” (without consent) and (b) hospital reports at Puswari & KL Hospitals are likely supportive of sodomy haviong taken place.
2. Per Malaysiakini report filed by Andrew Ong and Rahmah Ghazali | Aug 6, 08 8:57pm – at a press conference after chairing the Barisan Nasional management committee meeting in Kuala Lumpur on same day, when the PM was asked by press ‘if Saiful would be charged for sodomy as well if the alleged sexual encounter was found to be consensual, Abdullah laughed and said that he was not competent to comment on law issues. “You better read your law. It depends on whether a rape took place, or not. I’m not a lawyer. I don’t want to get involved. We’ll see when the case goes to court,” he said.’ Implication of that statement is that if alleged sexual encounter was found to be consensual, then Saiful would be charged as well. Now the charge is 377B (voluntary & consensual sodomy, it raises question whether Saiful (chief witness for prosecution will be charged as well under 377B)!
3. One would also expect bail was to be denied so that Anwar could not campaign in Permatang Puah. However contrary to that prosecution did not opposed bail and judge SM Komathy (in contrast with Augustin Paul J) granted bail on Anwar’s personal bond of RM20,000 with him not being required to surrender his passport.
All these suggest that rank & file of government machinery don’t seem to be necessarily acting entirely in concert with what either top echelon says or otherwise would have been expected to be consistent with the political interests of top echelon. It looks as if within the BN govt and down rank and file, some may have evil motives heedless of good sense and justice but we cannot say all are united in nefarious motives : up to this stage, within limitations pf political pressures, I cannot say I am unhappy with what the the Solicitor General or judge SM Komathy has done in preferring a charge under 377B instead of the absurd 377C, not resisting application bail and giving Anwar a fighting chance.
The judge also set the case for mention on Sept 10 when it will be decided when hearing will begin – which will be way after Oct 2008.
In the premises Anwar has a reprieve to (i) contest and win Permatang Puah on 28th August and (ii) become Opposition Head with national footing and (iii) if Anwar were credible in what he said that he could effect a take over of the government on 16th September by aid of cropssovers, then this entire exercise of prosecuting him for consensual sodomy will be an exercise in futility in not only bolstering his popularity in the polls of 28th August but also not thwarting in any way his attempt to take over the government on 16th September, which if successful, question of continuing with sodomy charges does not arise!

im a sabahan and also a strong supporter of Roket. .I can forseen that the government will not dare to arrest DSAI before the election.

If the original intended charge against Anwar comes under section 377C of the Penal Code relating to sodomy associated with anal rape has now been altered to one under section 377B which refers to consensual anal intercourse how come Saiful is not hauled up together with Anwar. In fact Saiful should be given a second charge for making an allegation of anal rape when in fact it is

I will not be surprised if the court declares Anwar NOT guilty on 10 September as that could be Abdullah’s plan to prove to the world community that the Malaysian legal system is trustworthy – there is no manipulation of the judiciary by the government. The worry and criticism of foreign diplomats over Anwar’s case are unwarranted.
By playing a game like this, Abdullah’s popularity ratings would probably improve to 50% from a low of 42%.

In reply to AhPek’s question at 13:26.08, it would be valid to argue that Saiful – just like Dr Chuah Soi Lek – should equally be charged for consensual anal sex under 377B.
However such an argument is put forth not because it is a right thing to do : it is put forth only in the limited context as a counterpoint of argument against authorities’ selective prosecution of individuals whom those in power are inimical to, whilst sparing others they are friendly with.
This is because selective prosecution is an infringment of our constitutional right to equal protection of the law.
But other than using such an argument merely as an expedient counterpoint against selective prosecution, I would not wish anyone, whether Saiful, Anwar, Dr Chuah or anyone for that matter to be prosecuted for consensual sex, whether natural or unnatural.
And that is because I place greater importance in a person’s freedom and liberty than his or her basic biological activities, drawing a line only where there is harm inflicted unto others as in rape, which excludes all consensual expressions, private and not public flouted, causing emotional distress to the more prudish conservative and in some cases hypocritical amongst us who witness such activities.
Having said that, it is also a personal view. I make no attempt to foist upon others that this personal view is more right, advance or enlightened than those who would take a different view that we should not condone immoral sexual behaviour.
However, this much has to be further added. No matter what we think of a person – that he may actually be guilty of allegations made (whether maliciously or even honestly) against him – as long as those allegations will result in that person being punished by public odium and shame and even incarceration upon conviction, we should observe, in relation to him, at least the minimum standards of rule of law and legal rights (including presumption of innocence unless proven otherwise beyond reasonable doubt) to which person is entitled.
Translated, it means that if the evidence is not up to mark, we don’t persist to dig further to fish and canvass for more incriminating evidence, and if necessary to even fabricate evidence with the view of deliberately incriminating the person.
In short, to accord every person the basic rights in accordance to ordinary principles of human decency and fairness. That’s all I have to say.
DSAI is charged under Section 377B of the Criminal Procedure Code, which is sodomy by consent.

This is because definition of carnal intercourse against the order of nature under 377 includes both anal as well as oral penetration.
SM Komathy had little or no choice but to grant DSAI bail if she has read Dr Osman’s SD posted on RPK’s Malaysia Today’s What the IGP and AG do not know……yet, which once and for all shows PDRM had tried to set DSAI up by intimidating the good Doctor into signing a false report!

What high ideals you expound here are only applicable in an ideal civil society. But sadly no place on earth exist that can uphold such ideals, more so in a political forum. The pertinent question one should ask on a charge under 377(b) of the Penal Code is on which first information report is the authoritie relying when they preferredthe charge against DSAI.
As it is there is only one report that we are aware of that Saiful has lodged alleging forceful sodomy. Unless in the course of their investigation and interrogation Saiful admitted that actually he had carnal sexual intercourse against the order of nature then in this circumstances can the police profer a charge against both offenders. So far only DSAI is charge. Why?
Now if Saiful have not admitted to consensual sex against the order of nature then the police is in double jeopardy because on what grounds have they charge DSAI on? Note that both Saiful’s complaint and the purpose of medical check up is for assault by sodomy. Furthermore according to Dr Osman examination there is no evidence of tear in Saiful’s arse thus indicating and ruling out sodomy altogether.
Mr. AG please withdraw the charges and safe facelah!

The case against Anwar is so full of holes that a fair judge will just throw it out without calling for Anwar’s defense. One hopes Umno will not change the judge just like the Altantuya case.

We must tell Permatang Pauh voters not to be swayed by the “softer” approach that I expect this time. The way Anwar will be treated will be “softer” than the last time in 1998.
Even if it is a bailable offence, the Court can use its inherent discretion to grant bail to Anwar. Then he may campaign while the case is still pending.
Anyway, there is merit in preparing for another candidate, just in case these clowns are up to some nonsense. While the whole world watches, they will be desperate enough to do something stupid like the Judge in the Bukit Bintang case.

Precisely and this boils down to the saga of Anwar Sodomy2 which tells of desperation of UMNOPutras to maintain power they have amassed over the years by throwing out buzz words like “aku punya negeri” (in the 40s and 50s),”Ketuanan Melayu”,”Malay rights”,”NEP”,”affirmative action” etc to gain currency amongst the Malay community.Anwar stands as a threat to such Malay dominance (more precisely UMNOPUTRA dominance) and his challenge must be put down at all cost using legal or foul means.That the charge against him is altered from one under section377C to that of section377B probably testifies to the fact that not everyone complies to their bidding to doctor their reports ie the doctors in the 2 hospitals,the people from the chemistry department and Anwar himself in refusing to submit sample of fresh DNA.

This might be true that the whole thing is being chereographed but you forgot you need a master ‘maestro’ to get the act together for it to materialise.

Lying is part of Anwar’s leadership qualities. He said he was anti money politics when in fact he was the leader of money politics during the UMNO Deputy President elections in 1993. What has changed since?
During his leadership of the ABIM movement, he used Islamic principles as his strong fundamentals to achieve his political ambitions. However, after he joined UMNO, all those principles and Islamic struggles were actually pretences and fake.
Corruption was at its highest during Anwar’s tenure as the Finance Minister. So much so that people call Anwar the ‘Father of Corruption’.
When Anwar was the leader of ABIM and a student, he loudly despised and belittled UMNO and its leaders but not long after that he praised those that he despised. He is a “leader” with no vision.
He is simply not worthy to be a leader and nor is he able to bring the country together under acceptable principles.
