Stop misallocating limited resources hunting Chua Soi Lek sex DVDs when top police priority is to fight endemic crime

The Batu Pahat magistrate’s court yesterday sentenced three persons to jail and hefty fines for possessing and reproducing the sex DVD of former Health Minister, Datuk Seri Dr. Chua Soi Lek, viz:

• Tay Bee Bee, 29, owner of a beauty salon, was jailed for five days and fined RM10,000 or default six months’ jail for having in her possession three DVDs;

• See Tooh Choy Yoke, 26 (Tay’s employee) and farmer Lim Poi Keong, 51, each jailed for four days and fined RM15,000 or in default seven months’ jail for making 11 copies of the DVD.

The fourth person, Tan Kim Chong, 48, has claimed trial in the Johor Baru magistrate’s court to the charge of possessing the DVD.

It is reported that two more men in Johor Baru have been arrested for having six Chua Soi Lek sex DVDs each.

While public opinion is in general agreement that the trio had committed offences under Section 292© of the Penal Code, it is also the general consensus that the sentences of jail and fine were excessive, unjustifiable in the public interest and therefore detrimental to the cause of justice.

Public confidence in the administration of justice and police maintenance of law and order are not served if it is perceived that the law enforcement agencies are overzealous in a case which affect a former government Minister when similar zeal has not been shown to make the streets, public places and homes safe for Malaysians, visitors, tourists and investors.

Police should stop misallocating their limited resources to try to hunt down all who possess the Chua Soi Lek sex DVD when their total focus must be to make Malaysia a safe country again and to restore to Malaysians their fundamental right to be free from crime and the fear of crime.

The Police had announced that it would conduct house-to-house search in Muar and Batu Pahat for those in possession of the Chua Soi Lek sex DVD, which is a shocking misallocation of police resources, gross abuse of police powers and an intolerable and unacceptable violation of privacy of ordinary Malaysians.

Why don’t the police start first with a house-to-house search of MCA Ministers, Deputy Ministers, Parliamentary Secretaries, Members of Parliament and leaders for the Chua Soi Lek sex DVD as the police can be assured of a bountiful harvest?
That Malaysia is even more unsafe for its citizens, visitors, tourists and investors could be seen from the endemic crimes which have sadly become a common occurrence in the country.

Some of the crimes reported in the past few days include:

• The “terrifying” armed robbery of a family of nine in Lucky Garden, Rasah, Seremban on Saturday night where five men armed with machetes robbed a family of about RM100,000 in valuables, after threatening to harm the sons and rape the daughters of the family.

• The hours of terror ride by former TV3 newscaster Wan Zaleha Wan Radzi who was assaulted, robbed and hijacked by three men in Pusat Bandar Damansara, Kuala Lumpur last Tuesday.

• A graphic designer with a Chinese daily who was kidnapped and gang-raped near her home in USJ6, Subang Jaya last Wednesday.

Today, I received en email about a new crime method by snatch thieves which the public, particularly womenfolk, should be aware and be on the look out, viz:

“I was driving along SS2/22, Petaling Jaya going towards Damansara Jaya. This street is totally residential one street off the main road.

“About 10 houses in front of me was this young lady walking by a car parked along the grass patch outside one of the terrace houses. As she was reaching the rear end of this clean decent looking Silver Proton Waja, I noticed the engine started and the left rear passenger doors window was being wound down.

“Suddenly a man emerged out of the rear passenger doors window his entire torso! and making a grab of this ladys handbag!!!! As this man emerged from the cars window, the Silver Proton Waja was pulling out of its parking position slowly not in a hurry with the man from within just dragging the lady and her handbag along until she gave it up!! Then they drove off slowly no hurry!!!
“All the above happened in front of my eyes in less than 30 seconds!!!!!

“Her screams and cries did not help! No one came to her rescue in fact a middle age woman ran into her house upon seeing this happening right in front of her house only to come back out to lock her gates after the car has driven away! Do you blame her? The thieves were so bold!!!!

“By the time my car reached her, the Silver Proton Waja had turned the corner. She was very shaken but thankfully only slightly hurt her pants were torn as were her slippers bloody knees, shins, palms and elbows. On the way to the police station, she told me that she had noticed that there were 3 men she identified them as Malay men in the car.

“I could not believe my eyes when I saw what was happening thus did not have the instinct to take note of the cars registration number. Ive always thought that would be the first thing I would look out in an incident like this but NO I was too shocked simply watching this scene being played out right in front of me!!!”

The streets and public places in the major towns in Malaysia are no more safe, with predators and criminals on the prowl for victims from the innocent and defenceless public. Making the towns and the country safe again should be the top priority of the police instead of the police on the prowl for the Chua Soi Lek sex DVDs as if this is its topmost concern!

Otherwise, more tragedies like the front-page report of China Press yesterday, where a nurse locked up the iron grill of a 24-hour clinic in Johore Baru and refused to allow a very sick 37-year-old welder entry at about midnight for fear that he could be a robber, resulting in delays in sending him to the Johor Baru Hospital and his totally avoidable death before arrival.

This is one case which highlights the breakdown in Malaysia not only of the medical and health system but also the maintenance of law and order system – a terrible beginning for the new year of 2008.

It is therefore inexcusable and unacceptable misallocation of limited police resources to be more zealous about hunting for the Chua Soi Lek sex DVDs instead of restoring the fundamental right to personal safety for all Malaysians – particularly when there are so many serious crimes still awaiting resolution, like the brutal murder of 8-year-old Nurin Jazlin Jazimin in September last year.

    Why should possessing the CD be such a big issue? If it had not been made, then there will not be one to be circulated around. So they should go after the main culprit and not the people who own the CD.

    I also wonder if the police are the one who set up these security cameras. If not, police have to show us the actual persons doing it.

    Will some one make a police report asking the police to investigate Chua and the woman? Make sure there was no ‘dealing’ of any form involved.

    The Nurin murder is yet unsolved. The murder of the two cops in a drug raid is also unsolved. The serial rapists who took young women for terror rides are still out there. Snatch thieves are everywhere.

    Misallocating resources is nothing new for a government that is bankrupt of ideas. It is only through the misallocation of resources that leakages can occur.

    Just because Chua Soi Lek was a Minister in the cabinet does not mean that the police should accord him special privilege and priority in his SEX case.

    Mind the police, they should be aware that Chua himself had committed offence of ADULTERY and SEXUAL MISCONDUCTS in the first place, and he should be prosecuted in the court of law which shall decide the outcome.

    It was because he was the one who committed offence that gave the opportunity to others to record the visuals of his SEXUAL ACTS and for certain purpose.

    If Chua Soi Lek never venture into his SEXUAL ADVENTURE and SEXUAL TRYSTS for his own SEXUAL satisfaction, who would ever be able to record anything?

    Right, the police should have known not to waste their resources on a futile chase.

    The IGP was being indiscreet to get himself carried away in the limelight that he wanted to have a share in. That is not the way to be professional as a policeman. Why should the police be drawn into the political vortex of a squable with the MCA?

The AG only prosecutes the small flies like farmer and beauty salon employee whereas those big snakes who are responsible for the production and distribution of the DVDs are exempted from the law. In imposing hefty fines, the magistrate was merely doing the bidding of the prosecution.

    While I do not condone selling of pornography, I am amazed at the way police handle this issue. There are more serious crimes in the country which IGP should solve.
    In case the IGP is so dense that he could not grasp the issues at hand, he should consult Mr. Lim.

  17. The main justification for investigating the sex DVDs was to ferret out and determine who was the “Black Hand” who invaded Dr Chua’s privacy and masterminded his political fall from grace. There is no indication that this has been done except harrassing those who have the DVDs either for personal viewing or commercial motives and announcing an intent of authorities to conduct house-to-house search in Muar and Batu Pahat, which is a process that will violate everyone’s sanctity of home and also privacy. Surely any investigation to punish those who violated Dr Chua’s privacy should not be used as a pretext to violate everyone else’s privacy by conducting house-to-house search! The priorities have all been mixed up.

    It sure is a gross misallocation of police resources when the police should be working hard to make our streets safe. Not to mention the abuse of power. Could this police drive be a reflection of the concern of some key elected officials that there may be other pornographic material out there that has nothing to do do with Chua now that the GE is in sight?

    Privacy rights? In a country best described as a police state, that sounds almost comical, does it not?

    My office was broken into more than once within a short span of time. Neighbors downstairs called me whilst the burglary was in progress and called the police. Another time they managed to carry down the safe. What did the police do? They came, took down reports and went away happily feeling that they have done their job!

    That’s police work at its best.

    Coincidently, when I was in London, a single burglar entered my apartment and escaped with jewelery. What did the police do? They came and dusted for fingerprints and showed me some photographs of jewelery and asked me if I recognized any. Then they told me many houses were burgled the same night and it looked like it was organized. They asked me to describe and make a brief sketch of the jewelery stolen and told me they would be in contact if any of it was recovered. That’s police work too. But I cannot imagine the London police diverting public resources which would be better spent in fighting crime and going after people in possession of some pornographic material be it involving one of their Ministers.

    In other countries vigilantes are known to fill the void left by agents dealing in law enforcement. That is to be expected. But Malaysia has very strict gun laws. Possession of firearms without a license, let alone use them, could land you in very serious trouble with the law.

    I cannot imagine our Parliament repealing any of those Acts currently in force to allow the people to have guns in their homes for protection of life and property.

    The right to bear arms is nowhere written into our Constitution.

A slight digression from the whole CSL scandal and abuse of resources by PDRM; why is it that this whole scandal is still getting wide and prominent coverage in the mainstream newspaper when during the Lingam Tape scandal, so little was reported, and even if reported, would be in a small column tucked away in page 11? It is abundantly clear to any right-thinking rakyat that the latter issue is far more grave than the former. The former, at most, would be a personal misconduct of a minister, who have since admitted and resigned. Shouldn’t that be the end of the reporting of the whole scandal? Why the ongoing reports everyday?     MCA linked triads in JB continue to distribute CSL SEX DVD.

    Yes, this is the latest news I received. In JB, DVDs are still being distributed for free. We’re not talking about JOHOR as a state isolated to Batu Pahat and Labis, but the town area JB itself.

    I know people who’ve been approached by people linked to triads (dvd/vcd peddlars linked to MCA) who were given the DVD Free of Charge.

    The MCA triads are really not afraid of the police at all, as they continue to attack CSL even after he resigned.

    My relative just told me he saw the full DVD quality version. In JB, it is spreading like wildfire and I think the police are going to have their hands full if they intend to sweep every single household.

  43. Maybe we should scrutinise the DVD carefully again. There could be some details hidden in there besides the sex act that the Govt. wants to cover up. Everyone is looking at the uncovered actors and might have missed something there.

    The other reason is it is a lot more fun and far less dangerous for the PDRM to go after porn DVD than chasing robbers and killers. They need a good reason to make themselves relevant. Because if it is just porn they are after, just walk into any DVD stalls and you can have your pick.

Reason is they want to have porn videos but does not want to shell out a few bucks to buy so they resort to legally stealing it from the citizens.   52. last 2week, a client was rob near puchong area after withdrawing 100K near a bank there. while driving, a new honda accord overtake and stop immediately infront of them. on the rear mirror, saw a merz closing to the car rear, then saw few men with parang coming out from this two car. friend manage to run out but left the 100K under the seat. it took them 3 to 5 mins to search the 100K. so i told him, did you call the police, his answer… kayu!

There are several international private investigating company, the most well know is called Kroll Associates who are ex-CIA with just as good resources as the agency who can track it down. In fact they likely have files on each minister/politician and their extra-curricular activities.

    It just cost money at least US$100K for a simple job but they rather spend the money chasing down DVD peddlers trying to make a living.

    I agree police has wide powers to search under various legislations but these ought to be exercised only if there is a reasonable suspicion on police part that evidence of crime is within the premises targeted for such a search to be valid.

    Surely they cannot go around conducting house-to- house searches at random hoping to fish, in that process, something prosecutable as an offence in advancement of their career.

    The words of what constitute an offence under the plethora of existing legislation are so wide that there is no house, I dare say, in the whole country that would not contain an item (whether a DVD or VCD, dildo, book magazine or whatever) for which an offence may be made out by the overzealous prosecutor inclined towards an ultra-legalistic interpretation of the law, thereby making every citizen a potential criminal!

    This ‘maxim’ deserves to be carved in stone in our Constitution, the way it is in the U.S. Constitution.

    Police in Malaysia can enter and search your house without a warrant, and should they find anything that could be evidence to a crime even though it has no relevance to the search, it could be used in court! That without more makes for a police state.

DVD is not the only way to record CSL “wayang”, can record on video tapes, computer hard disks (that disk can be outside Msia), thumb drives, emails (can be in emails memory of someone outside Msia), upload in you tube,and other websites. So pdrm must work harder (may hv to go outside Msia to do the search etc.) to eradicate this CSL “wayang” ! Otherwise pdrm still get grade “F” for this!
